SAN DIEGO (CNS) - Murder and other felony charges were filed Wednesday against a 20-year-old probationer who allegedly fired a gunshot toward his brother, missing him but inadvertently killing a next-door neighbor asleep in his bed.Manuula Save is accused in the Saturday morning death of Michael Walker, 38, who was shot about 1:45 a.m. by a bullet that traveled through a bedroom wall in the defendant's apartment and into the victim's unit in the 13400 block of Midland Road. Walker was hit once in the abdomen and died at a hospital about an hour later.Save faces life imprisonment if convicted of murder, shooting into an inhabited dwelling, assault with a semi-automatic firearm and being a felon in possession of a firearm.RELATED: Man killed by stray bullet in Poway apartment complex, suspect arrestedDeputy District Attorney Kristie Nikoletich said the shooting stemmed from a verbal argument and physical fight between Save and his older brother. "The defendant retrieved a firearm and fired in the direction of his brother to scare him and show his brother that he wasn't scared of him," Nikoletich said. But that bullet ended up going through a wall and striking a sleeping neighbor, Michael Walker. His grieving widow, Christina was inside the courtroom Wednesday, crying throughout the proceedings. 10News spoke to her earlier this week. "I'm just seeing this hole in his stomach, and then I look over, and there's a hole in my wall," Christina Walker said on the phone. She said he was sleeping in the guest room that night, so his snoring would not wake her up — A move that would place him right in the path of that stray bullet, and kill him hours later. Save then allegedly hid the 9mm firearm, which he was not allowed to possess due to a previous hit-and-run conviction involving the death of an elderly woman, Nikoletich said. Save was sentenced to probation in that case, she said.Nikoletich said Save was charged with murder due to "the defendant's conscious disregard for human life."Save, who's being held in lieu of million bail, is due back in court Aug. 29 for a readiness conference. 2145

SAN DIEGO (CNS) - A man who wounded an off-duty sheriff's deputy and a bystander by opening fire in the Gaslamp District two years ago was convicted of assault with a firearm Thursday in his third trial in the case. Ray Pitoau, 39, was convicted of two counts of assault with a firearm for the Aug. 7, 2017 shooting that injured Deputy Jason Philpot, who was walking through downtown with his two brothers following a Metallica concert at Petco Park. Also injured was bystander Vladimir Shvets, a passerby in San Diego for a convention. Pitoau was also convicted of a lesser charge of assault on Philpot's younger sibling, Joshua, who Pitoau initially got into an argument with on Island Avenue near Sixth Avenue just after 1 a.m. RELATED: Gaslamp deputy shooting suspect escapes Spring Valley SWAT standoffSentencing is scheduled for Dec. 11. Pitoau was convicted in a prior trial of three felony firearm possession counts and was sentenced to 27-years-to-life for those convictions. However, both of his previous trials in the case resulted in hung juries regarding the assault charges. Jason Philpot testified that he tried to wrap his arms around Pitoau and get the gun away, but the defendant was able to pull the trigger, wounding the deputy in the chest and right arm. A second round also passed through his right arm. One of the rounds ricocheted off the sidewalk and struck Shvets. Pitoau testified that he grabbed a gun in self-defense because a group of men, including Philpot, were advancing on him. He testified that he and Jason Philpot both grabbed onto the gun, leading it to fire as they grappled over the weapon. SAN DIEGO (CNS) - A young man who groped and sexually assaulted four female students as they walked to their off-campus housing near San Diego State University last summer was sentenced today to a two-year prison term.Judge Polly Shamoon also ordered Minda Shewangizaw, 20, to stay away from the four victims and San Diego State for 10 years.Shewangizaw pleaded guilty in April to felony and misdemeanor charges of false imprisonment and sexual battery. The defendant still faces charges that he tried to rape a woman in May 2017 at UC Riverside, where he was a student.Deputy District Attorney Judy Taschner said the victims in the SDSU case ranged from 17 to 19 years old. "He (Shewangizaw) attacked two separate groups of girls that were walking in pairs," the prosecutor said outside court."And even though they were walking with a friend, it didn't deter him from literally walking up to them and sexually assaulting them and grabbing them against their will."T.H. testified during a preliminary hearing in January that she and her roommate, T.L., were walking near Montezuma Road and 55th Street, back to their apartment just after midnight last Aug. 29 when the defendant came up from behind and forcefully "grabbed my butt."T.L. testified that she noticed someone walking behind them before he began chasing them. "I said, You need to leave," T.L. testified. "He grabbed my hand and pulled me toward him. He pulled my shirt down and grabbed my breast."T.L. said she kicked the defendant and was able to break free. She and her roommate notified a security guard, who called campus police.The witness said Shewangizaw was wearing an "extremely distinctive" blue Hawaiian shirt and she and her roommate were able to identify him a short time later, after his arrest following another attack.Jane Doe 2 testified that she and Jane Doe 1 were on a pedestrian bridge near the Aztec Student Union, headed back to their dorm about 1 a.m., when she heard footsteps and was smacked on her "behind" by the defendant."I was livid. I said, What are you doing? Don't do that! He laughed it off." The witness said she kept walking and tried to ignore the defendant, but he followed and made a remark about her breasts before pulling her shirt down and putting his hands on her chest.Jane Doe 2 said Shewangizaw went to Jane Doe 1 and said, "How about you? What do you have?" Jane Doe 1 testified that Shewangizaw asked them if they were freshman and told them he was a junior at SDSU. The witness said she froze when the defendant grabbed her friend's breasts."I got really freaked out." She said Shewangizaw grabbed her breasts and buttocks and trapped her against a rail before laughing and walking away. Shewangizaw was arrested and bailed out of custody, but was re- arrested in connection with the alleged attempted rape at UC Riverside. 2844

  

SAN DIEGO (CNS) - A woman was shot when a verbal argument turned physical in the Valencia Park neighborhood of San Diego, authorities said.It happened just after 9 p.m. Saturday in the 5000 block of Palin Street, according to San Diego police Officer Robert Heims.``During the argument it turned physical with pushing,'' Heims said. ``There were gunshots and a 35-year-old female was shot in the foot.''The woman was driven to a hospital with a wound not believed to be life-threatening, he said.There was no suspect description, Heims said. 549
