SAN FRANCISCO (AP) -- A federal judge blocked on Friday President Donald Trump from building sections of his long-sought border wall with money secured under his declaration of a national emergency. U.S. District Judge Haywood Gilliam Jr. on Friday immediately halted the administration's efforts to redirect military-designated funds for wall construction. His ruling was the first of several lawsuits against Trump's controversial decision to bypass the normal appropriations process to pay for his long-sought wall."The position that when Congress declines the Executive's request to appropriate funds, the Executive nonetheless may simply find a way to spend those funds `without Congress' does not square with fundamental separation of powers principles dating back to the earliest days of our Republic," the judge wrote in granting a temporary injunction to stop construction.At stake is billions of dollars that would allow Trump to make progress in a signature campaign promise heading into his campaign for a second term.Trump declared a national emergency in February after losing a fight with the Democratic-led House over fully paying for the wall that led to a 35-day government shutdown. As a compromise on border and immigration enforcement, Congress set aside .375 billion to extend or replace existing barriers in Texas' Rio Grande Valley, the busiest corridor for illegal crossings.Trump grudgingly accepted the money, but he declared the emergency to siphon money from other government accounts because he wanted to spend billion on wall construction. The funds include .6 billion from military construction funds, .5 billion from Defense Department counterdrug activities and 0 million from the Treasury Department's asset forfeiture fund.The president's adversaries say the emergency declaration was an illegal attempt to ignore Congress, which authorized far less wall spending than Trump wanted."We welcome the court's decision to block Trump's attempts to sidestep Congress to build deadly walls that would hurt communities living at the border, endanger wildlife, and have damaging impacts on the environment," said Andrea Guerrero, a member of the Southern Border Communities Coalition.The administration said Trump was protecting national security as unprecedented numbers of Central American asylum-seeking families arrive at the U.S. border.The courtroom showdowns come amid a flurry of activity to accelerate wall construction.Kenneth Rapuano, an assistant secretary of defense, said in a court filing last month that work on the highest-priority, Pentagon-funded projects could begin as soon as Saturday. SAN DIEGO, California — One person died and two others were injured, and Coast Guard crews rescued 17 others after a mega yacht collided with a fishing vessel off the coast of Imperial Beach on Friday night. The 332-foot yacht, Attessa IV, crashed into the 65-foot sportfisher vessel, Prowler, just before 8 p.m. about nine miles off the shore of Imperial Beach, according to the Coast Guard.The collision caused extensive damage to the right side of the Prowler.One man was airlifted to UCSD Hillcrest and died at the hospital, the Coast Guard confirmed. Two others were injured in the accident.Coast Guard crews transferred 17 passengers from the damaged fishing boat back to San Diego. SAN FRANCISCO (AP) — California voters approved a measure Tuesday requiring all eggs sold in the state come from cage-free hens by 2022.Proposition 12 led with 59 percent of the vote with nearly 4 million ballots counted.Supporters say the measure is a step toward more humane farming practices, while opponents say it doesn't go far enough.The measure sets new minimum requirements on the sizes of pens that farmers use to house breeding pigs and calves raised for veal, and it bans sales in California of products from hens, calves and pigs raised in other states that do not meet California's standards.Dubbed the Prevention of Cruelty to Farm Animals Act, Proposition 12 builds on an earlier ballot measure, Proposition 2, that passed in 2008 and banned keeping hens, calves and pigs in tiny cages so cramped they couldn't stand up, lie down or turn around.That measure took effect in 2015 but lacked specific size requirements and did not apply to out-of-state farmers whose products were sold in California.Proposition 12 specifies how much floor space farmers need to give each animal.The measure was sponsored and financed by the Humane Society of the United States, which also backed Proposition 2 and says the upgrade will strengthen the earlier measure and restore California as a leader in the ethical treatment of farm animals.A decade ago, Proposition 2 was the furthest-reaching law for farm animals in the country. Since then a dozen states have banned or restricted confinement for at least one farm animal. Massachusetts passed a comprehensive measure in 2016 that is similar to Proposition 12.The measure had the support of several animal welfare groups, including the American Society for the Prevention of Cruelty to Animals, Sierra Club and Center for Food Safety, and a variety of veterinarians and religious organizations.It requires that, starting in 2020, calves confined for production have at least 43 square feet (4 square meters) of usable floor space, while breeding pigs be given at least 24 square feet (2.2 square meters) of floor space in their pens starting in 2022.RELATED CONTENT 2125

  

SAN DIEGO, Calif. (KGTV) - A third gender option will be available for California drivers licenses and ID’s starting in 2019. The law, SB 179, was signed by Governor Jerry Brown in October. It will allow people to apply for a ‘non-binary’ gender marker if they do not identify as either male or female. “For me, it was surprising to see this change,” said Al Johnson, a transgender activist and member of Trans Family Support Services. Johnson is non-binary and uses pronouns they/them. But with that surprise, came excitement. “Not only does it mean we’re being recognized by society and the people around us but were also being recognized by government entities as valid and real people,” they said. Johnson says they know people who plan on changing their gender to non-binary, but so far, they have not decided to do it on their own license. “I’ve definitely considered it, but in the end I don’t think I’m going to,” they said. “I just came out to my parents and in my personal life I’m trying to navigate that.” The DMV’s website is encouraging those who want to apply for the change to schedule an appointment as early as January 2, 2019. 1154

  

SAN DIEGO (KGTV)- Residents in a South San Diego Apartment complex worked together to fight a fire that started in the patio.At around 10:45 Sunday morning, San Diego City Fire Rescue teams responded to the 1700 block of Oro Vista Road. Heavy smoke was billowing from the patio of a downstairs apartment. "I called 911 automatically, and that's when the person who lives upstairs came running out,” Alexa Delgado said.Delgado had just arrived at the Oro Vista Villas to visit her mother when she saw the flames. "It started popping, and the fire started coming out,” she said. It was in that moment of chaos that she found herself and several neighbors step up to help. One neighbor pulled the smoke alarm, others smashed fire extinguisher boxes and started spraying down the patio, and she protected the neighbor's pet birds, all before the fire department arrived. Engine 30’s Fire Captain, John Wilson said what the residents did in the first minutes of the fire helped suppress the flames. "There was an alarm that was going off upon our arrival, so the smoke detectors did their jobs and got everyone out safely,” Captain Wilson said. Delgado says what happened today was a true testament to the word “community.”“A bunch of neighbors helping and asking if anyone living there, went upstairs to see if anyone was in there and helping out."Fire investigators are still looking into what exactly caused the patio fire.  No one was inside the home when the flames ignited. No one was injured or displaced by the fire.  1568
