Dramatic moments in a San Bernardino courtroom today as a prosecutor slammed a sledgehammer onto a table. He was simulating what he says is how a Fallbrook family of four was murdered in 2010. Charles Merritt is accused of killing his business partner, Joseph McStay, his wife Summer and their two young sons Giani and Joe Jr. The prosecution says Merritt was being sidelined from the business and owed thousands of dollars to McStay. The defense countered in their closing arguments that the prosecution focused on trying Merritt’s character and not the actual facts of the murder. The defense told jurors the circumstantial case produced no evidence tying their client to the family’s violent deaths. The prosecution told jurors they didn’t have to prove how, where or when the murders took place, only that Merritt committed them. The McStays disappeared from their Fallbrook home in early February 2010. Days after they were last seen, the family’s SUV was found abandoned at a strip mall parking lot in San Ysidro.In 2013, the bodies of the family members were found in the Mojave Desert, near Victorville. Prosecutors said the family died from blunt-force trauma to their heads. Authorities found a sledgehammer, believed to be the murder weapon, in one of the graves.Merritt was arrested in connection with the killings in November 2014 after sufficient evidence linking him to the case, including DNA, was discovered.Authorities alleged Merritt killed the family members inside their home and then buried them in the desert. Merritt also tried to paint over the crime scene, according to authorities.Merritt, 61, has pleaded not guilty to charges of murder and is being held without bail.Prosecutors are seeking the death penalty in the case. 1758

(KGTV) — A family jewelry shop in El Cajon is out tens of thousands of dollars after a brazen robbery Friday.A couple entered Ishtar Jewelry Store on Avocado Avenue and began browsing around. It was a seemingly ordinary evening."They were looking for different pieces of jewelry, bracelets, necklaces," said Nadin Toma, the store owner's daughter. "My mom was the one who was helping them out. The female found a piece that she liked."After that, Toma said the woman claimed she needed to get her wallet from the car to purchase the piece of jewelry."Our door to get in is an electric door," explained Toma. "We have to buzz anyone in and out just for security purposes."So, the woman was buzzed out, but Toma said she held the door open.That's when the man by her side made his move, jumping over the display counter, snatching up a handful of gold chains, then running out of the wide-open front door."They just grabbed and ran as fast as they could," Toma said. "They got away."Toma estimates the cost of the gold chains were anywhere from ,000 to ,000.But, the thief also left something behind. His fanny pack hooked onto the front door and broke off his body as he ran away.Toma said inside the fanny pack was the suspect's identification card, which she gave to police.She also said a Good Samaritan wrote down the license plate number of the car the couple used to get away."With any robbery, it's very painful for anyone who goes through it," said Toma. EL CAJON, Calif. (KGTV) - City leaders in El Cajon want to add harsher penalties to punish stores that sell tobacco products to underage customers.Current law says stores cannot sell tobacco or nicotine related products to anyone under the age of 21.Under El Cajon's current Tobacco Retail License statute, any store caught selling will face either a fine or a 30 days suspension of their license for the first offense.A second offense brings a 90-day suspension. The third offense bumps that up to a year. If a store is caught selling to underage customers four times in five years, their license gets revoked.But some city leaders feel that's not harsh enough."I think that they looked at the ,000 fine and said that's just the cost of doing business," says City Councilman Gary Kendrick. "I think it's greed. These stores are profiting from the future suffering of our children, and I am going to stop it."Kendrick wants to make the first offense a 90-day suspension and raise the fine. He also wants more enforcement.The move comes after 15 stores got citations during enforcement stings during the spring. That's a big spike from previous years where as few as one store was cited.Of the 15 stores cited, eight are filing appeals. Six paid the fine for the first offense, and one store took a 90-day suspension for a second offense."This is a huge problem," says Kendrick.But store owners say more punitive penalties are not the solution."Is that going to solve the problem? I don't think so," says Isam Habib who owns the Ranch Liquor store on Washington Avenue."What can you do? When you have to hire employees in and out, and they're young, you train them, you teach them, and they make a mistake," he says.Habib says store owners don't think they should lose a large chunk of their business for one mistake."We just gotta check the IDs," he says. EARLESVILLE, Md. — Deputy State Fire Marshals are investigating an incident that left a Maryland student burned on a school bus on Tuesday afternoon.Fire crews and investigators were dispatched to Hack's Point General Store located in Earlesville, Maryland when they found the student with burns on his hands.An investigation showed that while the school bus was on route to drop off students from Bohemia Manor High School, the students on the bus notified the driver that there was a cellphone on the floor smoking.They say the 18-year-old student picked up the cellphone from the ground and he burned his hands while attempting to throw it off the bus.The student was later transported to Union Hospital of Cecil County with non-life threatening injuries.Investigators are trying to determine the cause of the phone explosion. 872
