SAN DIEGO (KGTV) — California has rejected San Diego County's request for a tier adjustment after the region was moved into the state's purple reopening tier.The county said that "San Diego’s increased cases are not due to the sectors impacted by moving into a more restrictive tier. County has interviewed cases to identify potential exposure settings and tracked community outbreaks."County health officials say businesses that will be impacted by purple tier restrictions saw the following breakdown of COVID-19 cases in October:Restaurant/bars: 7.4% of COVID-19 cases (715 of 9,646)Retail: 6.6% of COVID-19 cases (636 of 9,646)Places of worship: 1.9% of COVID-19 cases (184 of 9,646)K-12 schools: 1.7% of COVID-19 cases (165 of 9,646)Gyms: 0.4% of COVID-19 cases (39 of 9,646)In reference to October's data, the county said that, "outbreak data also show these sectors make up a small percentage of the cases overall ... Penalizing the impacted sectors for case increases is wrong, as these sectors continue to do the right things, while trying to weather the ongoing pandemic and the back and forth of re-openings."The county pointed to many local restaurants as an example of improving its mitigation efforts and investing in materials to make their settings safe for visitors, adding, "additionally, the closure of indoor restaurants, especially during the wintertime where outdoor dining is not optimal, will move individuals into homes and encourage gatherings, which is one of the high-risk areas for cases."Despite the request, the state decided on Sunday that the county will remain in the more restrictive purple tier.COUNTY'S EXPOSURE DATA (Oct. 25 - Nov. 7)According to county public health officials, between Oct. 25 and Nov. 7, there were a reported 5,576 COVID-19 cases.Of those cases, 3,833 cases were interviewed for contact tracing and 2,260 cases reported at least one of the potential exposure settings:Restaurant/bars: 389 casesBeach: 10 casesCasinos: 20 casesGroup gatherings: 159 casesGyms: 18 casesHair salon or barber: 97 casesPlaces of worship: 118 casesProtest: 0 casesRetail: 308 casesWork: 1,314 casesOther: 158 casesThe county says 1,573 of the 3,833 cases reported no potential exposure settings.Of all the cases between Oct. 25 and Nov. 7, the county says that people reported the possible exposure settings:Household exposure: 1,311 casesTravel-related exposure: 814 casesAny education-related exposure: 172 casesThrough Nov. 7, San Diego County has reported a total of 60,169 COVID-19 cases and 908 deaths from the virus. 2566

SAN DIEGO (KGTV) -- Boulevard Fitness in University Heights is open for business, with a line of people wrapped around the building waiting to go inside to workout on Tuesday, even though they’re not supposed to be open.Last week, San Diego County Supervisors said the county would be cracking down on businesses that violate public health orders put into place due to the coronavirus pandemic.A gym owner in Ramona was recently charged with several misdemeanors for staying open for indoor workouts. The San Diego County District Attorney’s Office said Peter San Nicolas, owner of Ramona Fitness Center, faces five charges that each carry ,000 fines.However, at Boulevard Fitness, staff members told ABC 10News they’ve had visits from police telling them they should not be open, but nothing more.The gym on El Cajon Boulevard is limiting the number of people inside and increasing cleaning and other measures to try to limit the risk of potential virus exposure to gym members.A San Diego Police Department spokesperson said officers are responding to complaints about businesses that are open when they’re not supposed to be, but police are -- at this point -- only educating businesses that may be in violation of the health order and not physically forcing any shutdowns.San Nicolas is holding a rally in Ramona Tuesday night in hopes of getting the word out that small businesses, including gyms like his, are still trying desperately to survive -- even if, in some cases, it means facing charges to stay open. 1526

SAN DIEGO (KGTV) -- Awaken Church continues to hold indoors services, despite orders from San Diego County to close all indoor religious services due to COVID-19 restrictions.According to the San Diego County website, three of the Awaken Church locations have received cease and desist orders. The location at 7620 Balboa Ave. received a cease and desist order July 17, 2020; the Carlsbad location received one Nov. 16, 2020; and the Chula Vista location received one Nov. 19, 2020.RELATED: Churches pushing back against purple tier restrictionsIn addition, San Diego County put out a notice that anyone who went to the location at 7620 Balboa Ave. between Nov. 15 and Nov. 22 needs to quarantine for two weeks because of a community outbreak. The county said a community outbreak had occurred there, which is when there are three or more reported cases from different homes in the span of two weeks.An attendee at the San Marcus location said he feels comfortable attending in person and indoors.“I think it’s really about having individual choice and trusting people to have the intelligence to do the right thing, and this church has a wonderful uplifting message that I think is so positive and hopeful for people in a time where we find ourselves somewhat down,” said Brian.Brian said that the San Marcos facility is spacious so people are able to spread out, adding that the right to worship freely is in the constitution.RELATED: County asks Kearny Mesa church attendees to quarantine after COVID-19 outbreak“Try to preserve as much of our freedoms and liberties as we can. Also, the website asks attendees to refrain from posting pictures and videos of the services on social media.A video of church leaders posted on the website describes their decision to remain open for in person and indoor services.“We’ve made this decision not out of defiance but out of obedience to God,” two people said in a video on the website, adding that they plan to continue in person services.A county spokesperson said if a cease and desist order is ignored, the next step would be a closure order. After that, law enforcement is asked to get involved by giving citations with a thousand dollar fine for each violation; then the case goes to either the San Diego District Attorney or City Attorney. 2635

  

SAN DIEGO (KGTV) -- City Council members Friday announced a plan to push for a temporary shelter for the homeless in Murphy Canyon.Council members Lorie Zapf and David Alvarez will hold a news conference Monday to request that a shelter be built at the former Chargers training facility.The complex, owned by the city, has remained unused since the Chargers moved to Los Angeles and will likely remain vacant for several more years.Announcing the press conference, the councilmembers said, “The San Diego River has seen an explosion of homeless encampments this year. This is an environmental nightmare and extremely dangerous with the rainy season rapidly approaching.”More than 100 homeless encampments were counted by volunteers with the San Diego River Park Foundation in October. 792

  

SAN DIEGO (KGTV) — Bystanders captured video of a truck involved in a crash near San Diego International Airport on Saturday speeding away from the scene.The video begins moments after a three-car crash on N. Harbor Drive at Lee Court around 9:30 a.m. A white truck reportedly slammed into the back of a Ford F-350 and sideswiped a sedan, according to the driver of the sedan, Kathleen Gleason. The driver of the white truck is then seen speeding away, creating a cloud of white smoke, with the driver-side front tire bent sideways. The driver first heads eastbound before turning around at McCain Road and heading westbound. A police vehicle is seen seconds later turning around and pursuing the truck.Gleason, a Lyft driver who was struck by the truck, told ABC 10News the suspect was determined to get out of the area quickly. She said she was in the middle of dropping off a passenger to the airport when she was struck. Thankfully, Good Samaritans gave the passenger a lift the rest of the way, she said.Gleason said police caught up with the driver and arrested the person. ABC 10News reached out to San Diego Police about what charges the driver faces, but have not heard back. 1192
