SAN DIEGO (KGTV) — The City of San Diego could go to court to invalidate a landmark pension reform measure that voters overwhelmingly supported in 2012.The City Council is expected to meet in closed session the week June 10 to decide whether to ask a judge to throw out Measure B. The measure switched most new hires from pensions to 401(k) style retirement plans. More than 65 percent of San Diego voters supported Measure B in 2012. The problem, however, is that the measure got to the ballot via a citizens initiative, but then-Mayor Jerry Sanders campaigned on its behalf. Labor unions challenged the initiative in court, contending the mayor's involvement meant the city needed to meet and confer with them. The state Supreme Court agreed, and an appellate court ordered the city to make its employees whole, plus pay them 7 percent interest. The courts, however, did not invalidate Measure B, instead directing the city to work out a compromise with the unions. On Thursday, City Councilman Scott Sherman and former Councilman Carl DeMaio held a news conference pushing the city to protect Measure B."Right now we are being asked to go against what our bosses told us, and I don't think we should do that," Sherman said, adding that the city spends 0 million a year now meeting its minimum pension obligations. DeMaio said he would work with a coalition to go to court to protect Measure B. "I'm talking about putting the City of San Diego back on the brink of bankruptcy, let alone telling voters that they don't have a say on where their tax dollars go," he said. Early estimates indicate the amount needed to make employees whole ranges from negligible to million.Michael Zucchet, who heads the Municipal Employees Association, said the only rational way to move forward is to invalidate Measure B."It is time for the City and its citizens to move forward by ending the Prop B debacle with the least amount of additional litigation and expense, and at the same time help address the City’s severe recruitment and retention challenges brought about because San Diego is the only City in California with no defined benefit pension nor Social Security benefits for newly hired employees," Zucchet said in a statement.Mayor Kevin Faulconer said in a statement he would oppose any effort to get rid of Measure B. SAN DIEGO (KGTV) - The fate of a beloved torrey pine - saved from the chopping block more than seven years ago - is once again in question.Along tree-lined Long Branch Avenue, one tree has captured the hearts of Jeff Ray's family."My kids loved it.  They touch it all the time.  It's wonderful," said Ray.The towering torrey pine is believed to be about 90 years old."It signifies the beauty of nature and the history of the area," said Ray.The history includes safety concerns. In 2010, with the sidewalks buckling, city experts deemed it a safety hazard, concerned the leaning tree would fall over. Upset neighbors hired their own arborist. Eventually, the city relented, deeming the tree stabile and repairing the sidewalks.  Since then, the tree has been granted Heritage status, giving it extra protections. Still, safety concerns remain.  On Wednesday afternoon, a city advisory panel met and the city's forester told the group the tree isn't just learning. It's actually on the move."The tree has moved an inch-and-a-half in the last two-and-a-half years. The city is recommending removal of the tree based on safety," said City Forester Brian Widener. 1192

SAN DIEGO (KGTV) -- The growing concerns over the coronavirus are impacting the daily routines of people across San Diego. Some businesses are changing the way they do things. CorePower Yoga has dozens of studios across San Diego. Monday morning, the company sent an email to its staff and clients outlining several precautions. Chloe Delehanti works out at the Mission Valley location."I've lived through SARS and Swine Flu, and I don't remember it being this serious of a concern, certainly never getting emails from my gym, or travel alerts, so it's definitely concerning," said Delehanti. The email stated the company is increasing its cleaning protocols and reducing the use of props and physical contact between teachers and clients. "Obviously, I really like adjustments and having that component in class, but I think it's a good idea to be as safe as possible, considering that it is a really growing concern, and there's a lot of new cases," said Delehanti.A salon in Hillcrest is also changing the way it does business. Stylists at Brightside Barber will now have the option of turning away customers who appear sick. "From here on out, not to feel like you can't turn someone away, if they are visibly sick with a fever, coughing," said Angelic Corona. She's been in the business ten years and said she's never seen anything like this. "I was relieved, cause you know, in customer service, it's kind of always been the customer is always right, but in this scenario it's health and safety for everyone," said Corona. A few doors down at Ralphs, shoppers, like Tyler Armstrong, were stocking up on cleaning supplies. "I think it's crazy, and I think a lot of people aren't taking it as serious as they need to, and I think we have something serious on our hands," said Armstrong. 1800

