Dramatic moments in a San Bernardino courtroom today as a prosecutor slammed a sledgehammer onto a table. He was simulating what he says is how a Fallbrook family of four was murdered in 2010. Charles Merritt is accused of killing his business partner, Joseph McStay, his wife Summer and their two young sons Giani and Joe Jr. The prosecution says Merritt was being sidelined from the business and owed thousands of dollars to McStay. The defense countered in their closing arguments that the prosecution focused on trying Merritt’s character and not the actual facts of the murder. The defense told jurors the circumstantial case produced no evidence tying their client to the family’s violent deaths. The prosecution told jurors they didn’t have to prove how, where or when the murders took place, only that Merritt committed them. The McStays disappeared from their Fallbrook home in early February 2010. Days after they were last seen, the family’s SUV was found abandoned at a strip mall parking lot in San Ysidro.In 2013, the bodies of the family members were found in the Mojave Desert, near Victorville. Prosecutors said the family died from blunt-force trauma to their heads. Authorities found a sledgehammer, believed to be the murder weapon, in one of the graves.Merritt was arrested in connection with the killings in November 2014 after sufficient evidence linking him to the case, including DNA, was discovered.Authorities alleged Merritt killed the family members inside their home and then buried them in the desert. Merritt also tried to paint over the crime scene, according to authorities.Merritt, 61, has pleaded not guilty to charges of murder and is being held without bail.Prosecutors are seeking the death penalty in the case. 1758

DULZURA, Calif. (KGTV) - An East San Diego County man was arrested Thursday on suspicion of poisoning his wife with Thallium.The woman was taken to a hospital on March 15 with an unknown illness. Deputies said the woman had a level of Thallium in her system that was so high, medical staff believed her exposure was intentional.Thallium is a heavy metal which has been used in rat poison and ant pesticides.Sheriff’s detectives, along with the FBI, NCIS, and San Diego County HazMat, conducted an investigation and believed the woman’s husband was responsible for her poisoning.Race Remington Uto, 27, was booked into Vista Detention Facility. EL CAJON, Calif (KGTV) -- A 26-year-old man accused of fatally stabbing a fellow Ramona resident during a fight at a gas station in their East County hometown pleaded not guilty Tuesday to a murder charge and was ordered held on million bail.    Jarrett Austin Wishnick is suspected of mortally wounding Steven Faught, 59, shortly before 6 p.m. Thursday near a set of fuel pumps in front of Stage Stop Liquors at 578 Main St.    Deputies responding to a report of an assault at the business found Faught bleeding profusely from a wound to his neck, sheriff's Lt. Greg Rylaarsdam said.    Paramedics airlifted the victim to a trauma center, where he was pronounced dead. Wishnick -- who remained at the scene of the deadly fight -- was treated for a hand injury before being booked into jail.    It was unclear what prompted the dispute between the men, both of whom had parked their vehicles in front of the gasoline pumps outside the store.    Faught's older brother, Jerry, flew to San Diego from Portland after the incident. He told 10News that his brother had a warm personality.  "Even though he had  very little, he'd give you the clothes off his back."    Wishnick will be back in court Nov. 20 for a bail review and on Jan. 16 for a readiness conference. A Feb. 1 preliminary hearing date was also scheduled.Wishnick faces 26 years to life in prison if convicted of murder and the use of a knife. 1490

Dolly Parton spent Thursday at Vanderbilt's Children's Hospital to celebrate a deeply personal milestone. Her niece, Hannah Dennison, turns 30 years old on Sunday — a birthday Parton wasn't always sure she'd be able to celebrate."Twenty-six years ago is when Hannah was diagnosed with leukemia, and for five years we didn't know if we'd be keeping her or not," Parton told a room full of doctors, nurses, patients and families. "But Hannah now stands here as our chemo hero. She shows that miracles do happen with good care, great doctors and great nurses."Parton met some of those doctors and nurses last fall when she visited the hospital to release her first-ever children's album. During that visit, she decided to donate million to the hospital."They took such good care of her and just looking at the little faces of the kids going through this and the parents who suffer so much as well; it's just touching and moving," she said. "If you're in a position where you can do something, you should do something."In return, the Children's Hospital dedicated it's second floor butterfly garden to Dennison on Thursday."Now that we have Hannah's butterfly garden, we may come up and do little shows now and then and bring some joy to the kids," Parton said.
