PHOENIX, Arizona — Aaron Wallace was sleeping when he was attacked in his bed.The patient at the Arizona State Hospital was stabbed by Reuben Murray, a fellow patient with a murderous past, who was wandering the halls unsupervised in the middle of the night with a sharpened pencil, according to a recent lawsuit filed against the state.The lawsuit raises new questions about safety and security inside Arizona’s only public psychiatric hospital and whether conditions have improved after sweeping changes and promises were made following an extensive KNXV television station three years ago. The lawsuit also alleges warnings about Murray’s aggressive behavior were ignored in the days before the stabbing.“The place is not better,” said Josh Mozell, an attorney representing Wallace. “Things have not changed. PARKER, Colo. – The Douglas County (Colorado) Sheriff’s Office is investigating the death of an infant that occurred at an unlicensed daycare facility in Parker.The infant was pronounced deceased Wednesday at Sky Ridge Medical Center.“We do have an open death investigation of an infant at 14166 Lexington drive in Parker. The status of the daycare facility is something that we will be looking at during the investigation,” read a statement from the Douglas County Sheriff’s Office.Madlynn Ruble with the Colorado Department of Human Services said the state was aware of an unlicensed and illegal childcare service being operated out of the home after a complaint was filed.The department served a cease and desist order to Amanda Anderson, who is alleged to have been running the daycare service. It’s unclear if any charges were filed.In the complaint, police noted that there were 16 children in the home at the time of incident -- most of the children were toddlers.The coroner’s office has legally identified the infant and an autopsy has been completed. People who watch certain classic Disney movies on Disney+ will see a new, more strongly worded advisory warning about racist content.Disney announced last year when they launched they would include an advisory on some films that read "may contain outdated cultural depictions."Now, the advisory has stronger wording, and will be included on films like “Peter Pan,” “Dumbo” and “Lady and the Tramp” that contain racist or insensitive content. In a statement on their website, they explain their decision to add an advisory.“As part of our ongoing commitment to diversity and inclusion, we are in the process of reviewing our library and adding advisories to content that includes negative depictions or mistreatment of people or cultures. PALA MESA, CA (KGTV) -- 10News is now digging deeper in the history of violations issued to the company that operated the bus that was involved in this rainy Saturday's deadly crash on I-15 just south of Pala Mesa. “One life lost is too many,” says Chris Turner with the Commercial Vehicle Safety Alliance. We spoke to him over FaceTime on Monday. The bus was operated by Executive Lines Inc., based in El Monte. According to the federal administration that oversees bus inspections, the company's fleet has had no crashes over the past two years, until now. However, they have had 26 maintenance violations, reportedly. After a November 2019 inspection, the same bus that was involved in this weekend's crash was reportedly issued two violations related to windshield wipers and spare fuses. Turner says violations like those should’ve been fixed right away. “Those need to be remedied before the vehicle is dispatched again,” he adds.10News spoke to attorney Nathan Morris about a separate major bus crash that happened last September in Utah, injuring 22 tourists. He's representing seven of the victims. “[I’m representing] three of those who were killed in the crash and their families as well as four others who were injured to various degrees,” he adds.Morris says bus passengers can look online for a snapshot of a company's safety. “They have a right as passengers of that bus to make sure that the driver and the companies and anybody else are held accountable for keeping the rules,” he says.“You enter the company's USDOT number and it will tell you whether or not they’re a safe company,” says Turner of researching bus companies online. A USDOT number is issued by the Department of Transportation. If you can’t find it on a company’s website, Turner says you can make a phone call. He adds, “One of the things they should readily give you when asked is the USDOT number and if not, that's immediately a red flag. PHOENIX (AP) — Police served a search warrant Tuesday to get DNA from all male employees at a long-term care facility in Phoenix where a patient who had been in a vegetative state for years gave birth, triggering reviews by state agencies and putting a spotlight on safety concerns for patients who are severely disabled or incapacitated.Hacienda HealthCare said it welcomed the DNA testing of employees."We will continue to cooperate with Phoenix Police and all other investigative agencies to uncover the facts in this deeply disturbing, but unprecedented situation," the company said in a statement.Local news website Azfamily.com first reported the woman, who had been in a vegetative state for more than 10 years after a near-drowning, delivered a baby on Dec. 29. Her identity has not been reported, and it's not known if she has a family or a guardian. It's also unclear if staff members at the Hacienda de Los Angeles facility were aware of the pregnancy until the birth.In a statement, board member Gary Orman said the facility "will accept nothing less than a full accounting of this absolutely horrifying situation.""We will do everything in our power to ensure the safety of every single one of our patients and our employees," Orman said.Hacienda CEO Bill Timmons stepped down Monday, spokesman David Leibowitz said. In the wake of the reports, the Arizona Department of Health Services said new safety measures have been implemented. They include increased staff presence during any patient interaction, more monitoring of patient care areas and additional security measures involving visitors.The state's online complaint database for care facilities shows multiple complaints about Hacienda de Los Angeles going back to 2013. Most of them involve fire drill and evacuation preparation or Medicaid eligibility. But one complaint from December 2013 outlines an allegation that a staff member made inappropriate sexual comments about four patients two months earlier. Nobody relayed the incidents to an administrator. That employee was later fired.Martin Solomon, a personal injury attorney in Phoenix whose clients are mostly vulnerable adult victims of abuse and neglect, said a lawyer representing this woman should call for all pertinent medical records, a list of current and ex-employees and any past litigation involving Hacienda. It would be the police who would lead DNA testing to figure out who fathered the baby, Solomon said.It would be hard for Hacienda to escape any kind of liability in court."There's a lot of information we do not have, But things like this don't happen without someone either knowing about it or should have known about it," Solomon said. "Whether it's an employee or someone from the outside, the facility has an obligation to protect residents."Advocates for the disabled say Arizona needs to find a way to monitor allegations of sexual abuse and sexual violence in these group settings. Doing background checks isn't enough, said Erica McFadden, executive director of the Arizona Developmental Disabilities Planning Council."I think when you've had somebody who's had multiple allegations from different parties, there has to be some way to track that," McFadden said. "If it's the same story from different people, then there's something wrong."The council recently formed a task force to look at how to improve training for health care workers when it comes to identifying and reporting sexual abuse."We don't have a systematic way to train people what's a good touch or a bad touch. We also don't have required training for providers," McFadden said. "We really need a lot of work in this area."Jon Meyers, executive director of The Arc of Arizona, an advocacy group for people with intellectual and developmental disabilities, called the allegations "disturbing, to put it mildly.""I wasn't there. I clearly don't have firsthand knowledge of what happened," Meyers said. "But I can't believe someone receiving that level of constant care wasn't recognized as being pregnant prior to the time she delivered." 4413
