New York Gov. Andrew Cuomo responded Thursday to the Supreme Court's Wednesday night ruling against the state's coronavirus restrictions on houses of worship in areas of New York City. The governor said the decision hasn't changed anything and called the court's action "irrelevant from any practical impact."However, leaders of the two groups who are plaintiffs in the case — the Roman Catholic Diocese of Brooklyn and Agudath Israel, an advocacy group for the Orthodox Jewish community — disagreed, saying that the case about religious liberty and more sensible health measures.Cuomo, for his part, pointed out that the Catholic church and Orthodox Jewish synagogues in Brooklyn and Queens are no longer subject to them."I think this was really just an opportunity for the court to express its philosophy and politics," Cuomo said. The justices split 5-4 on the decision, with new conservative Justice Amy Coney Barrett representing the decisive vote in the majority. It was Barrett's first publicly discernible vote as a justice. The court's three liberal justices and Chief Justice John Roberts dissented. In an unsigned order, a majority of the court said New York's restrictions "single out houses of worship for especially harsh treatment."Bishop Nicholas DiMarzio of the Brooklyn Diocese said that the ruling is relevant far beyond the boundaries of the New York City region."There are places where, for example, I'm on the board of the National Shrine of the Immaculate Conception in Washington D.C.," DiMarzio said. "That church seats 5,000 people. They are only allowed to have 100 people, by the laws of the District of Columbia.""The district refused to hear their plea," he said. "We have the same problem."Rabbi Chaim Dovid Zweibel is the executive vice president of Agudath Israel."It made no sense to treat a small synagogue that seats 25 people on a regular basis the same as a synagogue that seats 500 people," he said. For Cuomo, it came down to public safety."I fully respect religion, and if there's a time in life we need it, the time is now," Cuomo said. "But we want to make sure we keep people safe at the same time."Cuomo said the Supreme Court is "different" now, referencing Coney Barrett tipping the court more towards conservatives.Earlier in this year, when Barrett's liberal predecessor, Justice Ruth Bader Ginsburg, was on the court, the justices divided 5-4 to leave in place similar pandemic-related capacity restrictions affecting churches in California and Nevada. Two lower courts had sided with New York in allowing the restrictions on houses of worship to stand. The governor asserted that the Supreme Court decision isn't final, saying that it would go back to the Second Circuit Court of Appeals. When asked by a reporter if he felt the ruling would convince churches and synagogues they now have the leeway to host gatherings of thousands, Cuomo disagreed."It didn't affect our mass gathering rules...It didn't mention the overall limits," he said.President Donald Trump seemingly celebrated the court's decision on Twitter Thursday morning, writing simply "Happy Thanksgiving!" while sharing a tweet of the news from the @SCOTUSblog account.During Trump's single term in office, he appointed three of the justices sitting on the Supreme Court, including Barrett. Conservatives now have a 6-3 majority. This story was originally published by Jay Dow, James Ford and Mark Sundstrom on WPIX in New York City. The Associated Press contributed to this report. 3498

Nick Ayers, the leading candidate to replace John Kelly as President Donald Trump's chief of staff, announced Sunday he will not be taking the job, reviving discussions about who will succeed the retired Marine general when he leaves at the end of the month.Ayers, who has served as Vice President Mike Pence's chief of staff for more than a year, turned down the position because he could not agree to terms with the President, a White House official told CNN.Trump pushed Ayers to commit to two years, but he declined. He has young children, he told the President, and wants to move back to his home state of Georgia. He offered to become chief of staff temporarily, but Trump was firm on a two-year commitment, and talks fell apart. There was also a significant resistance inside the West Wing to Ayers becoming chief of staff, two sources with knowledge of the situation told CNN. Ayers, who considered the top contender to succeed Kelly for at least six months, will leave his position as Pence's chief of staff at the end of the year to run the super PAC set up to assist the President's re-election campaign."Thank you @realDonaldTrump, @VP, and my great colleagues for the honor to serve our Nation at The White House. I will be departing at the end of the year but will work with the #MAGA team to advance the cause. ????