CHICAGO, Ill. – Shortages of ventilators and personal protective equipment mean many healthcare providers are going into battle unarmed. It’s sparked a heated debate behind closed doors about balancing efforts to save patients versus exposing doctors and nurses to the virus. Who lives? Who dies? Who gets priority to a ventilator? All complex questions health providers are being confronted with. “We've never had this situation before. This is unprecedented,” said Craig Klugman a professor of bioethics at DePaul University in Chicago. Bioethicists say widespread infection, protective equipment and ventilator shortages are creating unique ethical dilemmas for healthcare workers. “We will start to care for the person who is at risk of dying first,” explained Dr. Ricardo Gonzalez-Fisher, a surgical oncologist who teaches healthcare ethics at Metropolitan State University of Denver. “But if we have more people than resources that we have to. Try to save those that are savable.” “The obligation for a healthcare provider to treat the patient doesn't necessarily have a limit,” said Klugman. In Spain, some 13,000 medical workers have been infected. In Italy, more than 60 workers have died since the outbreak began. “It's not just their life. They can assume this risk for themselves,” said Klugman. “If they don’t have the right equipment, they also have the risk of infecting other patients, other healthcare providers. Their family.” Some health systems around the country are reportedly discussing unilateral do-not-resuscitate policies. It’s something that was debated during the Ebola outbreak in 2015. Determining who gets treatment and who does not is something Klugman says is taken very seriously. “We think about it very carefully and with great deliberation.” In Italy, that meant denying some care to the elderly in favor of the young. Klugman says in Illinois, a pandemic flu plan created a decade ago includes care procedures built around ethical frameworks and algorithms that help decide who should for example, get a ventilator. “We have to consider things like what is our most important value. So, the value that we're considering is maximizing the number of years of life that we can save,” said Klugman. Ultimately, a balance must be struck. “You have to make sure that the benefit of the patient overrides the harm or the risk that you're getting in,” said Dr. Gonzalez-Fisher. Otherwise, bioethicists say there may not be enough first responders to treat the infected.“When you call 9-1-1 because your loved one can't breathe, there will be nobody coming. A Florida judge has denied a request for a temporary injunction to block the Palm Beach County mask mandate.Attorneys for a group of Palm Beach County residents filed a lawsuit claiming that the county's emergency order requiring masks in public places to help prevent the spread of the coronavirus was unconstitutional.Judge John Kastrenakes issued his ruling Monday morning."The right to be 'free from governmental intrusion' does not automatically or completely shield an individual's conduct from regulation," Kastrenakes wrote in his 13-page order. "More to the point, constitutional rights and the ideals of limited government do not absolve a cititzen from the real-world consequences of their individual choices, or otherwise allow them to wholly shirk their social obligation to their fellow Americans or to society as a whole. This is particularly true when one's individual choices can result in drastic, costly and sometimes deadly consequences to others."Kastrenakes went on to say that there is no "constitutional or protected right to infect others."Commissioners voted unanimously last month to approve the mask mandate, despite objections from an impassioned group of residents who spoke against such an ordinance.County Administrator Verdenia Baker last week extended the order for an additional 30 days. It now remains in effect until at least Aug. 23.Mayor Dave Kerner said Friday that the county is in the process of mailing about 3 million masks to residents."As this community tries desperately to navigate the tumultuous seas presented by COVID-19, it is reasonable and logical that our elected officials are throwing the citizens of Palm Beach County a lifeline in an attempt to ameliorate the spread of this deadly, unbridled and widespread disease," Kastrenakes concluded. "Based on the evidence, this court will not second guess the manner in which a co-equal branch of government sought to discharge its sacred duty to protect the general public."A statement from the Florida Civil Rights Coalition, which filed the lawsuit on behalf of the plaintiffs, said Kastrenakes "unsurprisingly" denied the motion, "paving the way for continued government tyranny under the guise of disease prevention in Palm Beach County."Attorneys for the plaintiffs argued during a hearing last week that the mask mandate infringes upon their clients' constitutional rights.In their statement, attorneys claim the ruling "disregards fundamental rights like freedom of speech and the right to medical self-determination protected by the Florida Constitution."The Florida Civil Rights Coalition plans to appeal the ruling. A group surrounded and attacked an NYPD officer in Lower Manhattan, police said Thursday. Pictures released from the May 28 attack at Albany Street and West Avenue show two men accused in the attack. One man pushed the 37-year-old officer to the ground and punched him in the face. The second man repeatedly struck the officer with his skateboard. Police said the officer was treated for a bloody nose along with bruising and pain to the head and shoulder.
