SAN DIEGO (KGTV) — This week, San Diego County will learn whether its coronavirus case rate forces the region to move into California's restrictive purple tier of reopening.If the county is forced to move into the most restrictive tier, several business types will have to enact more stringent capacity limits or move operations outdoors only:Retail stores at 25% capacity indoors,Restaurants can have outdoor dining only,Shopping centers at 25% capacity with closed common areas and a closed food court,Personal care businesses can have outdoor operations after working indoors with modifications.Museums, zoos, and aquariums can operate outdoors only,Places of worship and movie theaters can be outdoors only,Gyms and fitness centers can operate outdoors onlyLast month, California moved personal care services, like nail salons, tattoo parlors, and skin care services, into the same category as hair salons and barbershops. County spokesman Michael Workman said if the region does fall into the purple tier, the new restrictions would take effect 12:01 a.m. Saturday. This time, however, they would not be accompanied by an additional round of federal stimulus money to help small businesses make it through. "It's sustainable for a few months at time, but if you start talking about 12 to 18 months of this you're going to see hundreds and hundreds of restaurants and bars go out of business," said Steve Billings, owner of North Park's Original 40 Brewing Company. Ben Clevenger, President of the San Diego County chapter of the California Restaurant Association, says they are writing a letter asking local and state officials for a one-week extension in hopes the COVID-19 metrics improve.As for their members, he says it's up for each restaurant owner to decide what to do."We keep advising them to do safe social distancing, safe operation practices," Clevenger said. "But at the end of the day, it's up to them, the individual businesses, whether to they're going to stay open or close and follow the guidelines. I think right now, there's a lot of restaurants in survival mode, and they don't have a choice but to stay open and hope for the best."The purple tier also requires a case rate of 7.0 or more and testing positivity of 8% or more. The county's testing positivity has largely sat at 3% to 3.5% for the last four weeks, which falls within the positivity metric for the orange tier of reopening.If the county falls into the purple tier, it will have to meet red tier criteria for two consecutive weeks before it can move forward, according to the state. 3008

Those who came here for a better life say they are contributing to the economy and their communities. They say it's unfair to paint all undocumented immigrants as criminals.Jesus Mendez Carbajal, a DACA recipient and Human Rights Organizer for Alliance San Diego, believes the lawsuit is unfair and infringes on state's rights.However, some U.S. citizens say it's about time an administration took serious action against states.Brenda Sparks recently moved out of California because of its sanctuary laws. She doesn't believe the state is doing enough to protect its legal citizens.Now she lives in Mesa, Arizona.Almost seven years ago, Spark's son Eric was killed when an undocumented immigrant without a drivers license hit him. Sparks believes if the United States was tougher on illegal immigration her son would still be alive today. 1063

SAN DIEGO (KGTV) - The suspect in the shooting death of a man near the 24 Hour Fitness in the Midway area is an undocumented immigrant with a prior immigration violation, according to law enforcement sources.San Diego Police arrived at the rear parking lot of the gym at 3675 Midway Drive February 25 to find Alexander Mazin, 27, suffering from a gunshot wound to the torso. He died at the scene.After the shooting, officers surrounded an apartment at 30th St and Upas in North Park. The standoff ended hours later without an arrest.RELATED: Parents of Midway shooting victim describe son's life, violent murderLaw enforcement sources told 10News the suspect, Ernesto Castellanos Martinez, had a prior “voluntary departure” agreement which meant he had been asked to leave the country after an immigration conviction in 2004. He left, but eventually made it back into the U.S.Mazin’s family said Castellanos had previously been in a relationship with Mazin’s girlfriend of three months.Two weeks before the shooting, Castellanos had attacked the woman while she was working out with Mazin at a gym, Mazin’s parents said.RELATED: Police release pictures of Midway District homicide suspectTheir son’s death has galvanized their support for President Donald Trump’s plan to build a wall across the southern border.“I want President Trump to know about this,” Jeffrey Mazin told 10News. “I want him to be aware there was a true patriot, a wonderful human being that was an exemplary citizen that was lost because of this problem with our border.”But framing their son’s death as an immigration problem worries Dulce Garcia, an immigration attorney and an undocumented immigrant herself.She has protection from deportation through Deferred Action for Childhood Arrivals (DACA). To her, immigration status should be irrelevant in this case.“Someone is going to commit a crime whether they are undocumented here or not,” she argues.Garcia said her reason is that people like herself, who are otherwise law-abiding members of society, are put at higher risk for deportation when they get grouped in with criminal fugitives.“That’s the truly terrifying part for me because I don’t think that’s American. I don’t think we as a nation agree to paint any group based on what one person’s actions did,” said Garcia.Castellanos remains at large. SAN DIEGO (KGTV) - The San Diego District Attorney's Office announced a new program Thursday that would send low-level offenders to the classroom instead of a jail cell.The Community Justice Initiative requires 12 hours of cognitive behavioral therapy, as well as four hours of community service. The participant then has their case dropped and their record sealed. They wouldn't have to report an arrest on any future job application."Some people deserve second chances," DA Summer Stephan said.The program started in the South Bay in April 2018, expanded to the East County in January 2019, then North County in May. It's funded in part by the county, grants, and 0 from each criminal."That amount is less than any fine they would have gotten on any case," Stephan said.So far the program has seen 586 participants. 296 of them completed the program.Director of Cognitive Behavioral Therapy for Adult Justice Programs and Social Worker Laura Soto spoke of one of her patients who completed the program, "she [Amanda] began to spend more time with her son, she got a diploma and she got an office job, and then she started cosmetology school."Amanda was arrested for stealing. Through the program she shifted her mindset away from entitlement."Amanda began to think about the consequences, and things to be grateful for and that made her happy," Soto said."The most common offenses in the program are in fact shoplifting, non DUI traffic violations or vandalism,." Stephan said only non-violent and non-sexual offenders qualify."Misdemeanor convictions can have damaging affects that last a lifetime," she added. Stephan said criminals will continue turning to a life of crime if they can't find a way out.10News asked Stephan what she would say to critics who believe this program could incentivize criminal behavior. She said, "the people who complete the program recidivate at 2% which is so phenomenally low."She compared it to the 16 percent who didn't complete the program and were arrested for a crime again. 2027

SAN DIEGO (KGTV) -- Thousands of people visited Seaport Village Saturday to watch outdoor entertainers at the 14th Annual Busker Fest 2020. As the fear of coronavirus spreads, attendees of the festival seemed unbothered by it.Gather around! Let your eyes and ears feast on the marvels of jugglers, daredevils, and aerialists."Buskers have always been a big part of our history down at Seaport Village," Scott Andrews, Marketing Director of Seaport Village, said. Coming to the festival has become a seven-year tradition for Shannon Steward and her nine-year-old son, Aiden. "I like supporting the street performers!" Stewart said. "I never even knew what a busker was until I found out about this festival."New this year: Busker University. It's a special place where kids can learn about art and busking skills. One of the most popular booths is the slime station. Children can make slime by mixing Borax, water, and glue. After playing at the slime station, the kids are encouraged to wash their hands by using either baby wipes or hand sanitizer.Ahead of the event, San Diego Port Authority added hand-washing stations all along the Embarcadero, to quell growing fears of the coronavirus. Regardless, Stewart said good hygiene is something she always preaches to her family. "We are making sure we are washing our hands, not touching too many things, but obviously, we are kind of diving into the slime and no big deal!" Stewart said. She said she is not going to let fear and hysteria ruin their fun."It's at the forefront of our minds, but it's not changing too much of what we are doing right now," Stewart said. "Now, that may change in a couple of weeks.
