An Arkansas sheriff's office has arrested a woman who helped her boyfriend escape from the county jail last month by posing as a deputy from California.Maxine Feldstein, 30, was arrested Aug. 17 in connection with forgery, accomplice to third-degree escape and criminal impersonation.Feldstein's boyfriend, Nicholas Lowe, was at the Washington County Detention Center on July 27 with a hold for criminal impersonation out of Ventura, Calif., according to a probable cause affidavit.Feldstein, who had bonded out earlier that day, called Washington County jail staff and identified herself as deputy "L. Kershaw" with the Ventura County Sheriff's Office. She also provided a forged VCSO document releasing the agency's hold on Lowe.Jail staff learned of the forgery and accidental release two days later, when a VCSO deputy called to say he was on his way to pick up Lowe.The sheriff's office discovered through jail video that Lowe told Feldstein to pose as a VCSO deputy while she visited him, according to the affidavit.Lowe said Feldstein should tell Washington County that VCSO was "having issues with overcrowding and all low-priority extraditions have been suspended," according to the affidavit.Washington County later confirmed the VCSO document Feldstein used was fake, and that VCSO didn't have a deputy named "L. Kershaw," according to the affidavit.Lowe was also arrested Friday and faces a felony charge of second-degree escape.A spokeswoman for the sheriff's office said the agency is "still evaluating to determine the best corrective action needed to ensure this doesn't happen again.""There is a procedure to ensure requests are legitimate, and that hasn't changed," she said.Feldstein and Lowe were being held Tuesday (Aug. 21) at the Washington County Detention Center on bonds of ,500 and ,000, respectively.The pair has hearings set for Sept. 5 in Washington County Circuit Court. 1920

America's Paralyzed Veterans are urging disabled voters to make a plan for Election Day, and to read up on their rights before heading to the polls.Al Kovach has been there. As in, he tried to vote, and couldn't.“About 20 years ago, I went to cast a vote assuming the place would be wheelchair accessible and I was wrong and I was unable to vote, I was basically denied my right to vote,” Kovach said.Fast forward to today, and he says, we're still talking about polling and voting challenges for the disabled. Ever since that experience, he's opted for mail-in ballots. This year, he's urging everyone to plan ahead.“Unfortunately, there’s no ADA police going around and enforcing the law so when it comes to polling stations, if you go to a polling station and you can’t get in, your only recourse is to go to Department of Justice and file a complaint, but that doesn’t help you in that moment to cast your vote," said Kovach.As if it weren't complicated enough, he's reminding everyone to be mindful of the coronavirus. The disabled are medically fragile, he says, and more susceptible to serious implications from the coronavirus.“We are seeing a lot of people calling us with trouble with voting,” Kovach said. “I know in San Diego, we had someone who tried to vote last week and was unable to get inside the polling station and another gentleman in Chicago sat in line in his wheelchair for hours around people not socially distancing or wearing a mask.”The U.S. Government Accountability office sampled 178 polling places in 2016 and found that 60% had accessibility impediments, including steep ramps, lack of signage, and poor parking or paths. Federal law requires that polling places be accessible to all voters.“Election officials need to comply with not only the Help America Vote Act... but also the Americans with Disabilities Act, so it is important to make sure that all Americans are able to vote independently and privately,” said Ben Hovland, chairman of the U.S. Election Assistance Commission, which focuses on election administration and how elections are run around the country.Hovland says elections officials everywhere are scrambling. Most everyone is adapting to COVID-19 restrictions, which has forced significant changes at the local level. He too is asking people to plan.“Record numbers of Americans will be voting by mail this year and vote by mail has some challenges for Americans with disabilities,” Hovland said. “We’ve seen states implement portals that work with assistive technology and we’ve seen ballots that utilize hole punches near the signature lines of the absentee ballot envelope.”“A polling station might focus on wheelchair accessibility but forget the fact that there are people who can’t see or can’t hear and I want to make sure that people with disabilities know you can bring a friend with them to help them cast their vote. That is their right,” Kovach said.Kovach adds there's a checklist on the Paralyzed Veterans of America Website. He recommends people check out what's on that list, and understand what works or won't work for you. He said, “I wish I had done that 20 years ago."Hovland said make sure you seek trusted sites from your state and local election officials, as we're getting close to deadlines for many areas. 3293

  

As a massive caravan of migrants treks north, US officials have been negotiating with Mexico about how to handle the caravan should it reach the US border.Officials are weighing the legality of certain steps the Trump administration could take and looking at whether any processes could be changed to speed up the removal of migrants who have no legal basis to remain in the US, according to a senior Department of Homeland Security official.The official says the administration hasn't made any "firm decisions" about how to respond if the caravan reaches the border.Among the topics being discussed with Mexico is whether migrants from the caravan could be held there before entering an official port of entry, the DHS official said. The official said this is already being done to some extent, and described this as a more official process of what is known as "metering," when Customs and Border Protection officers keep immigrants in Mexico to limit the flow into the US. This process has been sharply criticized by advocates, who accuse officials of illegally trying to block immigrants from claiming asylum.A spokesperson for Customs and Border Protection referred all questions on the caravan to DHS.Additionally, the US is negotiating with Mexico about whether migrants from the caravan could be deported there, regardless of their country of origin. This process, known as "return to territory," which was included in President Donald Trump's January 2017 executive order on border security, isn't currently carried out by Immigration and Customs Enforcement, because Mexico would need to agree to take foreign nationals back."A lot of these (options) depend on cooperation and discussions with Mexico," the official said.There were 401 claims for asylum from the caravan that made its way to the US last spring, with 374 of those receiving "credible fear referrals," which is the initial screening to ensure a claim could have merit, according to Citizenship and Immigration Services data.ICE has been talking with contractors to discuss the possible need for additional detention capacity, according to the DHS official. ICE is also preparing for the possibility that it might need more officers at the border, the official said, stressing that while officials are preparing for various possibilities, they have not taken action.DHS has not responded to a request for comment on these policy considerations, but on Tuesday, DHS spokesperson Tyler Houlton tweeted that "stopping the caravan is not just about national security or preventing crime, it is also about national sovereignty and the rule of law. Those who seek to come to America must do so the right and legal way."On Tuesday, another senior administration official said the "administration wants the ability to return whole entire Central American families and also minors after apprehension."This official called the asylum system the "world's largest immigration loophole.""You simply come up to the border, you make a totally fraudulent assertion and it puts you into a legal system that takes more time to play out than we can detain you for, and so it becomes a ticket to catch and release," said the official on Tuesday. 3211
