SAN DIEGO (KGTV) -- If you've ever gone out in the Gaslamp, you know how busy it can get. Nothing will ruin your night more than finding out your car's been towed.That's exactly what's happened more than 1,000 times since the city converted Fifth Avenue to a three-minute passenger loading zone after 8 p.m. on Friday and Saturday nights in September 2016. "They really don't ask questions around here," said Vanessa Figueroa, who hands out fliers for Gaslamp BBQ on the corner of 5th and Island every Friday and Saturday nights. "If you're parked here, your car's gone."The city made the change to reduce gridlock, boost emergency response times, and make passenger drop-offs safer. But that's also meant a lot of towing. In the first year, the city towed about 1,200 cars - drivers either missing the warning signs or getting confused by different ones next to each other.RELATED:  906

SAN DIEGO (KGTV) - It is an effort to remove guns from dangerous people and an aggressive strategy by the City Attorney's office to implement a law that has been in place since 2016. Since the beginning of the year, the City Attorney’s office obtained 25 gun restraining orders, affecting teenagers to senior citizens.  “I think we have opened people's eyes to the availability of a tool that works,” said City Attorney Mara Elliott. “I think we all recognize that there are some people that should not have a gun or access to a gun.” It's a push to use a law Elliott said is underutilized. Now, she's training law enforcement to use it more.  These civil restraining orders prohibit someone from having a gun or ammunition. Law enforcement or close family members can request it if they're afraid someone will hurt themselves or others. A temporary order is issued until a hearing for a permanent one takes place. “It's not the city attorney or the police department making the determination... ultimately it's somebody that's got no horse in the race... a judge,” Elliott said.  This law came after a 2014 murder spree near Santa Barbara. Elliot Rodger stabbed three young men to death, then shot and killed three others. His family reported mental health concerns before the shooting.  “In the past, we had to wait for a tragedy. We don't have to wait anymore,” Mara Elliott said.  The City Attorney's office represents law enforcement in court.  Those with these restraining orders range in age from 19 to 81. All were men, except one. About a quarter involved were either current or former military. A City Attorney spokesperson said these numbers do not include minors that were connected to school shooting threats.  Team 10 spoke to one man who received a restraining order against him. He agreed to talk to 10News if he was not identified. According to the man, a fight with his wife was the catalyst for the restraining order. He claimed that he did not threaten his wife. “No, we never had a violent thing. Just words,” the man said.  It was a different story in the court petition. It said his wife was afraid and that the 81-year-old threatened “to shoot her” and the neighbor. His son, according to documents, was worried his parents were losing their sanity. It also showed he was arrested several years ago for domestic violence, but the charges were dropped. Still, he called the restraining order against him unfair. “I think every case is different. It depends on people you’re dealing with,” he said, calling himself a safe gun owner.  That man’s guns are at the San Diego Police Department. Under this law, guns are surrendered to law enforcement. An individual could also store them or sell them to a licensed firearms dealer. A permanent restraining order lasts a year. It expires unless someone seeks an extension. “We’ve done a lot to try and calm the nerves of those concerned about their Second Amendment rights,” Elliott said.  “Conceptually, the idea of taking firearms from criminals or people that are mentally unfit is something we stand behind,” said Michael Schwartz with the San Diego County Gun Owners PAC.  However, he still had concerns after meeting with the City Attorney. “If they've already broken the law, then we can take firearms from criminals or people that are mentally unfit. If they haven't broken the law, then why are we taking firearms from them?” Schwartz asked. He is also concerned about the potential for abuse of this law. The City Attorney's office said orders are issued when it’s not clear when or if a person will be charged or someone hasn't been convicted yet and the public needs protection. “I'm hoping that it makes people feel safer and it saves lives and I'm convinced we've done that,” Elliott said.  Elliott said it is still too early to determine any kind of trend of those served with a restraining order. There is a proposal right now to expand this law, allowing co-workers and school employees to request these types of restraining orders. That is heading to the Senate.     4173

SAN DIEGO (KGTV) - If you owe San Diego County property taxes, the deadline to pay is not changing.The County Treasurer-Tax Collector’s office tells 10News state law governs when property taxes are due and payable.In a statement, a spokesperson for the department said, “The second installment of property taxes is due no later than April 10. State action would be required to change the date. Critical county, school, and local city financial obligations are dependent on property taxes. They fund essential public services, including coronavirus response.”Several local politicians have pushed for state officials to change the deadline to allow property owners to pay their taxes late without consequence.Last week, San Diego City Council President Pro Tem Barbara Bry wrote a letter to the governor asking him to consider an Executive Order directing all county treasurer-tax collectors to defer April 10, 2020, property tax payments until July 15, 2020. The letter states, “This is in line with the announcement that both the Internal Revenue Service and California Franchise Tax Board are postponing tax deadlines until July 15, 2020 due to the COVID-19 pandemic.”Assemblywoman Lorena Gonzalez has publicly asked San Diego County Treasurer-Tax Collector Dan McAllister to waive late payment penalties.“State law already allows Mr. McAllister to waive any fees and the 10 percent penalty for late payments on a case-by-case basis. I would urge him to use that power to relieve San Diego County’s homeowners and businesses of these penalties during this dire situation we are experiencing,” Gonzalez said in a statement to 10News.The California Association of County Treasurers and Tax Collectors posted a statement on its website stating that tax collectors have the authority to handle specific scenarios where a taxpayer cannot physically pay their taxes on April 10 due to quarantine, illness or closure of the tax collector’s office as a result of COVID-19. The statement continues, “In such cases, the Tax Collector will utilize their authority pursuant to Revenue and Taxation Code (RTC) 4985.2. to waive interest or penalties that would otherwise be imposed or collected with respect to a delinquent second installment of property taxes levied for the 2019-2020 fiscal year on residential real property.”The San Diego County Treasurer-Tax Collector’s office told 10News that McAllister has no authority to extend the April 10 deadline as outlined in state law. However, taxpayers unable to pay on time can submit a penalty cancellation request after the April 10 deadline. The department reviews these requests on a case-by-case basis, and general guidelines are provided on the request form. A spokesperson for the office said all property owners who can pay their taxes on time are encouraged to do so. This revenue helps keep the government running and provides vital services that the public relies on, especially in times like these. Taxpayers can pay online, via telephone or by mail. SAN DIEGO (KGTV) -- King tides are expected to continue in San Diego on Sunday following a day of flooding in parts of the county Saturday. High tide is set to happen at 9 a.m. with low tide set to take place around 4:10 p.m., according to tide charts. King tides occur when there is an alignment of the gravitational pull of the sun and the moon. RELATED: Sandbags available in San Diego CountySome parts of Imperial Beach already experienced tidal flooding Friday morning as several homeowners reported water entered their homes.The City of San Diego built a three-foot temporary berm along parts of the bay in Mission Beach to help mitigate the risk of coastal flooding.