#Georgia," Ayers wrote in a tweet Sunday afternoon.Pence thanked Ayers for his work as his chief of staff in a tweet on Sunday, writing "@nick_ayers has done an outstanding job as my Chief of Staff and I will always be grateful for his friendship, dedication to the @VP team and his efforts to advance the @POTUS agenda. Thank you Nick! Karen and I wish you, Jamie and the kids every blessing in the years ahead."Ayers' decision not to take the job came as a surprise since he had been lobbying for the position, the sources said. There was resistance to him being appointed from first lady Melania Trump and some senior staff, the sources said. The Wall Street Journal first reported that Ayers would not be taking the job as Trump's chief of staff.Trump told reporters Saturday that Kelly, a retired Marine Corps general and Trump's previous secretary of homeland security, will leave at the end of year."I appreciate his service very much," Trump said.Kelly's status had become endangered in recent months as his relationship with the President deteriorated. He was not on speaking terms with Trump in recent days, two officials told CNN, and their relationship was no longer seen as tenable. CNN reported Friday that Kelly was expected to announce his departure in the coming days. Now there is an open question inside the West Wing over who will succeed Kelly. Trump is considering four people, multiple sources told CNN.Trump tweeted Sunday that he would be making a decision soon on who he would ask to fill the position."I am in the process of interviewing some really great people for the position of White House Chief of Staff. Fake News has been saying with certainty it was Nick Ayers, a spectacular person who will always be with our #MAGA agenda. I will be making a decision soon!"One name being floated is Republican Rep. Mark Meadows of North Carolina, the chairman of the conservative House Freedom Caucus. White House senior staff asked outside advisers on Sunday what they think of Meadows for chief of staff, a source familiar with the matter said. Meadows speaks with Trump often.Another person familiar with the matter said Treasury Secretary Steve Mnuchin is a possible choice and would likely accept if asked, but there are some complicating factors -- like Trump's irritation with the chairman of the Federal Reserve, Jerome Powell, and frustration over the economy -- that could count him out. Mnuchin is also not seen as being politically adept as some other candidates who have held elective office, which was Kelly's main fault in Trump's view.A person familiar with the Treasury secretary's thinking tells CNN that Mnuchin feels very strongly that he can best serve Trump in his current role as top finance chief with a portfolio that includes top administration priorities. The source says that Mnuchin has never pursued this job or has ever considered himself for the role. There has been some support for him to be the President's chief of staff among Trump family members, who trust Mnuchin's loyalty as one of Trump's longest and closest trusted advisers, says the source. They think Mnuchin both understands the President and would work in his best interests.Even so, the source says Mnuchin feels he can best serve the President in his current job at Treasury Secretary. This source also brushes off criticisms that Trump is unhappy with Mnuchin over the economy's performance, saying the two men have only had positive conversations over the country's upswing in growth.Another name frequently on a list of potential candidates is White House budget director Mick Mulvaney. A source close to Mulvaney says that while his name keeps coming up for the position, he remains uninterested in it."He is happy where he is," the source said, adding that Mulvaney is not "angling" for the chief of staff job nor has the President asked him to take the position.A source familiar with the discussions tells CNN that Pence has started to have conversations with close aides about who will be his next chief of staff. One name that has arisen in conversation is his long-term adviser Marty Obst, who is still based in Indiana because he works in the private sector, but travels to Washington often and is frequently at the White House, according to the source.Obst traveled with Pence to Indiana on Friday afternoon after being in Washington that day, according to the source. 5734

