NEW YORK CITY — Defense attorneys are not only calling for two NYPD officers to be fired after body camera video showed them beating a man, shoving him to the ground and macing him, but lawyers are also calling for one of the officers to be charged with felony assault. The video, recorded on May 25, was released on Wednesday.Edda Ness is a Legal Aid Society attorney assigned to represent the man."It's unjustifiable what they did," Ness said. "They should have been fired immediately. This case should've never been prosecuted."Police confronted 30-year-old Joseph Troiano for taking up more than one seat in the mostly empty subway car, a crime that hasn't been prosecuted by Manhattan District Attorney Cy Vance's office since 2016.Troiano was charged by police with resisting arrest and other misdemeanor charges. But the district attorney's office added a felony assault charge after Vance's office determined that Troiano had injured one officer's hand in the encounter. That charge was when the video of the incident surfaced."After a thorough investigation, our prosecutor intended to offer the individual an Adjournment in Contemplation of Dismissal at his next court appearance," a spokesperson from Vance's office said in an e-mailed statement. "The District Attorney was provided with the available footage last night and determined that our office will advance the case for this purpose, dismiss the assault charge, and offer an adjournment in contemplation of dismissal for the remaining misdemeanor charge."The Legal Aid Society called for the officers' dismissal by name."[We're] calling for the two officers, Shimul Saha and Adonis Long, to be immediately fired," Ness said.Officers Adonis Long and Shimul Saha confronted Troiano around 12:30 a.m. on May 25. After Troiano was told to leave the train, he moved to another subway car. Police followed him."Step off the train," one of the officers said in the video. "You're holding up the train for everybody. Step off or I gotta drag you off."Troiano asked them how he was holding up the train, and he refused to get off. When Long reached out for Troiano's arm, the subway rider pushed Long's hand away."Don't touch me," Troiano said. "Don't touch me. Get off of me."Long then repeatedly punched Troiano in the face. The first punch caused Troiano's eyeglasses to fly off his face. Long and Saha pulled Toriano from the subway car, and he was thrown to the ground in the station. One officer pulled Troiano over to a wall while the other kicked his belongings off the train. Police told him to sit down, and then pepper-sprayed him in the face when he didn't immediately comply.Toriano turned to the wall and covered his eyes; he cried and took a few steps away from police, then fell to the ground where he continued to cry. Officers made him stand, but then told him again to get on the floor."Help me," Troiano said as he got down on the ground.Video shows that Troiano, face bloodied, struggled with police while on the floor. Officers pulled at his hair and held a hand on his neck. One of Troiano's shoes came off. He asked to be allowed to stand up."I'm having a panic attack, please," he said. "I'm sorry. Please, guys, you're killing me."Troiano was taken to a local hospital on a stretcher. He was charged by police with resisting arrest, obstruction of governmental administration and taking up more than one seat on the subway.Walter Signorelli, a retired NYPD inspector who's now an attorney who represents clients suing police, pointed out that Troiano first disobeyed an order from the officers, after which Long struck."It's always difficult to second guess an officer," Signorelli said. "The officer might have [first] said, 'You're under arrest,' which would have made everything clearer and more legal."Legal Aid is calling for prosecutors to charge Long with felony assault. Meanwhile, Ness said her client has had emotional challenges since the late May incident."It's a lot of trauma," Ness said. This story was originally published by James Ford on WPIX in New York City. 4069

