SAN DIEGO (KGTV) — A class-action lawsuit against the University of San Diego wants the school to refund students some tuition fees following the move to virtual learning.The lawsuit, filed by two students, claims the college owes students some of their tuition and fees back due to the switch to virtual learning.The suit says that when the school switched to virtual learning in Spring 2020, students were still charged full tuition even though "USD could no longer provide the promised hours of instruction." The lawsuit claimed that USD also increased its tuition on top of that."Similarly, students paid fees for services and access to facilities and equipment over the full semester. Though USD provided these services and facility/equipment access for only part of the semester, and could not provide them for the full semester, USD demanded that students pay fees for the entire semester," lawsuit documents state.A spokesperson for USD told ABC 10News they have not been notified of or served with the lawsuit.The lawsuit is seeking a "prorated portion of the tuition, fees and other related costs, proportionate to the diminished value of online classes and the amount of time in the Spring 2020 and following semesters when USD ceased in-person classes, campus services and access to campus facilities, continuing through to such time as USD reinstates in-person classes" for the two students who filed the lawsuit and "all others similarly situated." 1470

SAN DIEGO (CNS) - Warning that the change would pose serious threats to public health and safety, the San Diego County Police Chiefs' and Sheriff's Association Monday announced its opposition to a state bill that proposes extending California's daily alcohol sales cutoff time from 2 a.m. to 4 a.m.Chula Vista Police Chief Roxana Kennedy, vice president of the law enforcement group, asserted that Senate Bill 58 -- which calls for allowing bars in 10 cities throughout the state to keep serving drinks for an extra two hours a day as part of a pilot project -- would have negative effects on communities ``that are within driving distance of the cities where the bars (would) stay open later.''``Extending alcohol sales means more drunk drivers during early-morning commutes, more DUI crashes, more injuries and more deaths,'' Kennedy said, adding that the change would ``impact our ability to respond quickly to other emergencies.''Under SB 58, bars in Cathedral City, Coachella, Fresno, Long Beach, Los Angeles, Oakland, Palm Springs, Sacramento, San Francisco and West Hollywood would be cleared to remain open two hours longer each night.The change would affect more than three-quarters of the state's population, according to a letter sent from the police association to the author of the bill, Sen. Scott Weiner, D-San Francisco.Weiner introduced the proposed legislation in December, three months after outgoing Gov. Jerry Brown vetoed a similar bill.Proponents contend that the change would be an economic boon for areas with vibrant night-life scenes and high tourism levels.Alcohol-related problems cost California more than billion annually, including expenses related to public safety, crime, street collisions, injuries and illnesses, the San Diego-area law enforcement agency stated, citing studies by the nonprofit Pacific Institute for Research and Evaluation.That fiscal hit would increase dramatically under the proposed extended alcohol-sales hours, resulting in an estimated 230 percent increase in fatalities and a 179 percent increase in injury traffic crashes, according to the association. 2126

SAN DIEGO (KGTV) -- A 2-year-old girl allegedly abducted by her father in Chollas View, triggering an area Amber Alert, was found safe in Escondido Tuesday morning, San Diego police said.According to police, young Charli-Fae Harris was last seen with her father, Lafayette Harris, in the 1000 block of 47th Street at around 5:30 p.m. Monday.Police were notified of the girl’s disappearance by her mother. SDPD officials confirmed 31-year-old Lafayette Harris is under a restraining order related to domestic violence.After an Amber Alert was issued for the child and her father, police located Harris’ white Saturn vehicle in a parking garage near UC San Diego shortly before 6 a.m. However, Harris and his daughter were nowhere to be found.Harris was eventually tracked down at a construction site near UC San Diego Health System in La Jolla. ABC 10News learned Harris, who works at the construction site, was taken into custody without incident.Charli-Fae was found safe just before 8:15 a.m. in an Escondido apartment. Escondido Police said a woman connected to the child's father was watching the news when she realized she had the child police were looking for in her care, so she then called police to alert them. It's unclear if she knew the child had been taken.The girl will be reunited with her mother later Tuesday.Police said Harris will most likely face kidnapping charges and charges related to violating the restraining order against him, and said there could be more charges added as the investigation continues. 1536

  

SAN DIEGO (CNS) - Two pregnant women in San Diego County have been hospitalized due to flu complications, the county's Health and Human Services Agency announced Wednesday. A 40-year-old woman spent 16 days in the intensive care unit and a 30-year-old woman spent nine days in the ICU. Both women were unvaccinated, in their third trimesters and contracted influenza A. According to the Centers for Disease Control and Prevention, pregnant women have some of the highest risk of developing flu complications if they remain unvaccinated. “That is why they're one of the groups for which vaccination isextremely important," said Dr. Wilma Wooten, the county's public health officer. "Changes in the immune system, heart and lungs during pregnancy make pregnant women (and women up to two weeks after delivery) more susceptible to severe illness from the flu, which could require hospitalization." Officials from the CDC and the Health and Human Services Agency suggest that pregnant women receive the flu vaccine at any point in their pregnancy. However, the nasal spray flu vaccine is not recommended for pregnant women. Flu cases in the county ticked up during the week of Dec. 9-15, according to the county's weekly influenza report. Confirmed flu cases totaled 290 compared to 199 the previous week. The county's overall total of confirmed flu cases is at 940, well behind the 1,641 cases at this time last flu season. Everyone 6 months or older is recommended to get the flu vaccine each year. In addition to pregnant women, health officials strongly advise the vaccination for people with a heightened risk of serious flu complications, like people older than 65 and people with chronic conditions like asthma and diabetes. County residents can get vaccinated at doctors' offices, retail pharmacies, community clinics and the county's public health centers. Residents can also call 2-1-1 or visit the county's immunization program website, sdiz.com, for a list of county locations administering free vaccines. 2021

  

SAN DIEGO (KGTV) -- A 36-year-old man riding an electric scooter suffered severe head injuries when he collided with an SUV at an intersection near Liberty Station.According to San Diego police, the crash was reported around 10:40 p.m. Sunday at the intersection of Byron and Rosecrans streets in Point Loma.Investigators determined the man was riding an electric scooter westbound on Byron Street when he traveled through a red light at the intersection, directly into the path of a Volvo SUV driven by a 20-year-old woman.The victim was taken to a hospital with multiple facial fractures, which Police say are life-threatening.The Volvo driver remained at the scene and cooperated with investigators.Drugs or alcohol were not a factor for the Volvo driver, but Police say the scooter rider was under the influence of alcohol at the time of the crash. 861
