(KGTV) — Defense attorneys for 15 Marines accused of human smuggling said they hope the judge dismisses the case.The attorneys argued that the Commander illegally used his power to discipline the Marines publicly, and therefore influenced the outcome of the case.It was a very public display of discipline.Fifteen Camp Pendleton Marines were cuffed and taken away by NCIS agents in front of an 800-person battalion formation in July. They were accused of human smuggling and conspiracy.But now, attorneys representing a few of the accused Marines said the public arrests violated their rights. Now, they are filing what's called an "undue command influence" motion against the Battalion Commander who led the formation."Anytime you have a Commander who is in a position of leadership who potentially affects a subordinate's rights to a fair trial, that can be viewed as potential 'undue command influence,'" military attorney Gary Barthel explained. "This motion for 'undue command influence' was made against the Battalion Commander for making comments and parading the 15 individuals out for what was supposed to be a recognition, and they were ultimately arrested." Barthel is a former legal advisor to Camp Pendleton's Commanding General. He said a Commanding Officer's job is to maintain good order and discipline their command. But in military law, they also wear the prosecutor and jury selector hats."Those two hats can clash," Barthel said. "That's why it's important for Commanding Officers to be careful what they say with regard to their views of the military justice system, or their views of a particular individual who has been accused of an offense."The defense team said the Commander used his power to influence the outcome of the case unfairly. But Barthel said in his experience with 'undue command influence' cases, he believes the military has likely already taken the Commander in question off the case."You can take the individual that allegedly made the statements involved out of the process, and that keeps the process fair and impartial," Barthel said. (AP) — A federal judge has ordered the U.S. Census Bureau for the time being to stop following a plan that would have had it winding down operations in order to finish the 2020 census at the end of September. The federal judge in San Jose, California, issued a temporary restraining order late Saturday against the Census Bureau and the Commerce Department, which oversees the agency. The order stops the Census Bureau from winding down operations until a court hearing is held on Sept. 17. The head count of every U.S. resident every ten years helps determine how .5 trillion in federal funding is distributed and how many congressional seats each state gets. Those who have not filled out the paper census yet can fill it out online by going to the official census 2020 website. The temporary restraining order was requested by a coalition of cities, counties and civil rights groups that had sued the Census Bureau, demanding it restore its previous plan for finishing the census at the end of October, instead of using a revised plan to end operations at the end of September. The coalition had argued the earlier deadline would cause the Census Bureau to overlook minority communities in the census, leading to an inaccurate count.Because of the coronavirus pandemic, the Census Bureau pushed back ending the count from the end of July to the end of October and asked Congress to extend the deadline for turning in the apportionment numbers from December, as required by law, into next spring. When the Republican-controlled Senate failed to take up the request, the bureau was forced to create a revised schedule that had the census ending in September, according to the statistical agency. 1720

OCEANSIDE, Calif. (KGTV) — Oceanside city officials are asking for developers to submit their bids to create an "iconic" downtown sign for the city, similar to areas of the county like the Gaslamp District, North Park, and Escondido.The city's request for proposals calls for a sign that will act as a new landmark and "the heart of the Sunset Market" at the intersection of Tremont Street and Pier View Way.The sign must be an "over-the-road" style sign that spans the intersection and aims to, "create a 'place' that locals and visitors are invited to enjoy for decades to come," the city says.Candidates can submit an initial design by January 13, 2021. The top five candidates will be granted ,000 and four weeks to flesh out their designs, budget, and other aspects. The city's Property and Business Improvement District will then choose the best three to go before a public vote.
