(KGTV) – National City Police found Tuesday a student-to-student threat at a South Bay elementary school was not credible.The alleged threat by a John A Otis Elementary student to another student was investigated, though not further details could be offered due to student privacy laws, according to National School Distict Superintendent Leighangela Brady."Students informed us of the alleged threat, and based on the information provided we took immediate action to investigate," Brady said. "This information came to our attention becase a student spoke up. I am grateful for the students' proactive efforts and self-confidence to speak up."No further details regarding the incident were immediately released. 720

(KGTV) -- Testimony will continue Tuesday in the preliminary exam for the suspected smuggler charged with murder after leading the border patrol on a wild, high speed chase that ended with the deaths of three of his passengers. It happened on westbound Interstate 8 near Boulevard on the evening of November 29th, 2018. Luis Virgen, 21, is a U.S. citizen who had been living in Tijuana at the time of the crash. He's charged with second degree murder and gross vehicular manslaughter. Virgen is accused of smashing through a gate that leads into the U.S. from Mexico with 10 undocumented immigrants in his truck, including 9 in the bed of the truck under a tarp. Everyone but the driver was thrown from the truck when it crashed after hitting a spike strip deployed by the border patrol. Gregg Curtis testified that after the truck blew past him, he started shooting video with his cellphone in case something happened. Curtis can be heard talking under the cellphone video, which was played in court Monday. "I wouldn't be surprised if he totally crashes his brains out," said Curtis. He also testified about how fast the defendant was going."I was alarmed at a vehicle passing me at such a large rate of speed that it shook my truck," said Rieu. The border patrol received some criticism following the incident, some questioning why they didn't call off the chase given the wet roads and dangerous conditions at the time. Several agents testified that they had no idea that the truck's bed was hiding several undocumented immigrants. Another agent described how he tried to revive the victims. "Another individual, I cradled his head, he was moaning and groaning, and I told him he was going to be fine that it was just a scratch and to stay awake," said Agent Jahir Waterman. If convicted on all counts, Virgen could spend 45 years to life in prison. 1970

(KGTV) A same-sex couple says a staffer from a private school in Solana Beach told them to not submit their son’s application.Matthew Bosse and Joe Mosca are looking at middle schools for their 10-year-old son.They say Garrett earns exceptional grades and is as much a musician as he is a lacrosse player so several friends referred them to Santa Fe Christian Schools in Solana Beach.Bosse says during a phone call he told the SFCS staff member that he was married to a man.“That’s when she essentially said the values that are taught at the home are the values that are taught at school and we don’t think your family would be a good match,” said Bosse.The family regularly attends an Episcopalian church and says they’re a same-sex couple with Christian values.“You never expect to encounter such over discrimination,” said Mosca, who is also the Deputy Mayor of Encinitas.Since Santa Fe Christian Schools is private and receives no public funding, it does not have to follow state or federal anti-discrimination laws.In a statement to 10News SFCS wrote:"While we do not provide details on matters involving students or prospective students, I can say that our policy is to encourage the family of any student committed to academic excellence and spiritual development to apply. As a matter of practice, we do not attempt to persuade or dissuade prospective families from applying. At the same time, as part of the admissions process, we make clear to prospective applicants that they will be joining a Bible-based community designed to disciple students to embrace biblical truth. (KGTV) — More than 20,000 acres have been scorched in Riverside and San Bernardino Counties by the Apple Fire since Friday, prompting evacuation orders for thousands of residents.The fire had burned 26,450 acres and was 5% contained as of Monday at 7:48 a.m., according to Cal Fire.Officials say the blaze began as two separate fires on Friday in Cherry Valley, an unincorporated area near Beaumont in Riverside County, before exploding over the weekend and crossing into San Bernardino County.RELATED: Several San Diego County fire departments help fight growing Apple FireThe U.S. Forest Service says the majority of the area covering the northern and eastern edges of the fire is very steep and rugged, making it difficult for crews to access the area with vehicles. The agency added that a high pressure ridge on Sunday created hot and dry conditions, fueling the flames.Helicopters and fixed-wing air tankers were assisting ground crews and equipment in battling the fire.At least one home and two outbuildings have been destroyed by the fire and several more were threatened. No injuries have been reported.Evacuation updates for Riverside County were posted here, while evacuation updates for San Bernardino County could be found here.A plume of smoke could be seen for miles and led to air quality warnings.
