SAN DIEGO (KGTV) — A class-action lawsuit against the University of San Diego wants the school to refund students some tuition fees following the move to virtual learning.The lawsuit, filed by two students, claims the college owes students some of their tuition and fees back due to the switch to virtual learning.The suit says that when the school switched to virtual learning in Spring 2020, students were still charged full tuition even though "USD could no longer provide the promised hours of instruction." The lawsuit claimed that USD also increased its tuition on top of that."Similarly, students paid fees for services and access to facilities and equipment over the full semester. Though USD provided these services and facility/equipment access for only part of the semester, and could not provide them for the full semester, USD demanded that students pay fees for the entire semester," lawsuit documents state.A spokesperson for USD told ABC 10News they have not been notified of or served with the lawsuit.The lawsuit is seeking a "prorated portion of the tuition, fees and other related costs, proportionate to the diminished value of online classes and the amount of time in the Spring 2020 and following semesters when USD ceased in-person classes, campus services and access to campus facilities, continuing through to such time as USD reinstates in-person classes" for the two students who filed the lawsuit and "all others similarly situated." 1470

SAN DIEGO (KGTV) -- A 17-year-old boy accused of killing a Carlsbad woman on a popular hiking trail denied the allegations against him during a virtual arraignment Thursday morning.Through his attorney, the teen denied all allegations. He faces charges in connection with the Nov. 23 death of 68-year-old Lisa Thorborg.Thorborg was on a morning walk at Hosp Grove Trail when Carlsbad police investigators said she was attacked and stabbed to death.On Dec. 14, Carlsbad police announced the arrest of a 17-year-old boy in the case. Little information on the teen was released, but police noted the suspect is a Carlsbad resident.Thorborg's death struck a chord with many in the community. In the days following her death, a large group came to honor her by finishing the walk she started.The woman’s death also left many neighbors upset and concerned about their safety while on that trail.During Thursday’s arraignment, the judge also granted the teen's request to two phone calls -- one to his Mom, the other to his grandmother.ABC 10News learned Thorborg’s family was also listening to the hearing through the phone.Another hearing in the case is set for Dec. 22. 1173

SAN DIEGO (KGTV) - A group of friends from Del Norte High School in 4S Ranch have turned their summer boredom into a way to help others.Andrew Zhang, Jerry Wu, Nick Genovese and Rishi Peddakama are 3D printing face shields and donating them to local hospitals."I guess we were all just kind of feeling like restless and we needed to do something during this like difficult time," Zhang says on why he and his friends decided to start making PPE from scratch.The boys have turned their summertime hobby into a new non-profit, Shield Our Health Heroes. Their website has a place for donations, and all of the money goes towards materials for more face shields.So far, they've raised enough money to donate 750 face shields to 10 local hospitals."We've been told multiple times that our shields fit better and are better quality than a lot of the shields that they're getting," says Genovese."I really think we are making an impact in our community," adds WU. "Our products are actually really helping these health care workers who need these."The four friends each brought their unique talents to the group effort. Andrew came up with the idea and has spearheaded the project. Rishi built the website and set up the donation PayPal account. Jerry does all of the social media and advertising. Nick contacts the hotels and sets up the deliveries."We try to make it hassle free for them," says Peddakama."We just really want to give back during this time," says Zhang. "And this helps make sure they're staying safe as well." 1529

SAN DIEGO (KGTV) - A BB gun shooting spree has neighbors frightened Sunday after more than a dozen incidents across San Diego.At the corner of L Street and Sixth Avenue a woman was shot in the arm overnight, according to San Diego Police. She was walking in a small group and one of the men was an exhibitor at Comic Con, staying at the Omni Hotel, where they were headed before the shooting. That man, Sal Abbinanti, said "The girl I was with said a guy in a white car in the back seat, she heard a trigger sound and then she's like oh I think I just got shot which kinda got out attention and then we saw it was bruised and bleeding and it looked like a BB." "There's just so much security down here, so many San Diego police down here. I was surprised that this guy was dumb and brazen to do something like that," he said the hotel provided excellent care to his friend.Over in National City and Paradise Hills, at least a dozen cars were hit.Coronado Police say at least 11 businesses were hit.Downtown, police reported four more instances of people being shot at or hit by BB guns.The rash of crimes comes after 10News reported more than a dozen businesses and car windows busted by BBs in the past month:June 24th – Numerous vehicle windows were vandalized in the Point Loma, Ocean Beach and Mission Hills neighborhoods.July 1st and July 2nd - Three businesses in the Hillcrest neighborhood were vandalized.July 2nd - Two businesses in the Park West neighborhood were vandalized.July 2nd and July 3rd – Numerous vehicle windows were vandalized in the Clairemont neighborhood.July 6th - Three businesses and one vehicle were vandalized in the Midway area. A dark colored SUV is suspected in these cases.July 7th - Five businesses in the College area were vandalized.July 8th - One home in the Lake Murray neighborhood was vandalized.According to California law, negligent discharge of a BB gun resulting in injury could mean up to a year in jail.Police from the corresponding agencies are working on these cases. SAN DIEGO (KGTV) - 10News is learning more about how suspected Poway shooter John Earnest got the weapon. On Thursday, investigators revealed that they believe he got his rifle from a licensed dealer.In federal documents released on Thursday, prosecutors report, “The firearm was manufactured by Smith & Wesson in Princeton, Illinois and shipped to Springfield, Massachusetts where it was assembled. The firearm was ultimately transferred, via Fort Worth, Texas, to a Federal Firearm Licensed (FFL) Dealer in San Diego, California, which sold the firearm to Earnest. Earnest picked up the rifle on April 26, 2019.”That was the day before the shooting.In a press conference on Thursday, Southern District of California U.S. Attorney Shane Harrigan told reporters, “I can say that there is no allegation that the defendant violated federal law when he acquired the rifle that he used in the violent attack on the synagogue.”Questions still remain as to whether state law was violated. Earnest is only 19 years-old.California law requires that adults be over 21 years-old before they can buy a firearm, unless they have a hunting license, are current or former military, or are in law enforcement.Prosecutors wouldn't comment on whether Earnest had a hunting license. “That allegation isn't in the complaint but please understand that as the criminal process moves forward, more information may be available to the public,” added Harrigan.District Attorney Summer Stephan originally said that the rifle had been obtained legally, but when pressed on Wednesday by 10News, she didn't provide a clear answer. “I don't want to [comment any further] because it's a pending case,” she said.At Thursday’s press conference, a reporter asked the federal prosecution about when Earnest purchased his 60 rounds of ammunition. Harrigan replied, “We’re limited to the allegations in the complaint. I hope you understand. I think more information may be forthcoming.” 1962