SAN DIEGO (KGTV) - The California Senate will vote this week on a bill to add a surcharge to utility bills, with the money going to pay for damages caused by wildfires.Governor Gavin Newsom says he wants the bill on his desk to sign by Friday before the legislature takes its summer break.According to the text of Assembly Bill 1054, each utility company would have to "collect a nonbypassable charge from its ratepayers to support the Wildfire Fund." That money would go to pay for damages from wildfires caused by utility companies.But the fund can only be used if the utility companies comply with state safety laws and regulations.The bill also requires each electric company to file a wildfire mitigation plan with the state every three years, and update it yearly.Critics say it's nothing more than a tax, passing the responsibility of wildfire damage away from the utility companies and onto rate-payers."This is going to be a tax that will go on, who knows how long," says Richard Rider from the San Diego Tax Fighters. "Long after the utilities have buried their wires, long after the risk has dropped dramatically, the ratepayers will still be paying it."Rider says this bill would unfairly make people in low-risk areas pay into a fund that would only benefit people in high-risk areas.RELATED: PG&E equipment may have caused Camp FireAn SDG&E spokesperson says the company does not have an official position on AB 1054 but sent a statement to 10News saying:"We believe this bill is a good starting point for legislation to be enacted by July 12 to help address some of the legal, regulatory and policy challenges facing California, as the state grapples with the wide-ranging impact of catastrophic wildfires. We look forward to reaching a final agreement with the Governor and Legislature that meaningfully addresses the crisis posed by wildfires. SAN DIEGO (KGTV) -- The magic of the holiday classic "The Nutcracker" couldn't be stopped, even by a pandemic, as the San Diego Civic Youth Ballet has figured out a way for the show to go on.We're used to seeing this ballet with its lavish sets on an indoor stage with dancers close together, but this season things will look different because the virtual show will be outside with dancers wearing masks and distancing.Lucia del Rio stars as Clara and says, "I'm just really excited to be doing it at all. It's like in the beginning it was kind of hard to see how it was going to work especially since we were on Zoom. The most exciting part for me is being around everyone even if we have our masks on."The 9th grader from Academy of Our Lady of Peace says while they have had two in-person rehearsals following safety precautions, most rehearsals have been from home alone via Zoom."It's just very tough.. My floor is not good, my floor is very slippery." San Diego Civic Youth Ballet Artistic Director Danika Pramik-Holdaway has been on the other end of those Zoom rehearsals and says they've all had to overcome a few obstacles."Knowing who they stand next to, who they go behind, how they go in their direct order, when you're on Zoom at home by yourself that's very very challenging," says Pramik-Holdaway.But the students were up to the task and with hard work, Lucia and the other dancers have been able to turn lonely Zoom rehearsals into something special. The small group performance outside the Casa del Prado Theater will be recorded so people can watch online. It will be a simplified, shorter version of The Nutcracker, but the beloved scenes will still be there. Lucia says, "It's really really special. It's kind of a gift to be able to dance with people in the holiday season, so I'm really excited about that."Not to mention a virtual trip to see the Sugar Plum Fairy could yield a sweet reward --- more viewers than usual. Pramik-Holdaway says, "I'm sure we'll have definitely a lot of grandparents, who don't live here in San Diego, get to see their grandkids dance."They both agree that holding onto cherished traditions like this one, even if they have to be adapted, is something we need right now."Since we're in Balboa Park we have people walking through the park and everyone stops by and says, 'Oh, the Nutcracker!' They hear the music and I think it makes everyone feel like things are going to be okay again," says Pramik-Holdaway.SDCYB is celebrating its 75th anniversary this year and ticket sales help keep this nonprofit going.
