SAN DIEGO (CNS) - A Lemon Grove man who aimed a laser pointer at a San Diego police helicopter during a police protest this summer is facing a maximum possible sentence of five years in prison following his conviction by a federal jury, the U.S. Attorney's Office said Thursday.Rudy Alvarez, 25, was found guilty by a jury in San Diego federal court late Wednesday for shining a laser at the SDPD chopper around 8:30 p.m. June 4 in the area of 500 University Ave.The U.S. Attorney's Office said Alvarez shined the laser at the chopper multiple times over the course of an hour as he marched with protesters through downtown San Diego.The count of aiming a laser pointer at an aircraft carries a maximum possible sentence of five years in prison and a 0,000 fine. Sentencing is scheduled for Feb. 22.U.S. Attorney Robert Brewer called the result "a very important verdict" and said "This kind of crime could have a disastrous impact if a pilot's sight is compromised. We support the Constitutional rights of free speech and assembly, but the rule of law must be respected. It's there for a reason -- to protect the public and law enforcement from danger."Earlier this year, the U.S. Attorney's Office also charged San Diego resident Stephen Glenn McLeod with the same count for allegedly directing a laser at a San Diego Police Department chopper multiple times during a protest on Aug. 28. SAN DIEGO (CNS) - Mayor Kevin Faulconer announced Wednesday that more than 2,000 businesses in the city have received grants from San Diego's COVID-19 Small Business Relief Fund, impacting nearly 10,000 full-time jobs with half of the recipients operating in underserved communities."Across the nation, small businesses are closing in alarming numbers because of the pandemic. We're doing everything we can to stop the hemorrhaging of small businesses in San Diego," Faulconer said. "We've been able to help 2,000 businesses survive for another day, but we know the need is great so I encourage San Diegans to do what they can to support their favorite local businesses during these trying times."Faulconer created the fund in March to offer support to local employers so they could sustain operations, retain employees and address unforeseen reductions in consumer demand and production. SAN DIEGO (CNS) - A judge took under submission today a motion by the federal government to dismiss a lawsuit filed by the cities of Imperial Beach and Chula Vista and the Port of San Diego, alleging that the International Boundary and Water Commission is violating the Clean Water Act by not doing more to prevent Tijuana sewage from flowing into San Diego area waters.The federal government maintains that the IBWC isn't legally responsible for the sewage flowing into U.S. waters from Mexico.But the plaintiffs claim that since the IBWC oversees a flood control channel that redirects the Tijuana River on its way to the Pacific Ocean, as well as water- capture basins in five canyons along the border, the agency is responsible for the sewage that gets through those systems.RELATED: Imperial Beach businesses hurt by sewage & runoff related closuresImperial Beach Mayor Serge Dedina, who has led the fight to against the IBWC since his city was hit with millions of gallons of raw sewage in February 2017, said it was heartening to hear U.S. District Judge Jeffrey Miller say he might go to the South Bay to see first-hand how the situation is being handled.Dedina said the plaintiffs got a fair hearing. SAN DIEGO (CNS) - After being reassured that motorists' privacy would not be compromised, the county Board of Supervisors Wednesday unanimously approved a plan to electronically collect license plate data as part of a vehicle- emissions study aimed at improving air quality.Under the plan, the county Air Pollution Control District will use automated license reader software to analyze vehicles at 12 intersections in disadvantaged communities, including Barrio Logan, Logan Heights, Sherman Heights and western National City.A state grant will pay for the ,500 automated license plate reader system, which will collect license plate numbers and vehicles' weight, make and model.Jon Adams, assistant director of APCD, said the data will be collected in a secure method and kept at the district office, and would not be shared with anyone else. He said information, including license plate numbers, will be deleted after three days.Other agencies, including the California Air Resources Board and Port of San Diego, already use the same software, Adams said.APCD officials met over the last two months with various community groups and the Portside Community Steering Committee, which includes representatives of private and public organizations.The district's Community Air Protection Program was developed in response to Assembly Bill 617, which is aimed at reducing exposure to air pollutants in disadvantaged communities.At its Sept. 11 meeting, the Board of Supervisors expressed concerns over potential privacy violations and asked district officials to present alternatives.Two residents urged the board to support data collection, saying the end goal of cleaner air is a worthy cause.Sandy Naranjo, a Portside Steering Committee member, said "information and transparency are crucial for our communities, because we are tired of getting sick."Joy Williams, an Environmental Health Coalition member, said her group has been working in Barrio Logan and surrounding communities for decades and heard numerous complaints about pollution sources, including mobile ones.Supervisor Greg Cox said any time the county can get so many groups to agree, it's a good sign and "makes it a pretty easy decision on our part."Supervisor Kristin Gaspar said she appreciated the reassurances relating to privacy."I believe that we have the best intentions with this program," Gaspar said.Supervisor Nathan Fletcher said no group of children should be "eight times more likely to develop asthma because of where they live or the color of their skin.""We have to take swift, bold action and spend money in a way that represents the greatest investment," Fletcher said, adding he hopes this program gets underway quickly. 2716
