SAN DIEGO, Calif. -- Tech giants say they will not sell facial recognition software to police departments, for now.It's a tool police departments have been using for years, helping solve everything from property crimes to cold cases and missing people. But there's little oversight over the technology, and critics say it puts our privacy and civil rights in jeopardy.While police often use the software to scan the mug shots of criminals, there's a good chance your photo is also in the system. A 2016 Georgetown Law report found one in two American adults are in a law enforcement face recognition network. In addition to mug shots, social media photos and surveillance videos, many states also allow searches of driver's licenses databases.Critics of the technology also point to inaccuracies in the software.In 2018, researchers at MIT and Stanford University examined three commercially released facial-analysis programs from major technology companies.The analysis showed an error rate of 0.8% for light-skinned men compared to 34.7% for dark-skinned women.Steve Beaty is a professor of computer science at MSU Denver. "It appears these programs have, what we call, biases in them. That they're biased towards certain skin tones, for example, and will make more mistakes with certain types of people than other types of people," said Beaty. He says the bias can occur when the machines are trained. "The computers I don't think have any inherent bias in themselves, but they can only learn from the data sets they're provided with," said Beaty.If a machine sees more photos of white males while being trained, it will be able to identify them more accurately. And while the technology has proven to be a useful-crime fighting tool, a case of mistaken identity can mean an innocent person ends up with police looking into their private lives unnecessarily."I think it's a good idea to take a step back and say what is it we as a society want from our facial recognition technology? That's exactly what Amazon has come out and said," said Beaty. This week, Amazon announced a one-year moratorium on police use of their facial recognition technology, Rekognition. The company is calling on lawmakers to put in place stronger regulations to govern the technology's ethical use.Microsoft also said it will not sell its software to police departments for now, while IBM is abandoning its facial recognition program altogether. "Let's talk about what it means, and have the conversation, and make sure that we as a society, as a country, are comfortable with what the technology is being used for," said Beaty. SAN DIEGO — A lawsuit was announced Monday over the death of Roxsana Hernandez, a transgender woman who died in Immigration and Customs Enforcement custody earlier this year as she sought asylum at the border.Hernandez arrived at the U.S.-Mexico border in San Ysidro in May from her native Honduras, but Transgender Law Center Director Lynly Egyes said Hernandez “came to the U.S. seeking protection and instead was met with torture.”"An independent autopsy report reveals that Roxsana was shackled for a long time and very tightly, enough to cause deep bruising on her wrists. She also had deep bruising Injuries consistent with physical abuse with a baton or asp while she was handcuffed, according to an examination of the tissue by an independent expert board-certified forensic pathologist," Egyes said.According to attorneys, Hernandez died from dehydration after being denied water and medical care.Hernandez, who was HIV positive, became very ill as she was transferred from California to Texas, back to California, and then to New Mexico, where she died.Hernandez’s family is hoping the wrongful death lawsuit will provide answers as to what happened. Sunday is also the kick-off of National Fire Prevention Week.Cher Smith's home in Crest has a 360-degree view of nature. It's beautiful to look at, but dangerous during fire season. "Somebody is throwing a cigarette out, sparks from a car, whatever," Smith said. "There's always that fear that something is all of a sudden going to cause a fire to get out of control."In the last month, she and her son-in-law spent hours clearing up the dead brush on her 2.5 acre property. "We just barely made a dent on what needed to be done," Smith said. Smith said she couldn't afford to pay a landscaper to finish the job, but that all changed when she looked out her window earlier this week. "They are all up there like ants on the mountain bringing down the brush," Smith said. She saw CALFIRE and inmate fire crews working earnestly, with shovels in hand, to create a safe, defensible space. The space won't just create a defensible space for Smith's home, but for the entire Crest community. "I said, 'You have no idea how jazzed I am that you guys are doing this for us!'" Smith said enthusiastically. That's because just last month, she watched the Dehesa fire, creeping up toward her home. Also, back in 2003, her son-in-law lost his childhood home to a wildfire."A lot of people in Crest had their homes burned, so I think people are on high alert and sensitive to the dangers," Smith said. San Diego (KGTV)- As Westin Hotel workers fight for better wages, local business owners are fighting to keep business.Hotel workers have been on strike for the past few weeks. Business owners say customers are now avoiding the area and its costing them money.Joey Aiello owns a shoe shine stand that sits outside of The Westin Hotel. He says he’s seen fewer customers this month because of the strike. “People don’t think its a big business but it supports my family,” says Aiello.He says since the workers hit the picket line, he’s lost 00 in business. “The first week they were here I made less than 0 a day. We have to make 0 a day to stay a float.” Other business also say they are concerned about the noise.The San Diego Police Department says they have received six complaints since October 9th. A spokesperson with Marriott International sent us this statement that says in part:“We are disappointed with some of the tactics the union has deployed including the noise levels. We continue to work with local police to address these issues and we are grateful to our guests for their patience during this time.”The Unite Here Union President, Bridgette Browning, says employees are now in negotiations with the hotel. She also sent us a statement that says:“While we are sympathetic to neighboring businesses - we believe the Marriott has the power to fix this strike and the businesses should be demanding that Marriott do the right thing. The workers are not to blame for the low standards that Marriott has created at the Westin San Diego Gaslamp. The workers are prepared to settle as soon as Marriott decides to do the right thing and sign a contract that provides living wages.”For business owner Joey Aiello, he says he won’t be able to make back the money he’s lost. “I just have to work harder and keep everything a float the best I can.” 1869