Nikolas Cruz, the 19-year-old who was arrested in connection to Wednesday's mass school shooting that left 17 dead, walked to a nearby McDonald's and Walmart after the massacre, Broward County Sheriff Scott Israel said. According to Israel, Cruz tried to blend in with students evacuating the school after he allegedly committed the shootings. He then walked to a Walmart and bought a beverage from the Subway restaurant inside the store. Investigators believe that he then walked to a McDonald's and spent 40 minutes inside before leaving. Cruz was then caught by local police walking alongside a road. His arrested came roughly 80 minutes after the beginning on Wednesday's shooting. Here is a timeline of events, according to Israel:  770

NEW YORK (AP) — Martha Stewart's first Uber ride was not a good thing.Stewart ordered the "most expensive version" Monday outside Tiffany's flagship store in New York City. As Stewart explained on Instagram , she wanted to be picked up on Fifth Avenue and 57th Street.Stewart wrote the first car did not show up and the second parked "halfway down" the street where she "could not see the license plate." That car was pointed in the wrong direction, delaying her journey as the car snaked through midtown Manhattan traffic. But the worst part was the car "was a mess inside and out!!!!!!!!" She posted a picture that showed debris on the floor and two water bottles.Uber says it was disappointed to hear about Stewart's first experience and has reached out to her and her team. 794

Nichole Jolly just confirmed what she feared: her childhood home, where three generations made memories, was now reduced to rubble.“This is where I came back when I was born,” she said through tears. “This is where my babies came back when they were born.”Jolly and her husband, Nick, had come to terms thinking the cat that lived with her mom probably didn’t make it. Jolly said her mom was given such little notice to evacuate, so she left with only the clothes on her back. But as if on cue, a head popped up from the rubble.“Oh my god, Nick!” Jolly cried out.  “That’s our cat! Oh my god.”After a few minutes, they coaxed her out of the rubble. Jolly whispered an apology to little Kit Kat, nestled in her arms. The cat was now much thinner than the last time they saw her and her paws were singed.“I can’t believe she made this! She is a strong kitty. We have a strong family,” Jolly said.“I had to walk through fire too,” she said in Kit Kat’s ear.Jolly did, in fact, walk through fire. In fact, she barely escaped. It was last Thursday when the rapidly-moving fire was spreading through the town of Paradise—now 90 percent destroyed--where Jolly works as a nurse. She helped evacuate the surgical unit patients, putting them in any cars they could find, as gently as possible. And for that, she’s been dubbed a hero. However, Jolly thinks that saving her own life soon after was the real miracle.Jolly was in her car trying to escape, when the inferno suddenly surrounded her and many others on the same road.“I don’t even know where I am, it’s on fire,” Jolly said in a video she took from her car. “And we’re stuck in the middle of it. These trees could come down at any moment.”Cars were lined up and going nowhere.“I thought I was gonna be able to get out this way, but I’m stuck here, too,” she can be heard saying through tears in that same video.“We were screaming and running into each other with our cars. They pushed me off the road.”On Tuesday evening, she returned to that very spot for the first time since she almost lost her life.“I was all by myself. I was totally alone, and I called Nick and I said, ‘Honey, there’s flames all around me, and I’m gonna die. There’s no way I can make it out of this.’”Her husband had even begun to think about how he would tell their children their mom wasn’t coming home.“She was hysterical,” her husband Nick said, recalling their phone call. “And I couldn’t do anything to help her.”He suggested she get out and run. So, she did. Her shoes began to melt, and her clothes caught fire.“And I just had my arms out and I’m running, and I touched a firetruck.”She got inside it, but traffic was still at a standstill. Even the firefighters thought their chances for survival were grim.“I was sitting in the fire truck right here and just thinking, ‘OK, this is going to be a really painful death.’”But a bulldozer suddenly appeared, pushing the melting vehicles off the road. They made it out. But she hasn’t stopped reliving it. “I’ll never forget my screaming in the car, when the fire was just coming up on the side of it, and I was yelling for my husband ‘Oh my God, oh my God.’ I’ll never forget that. That’s what I wake up to every night.”But she takes comfort in knowing they, unlike some, still have each other. And they have Kit Kat. Tuesday evening, they brought her to her mom while she was at work to surprise her.“We found your freaking cat, mom,” Nichole shouted.Stunned, her mother could hardly find words.“Oh my god, you guys. I can’t believe this…. I thought she was gone!”Still alive. But now with eight lives left to spare. 3610
