Two brothers who threatened to stop cooperating with prosecutors in the case against actor Jussie Smollett have changed their mind. In a statement issued Thursday, an attorney representing Abimbola and Olabinjo Osundairo, said that two who have admitted to helping Smollett stage a racist and homophobic attack against the Black are ready to testify because a gun that went missing after police found it in their home had been found. Smollet is charged with lying to police about the “attack” that authorities say the actor staged to gain publicity for his career. The actor has maintained his innocence.Smollett's charges were filed by special prosecutor Dan Webb, who was appointed to the case after Smollett originally had his charges dropped by the Cook County State’s Attorney Office .The prosecutor's announcement of dropping the charges last year drew ire from Chicago Police and outgoing Mayor Rahm Emanuel.Smollett allegedly filled a false police report, when he told officers that two attackers shouted racial and homophobic slurs at him.The Osundairos were originally arrested for the alleged attack, but were later cleared of charges after police claimed that Smollett paid the men to stage the attack. 1222

(KGTV) - Hundreds of active duty service members and family members attended a memorial this Wednesday for a medic who mysteriously died this summer on a Southern California military base.Team 10 investigative reporter Jennifer Kastner first broke the story a few weeks ago when 10News reported that he may have been killed by someone else. It’s been three months since HM3 Michael Vincent de Leon died but investigators still won’t release details on his death. He was a Navy corpsman, which is a medic, stationed at the Twentynine Palms Marine base in San Bernardino County.At the memorial service, rubber duckies were handed out to attendees. Ducks were Michael’s favorite type animal. "Michael was special. He thought that life was water and whatever life would throw at him, he was going to act like the duck and the water would fall right off," says Corpsman Michael Joseph Navarro. “If you needed something, he was there in a heartbeat,” explains former Corpsman Benjamin Clark. He and wife Lisa were some of Michael’s closest friends, yet they're nowhere near understanding his sudden death in August.Clark adds, “To this day, we [still] don't know a whole lot.” “I've been to memorials and I've always seen [them] through the viewfinder. Today, I was front row,” says Jose de Leon, Michael’s father. Jose is a former news photojournalist. He and the rest of the immediate family flew in from Texas for the memorial. 10News spoke with Jose via video chat last month. He had contacted 10News for help after claiming that the military stonewalled him from getting answers about his son's death. 10News learned from a source with close military ties that the Naval Criminal Investigative Service (NCIS) confirmed that Michael's death was being investigated as a homicide. It's a very different story than what the family says they were led to believe in the hours just after the death, when they say the word "suicide" came up from service members on base. After digging for information, Jose says he spoke to a service member who is close to the case. “I begged him, ‘Just tell me, did Michael pull the trigger or did someone else? There was a long pause and [then he said], ‘Mr. de Leon, someone else pulled the trigger,’” he explains.He says other service members who knew Michael said he was shot on base at another corpsman's going-away party in the military housing area. Days went by until, he says, an NCIS agent told him there was, in fact, a shooting on the base at a housing unit and other corpsmen were present.“We're not a vengeful family. [We’re] not vengeful at all, but we do want justice,” Jose tells 10News.This week, NCIS Public Affairs sent 10News the following statement.“Out of respect for the investigative process and to protect witnesses, NCIS does not comment on or confirm details relating to ongoing investigations.” 2882

  

VENTURA, Calif. (KGTV) - A suspect who led California Highway Patrol officers on a pursuit onto the 101 Freeway died of an apparent poisoning.The chase began Wednesday in Oxnard during a vehicle check, according to ABC-affiliate KABC. CHP officials said information came back on the car belonging to a rape suspect. When officers tried to pull the vehicle over, the driver refused, KABC reported.The chase continued northbound onto the 101 Freeway and ended in Ventura. The vehicle came to a stop in the center median, though CHP officers told KABC it's unclear if the suspect crashed of stopped the vehicle on his own.The suspect was seen motionless outside his vehicle, with the passenger-side glass shattered, according to KABC. Officers told the station they believed the suspect possibly poisoned himself.No officers were reportedly injured.Both sides of the 101 Freeway were initially shut down between Sanjon Road to Seaward Avenue, but some lanes have since reopened, KABC reported. 1028

  

UPDATE, 4:20 p.m.: Officers tweeted Sampson was found safe. SAN DIEGO (KGTV) - San Diego Police asked for the public’s help Monday to find a legally blind man who disappeared from his South Bay apartment. Brian Sampson walked away from his apartment sometime around midnight, police said. He was having trouble sleeping and may have gone for a walk, according to officers. Family members said Sampson is blind and epileptic. He suffered a seizure earlier in the day and was acting confused, police said. Sampson recently moved to the area. Police did not provide details about his location in South Bay.Anyone with information is asked to call San Diego Police at 619-531-2000 or SDPD Missing Persons at 619-531-2277. 725