NEW YORK (AP) — Democratic presidential candidate Elizabeth Warren on Friday rolled out a proposal to break up the biggest U.S. technology companies, saying they have too much control over the economy and Americans' lives. In her pitch to rein in the influence of tech giants, the Massachusetts senator envisions legislation targeting companies with annual worldwide revenue of billion or more, limiting their ability to expand and forcing parts of Google and Amazon's current business structure to operate as separate entities. As president, Warren said she would pick regulators who would seek to break up what she called "anti-competitive mergers" such as Facebook's recent purchase of Instagram and Amazon's acquisition of Whole Foods. She made the pitch ahead of a rousing town hall appearance Friday in the New York City neighborhood where Amazon recently scrapped plans to open a new headquarters. It's Warren's latest effort to shape the policy agenda for the rest of the Democratic presidential primary, coming after earlier announcements of a "wealth tax" plan on households with high net worth and a universal child care proposal. Her tech agenda, coming at a time of rising public concern about the growing power of the dominant players, could force the rest of her rivals for the 2020 nomination to follow her lead.During remarks before a crowd of more than 1,000 people in Queens, Warren touted elements of her new tech-industry plan as part of her stump speech. She took aim at Amazon's search for lavish economic incentives from cities competing for its headquarters, likening the company's efforts to pit areas against each other to the dystopian film "The Hunger Games.""That's what's wrong with the system. It's not just that big tech companies like Amazon have enormous market power, which they do. They have enormous political power," Warren told the audience, describing the industry's lobbying expenditures as a "good return on investment if they can keep Washington from enforcing the antitrust laws."It remains to be seen whether Warren will introduce legislation in the current Congress aligning with the first element of her plan. A spokeswoman, Kristen Orthman, said a bill introduction was not imminent.Warren's latest policy proposal also promised to be a central element of her scheduled visit Saturday to the South by Southwest conference in Austin, Texas.Sen. Kamala Harris of California represents the tech industry's home state, while Sen. Cory Booker has come under scrutiny for his past ties to tech companies — though he's stepped up his criticism of the industry in recent years.Facebook spokeswoman Monique Hall said the company had no comment on Warren's proposal. Representatives for Google, Amazon, Microsoft and Apple did not immediately respond to a request for comment. 2822

NEW YORK (AP) — Pacific Gas & Electric says its equipment may have ignited the 2018 Camp Fire, which killed 86 people and destroyed an entire town in Northern California. The embattled utility, which filed for bankruptcy protection in January, said Thursday it's taking a .5 billion charge for claims connected to the Camp Fire in its fourth quarter earnings. The cause of the Camp Fire, the deadliest in California history, is still under investigation. But firefighters located the start of the fire near a tower on PG&E's Caribou-Palermo transmission line. PG&E says that transmission line lost power right before the fire and was later found to be damaged."We recognize that more must be done to adapt to and address the increasing threat of wildfires and extreme weather in order to keep our customers and communities safe," said John Simon, interim CEO of PG&E, in a statement. "We are taking action now on important safety and maintenance measures identified through our accelerated and enhanced safety inspections and will continue to keep our regulators, customers and investors informed of our efforts."PG&E also recorded a new billion charge related to the 2017 wildfires in Northern California, saying it still estimates it is facing wildfire liabilities in excess of billion.Citing extraordinary challenges from wildfires, PG&E's management concluded the circumstances "raise substantial doubt about PG&E Corporation's and the Utility's ability to continue as going concerns."PG&E also said there was an outage and downed wires in another location, called Big Bend, that morning. While fire officials have identified the second location as another potential ignition point of the Camp Fire, PG&E said it's unsure if that problem might have ignited the fire. The Caribou-Palermo transmission line has been out of service since mid-December, and inspections have identified equipment that needs repair or replacement, the company said. 1997

NEW YORK (AP) — Carl Lentz, a pastor from global megachurch Hillsong known for his ministry to athletes and celebrities, has been fired. He acknowledged on Instagram that he cheated on his wife. Lentz and his wife, Laura, founded the East Coast arm of the Australia-based church in 2010. Justin Bieber and wife Hailey Baldwin both attended Hillsong in Los Angeles. "This failure is on me, and me alone and I take full responsibility for my actions. I now begin a journey of rebuilding trust with my wife, Laura and my children and taking real time to work on and heal my own life and seek out the help that I need," Lentz said in his social media post. 661
