SAN DIEGO (KGTV) - Officials with the California Department of Corrections and Rehabilitation say Donovan State Prison officials confiscated a cell phone Tuesday from an inmate who was allegedly using the phone to harass and threaten a woman in New York.According to Christina Neal, 37-year-old Brandon Baker, a prisoner serving 75 years to life at Donovan in South San Diego County, contacted her nearly two weeks ago.“I started getting messages from someone named Brandon Baker, but I had never heard of him before,” Neal said. Neal says Baker found her on Facebook through mutual friends and family members and then began sending her inappropriate messages through Facebook messenger.“He put ‘ma, what’s up, you looking really good. I’d like to get to know you,’” Neal said. “and he was like, ‘you're really sexy.’ And I didn't respond. So then a couple of days later, I got another message from him, and he's talking about my daughter.” “So I was just like ‘I don't know who you are. I don't know how you got pictures of me and my daughter, but please leave me alone, I'm married, and I don't want to have anything to do with you,’” Neal added.Neal says the tone of the messages escalated and Baker told her he would be getting out next month.“He said he was gonna come to my house and said he was gonna rape me,” she said. “I’m very nervous, just because hearing what (he) did, (he) doesn’t seem like (he’s) that nice of a person.”CDCR says they are investigating the case, and Baker could face more punishment depending on what they find on the phone they seized.They released the following statement:“Contraband cellphones are often used to in criminal and illicit activities, conduct drug trafficking, enable gang communication, and harass and intimidate victims and witnesses. Their presence affects safety and security in state prisons and California’s communities. The California Department of Corrections and Rehabilitation uses a multi-layered approach to detect and find contraband cellphones. Smuggling and possessing cell phones in prison is a misdemeanor, and an inmate found in possession of a cell phone can lose credits.” 2150

SAN DIEGO (KGTV) - On Wednesday, the San Diego Police Department issued a press release in which the Chief reaffirmed his commitment to unbiased policing, months before the anticipated release of a new report about officers stopping people in the field. It comes amid community concern over a different report that suggests that minorities are stopped at higher rates.Over FaceTime on Wednesday, 10News spoke with Chris Burbank, a retired police chief from Utah who is now working with the Center for Policing Equity. It’s a nonprofit that looks at data surrounding police interactions with the community. “We try and reduce the disparity that exists in law enforcement today, throughout the country,” he adds.In September, his team partnered with SDPD to start analyzing the department’s stop data for a new report that should be released in about six months. Wednesday’s press release states in part, “Police Chief David Nisleit [reaffirms] his commitment to reviewing internal operations and making any necessary changes based on the report's findings."Last week, a separate ACLU-commissioned report was released that caused some community concern. According to the ACLU, records from SDPD and the San Diego County Sheriff's Department show a pattern of discriminatory policing against black people and people with disabilities. SDPD has not issued a formal comment on the ACLU-commissioned report. Last week, the San Diego County Sheriff’s Department sent 10News the following statement. “The San Diego Sheriff's Department is committed to providing the highest level of public safety in all the neighborhoods we serve. We expect all of our stops, detentions, arrests, and searches to be constitutional and within Sheriff's policy. We regularly meet with community groups which allow us to address concerns and continue to build trust with the citizens of San Diego County. We have just been made aware of a report evaluating policing in San Diego. It would be premature to speak about the findings prior to reading and evaluating the methodology used to reach the conclusions presented in the report. However, at a glance some of the statistics in the report do not correlate with our numbers. For example, the report seems to overstate the rate at which Blacks and Hispanics are stopped within Sheriff's jurisdictions. The numbers in the ACLU report do not appear to be consistent with our data. SAN DIEGO (KGTV) — One person was killed and police were searching for a suspect after a shooting in the Chollas Creek neighborhood.San Diego Police said one victim was transported to a nearby hospital after the shooting at about 2:30 p.m. Friday in the 5200 block of University Avenue.Police later confirmed the victim died of their injuries.Police were still searching for a gunman following the shooting. SDPD's homicide unit has taken over the investigation.Delays for drivers are expected in the area on University Ave., police added.No further information was immediately available. 596

SAN DIEGO (KGTV) - People who live near Mini Square Park in City Heights are fed up with what they say is a rise in crime and noise. They're calling for a curfew to be imposed at the park from 9 pm - 5 am."Every rule that's posted here is broken all day long and mostly all night long," says one woman who asked 10News not to identify her because she feels unsafe in her home next to the park. "I can get practically high from the marijuana that comes into my window cause it overlooks the park. The noise becomes just unbearable at times."The park opened in 2014, on 43rd Street in between Polk and University Avenue. Sitting between a senior center, an apartment complex and a health clinic, It was designed as a way to give adults in the community a gathering place.Instead, neighbors say it's been overrun with crime and drugs.A search of the website crimemapping.com shows 148 crimes reported within 1000 feet of the park over the last six months. That includes 21 stolen cars, 19 assaults and 16 robberies.It's gotten to the point where some people say they're afraid to walk by it, especially at night."Of course I would like to be in this park, to spend my free time there," says Isaac Musaazi, who lives in the apartment complex next door. "But I can't because of the people who are there."A community meeting to discuss a curfew and how to enforce it is scheduled for Thursday with the Community Parks Committee. SAN DIEGO (KGTV) -- On Thursday, January 3, the newest members of Congress will head to Washington D.C. to be sworn in. Among them is Mike Levin, who will represent California's 49th Congressional District. Levin, an environmental attorney, ran a campaign focused on younger voters. During the campaign, he cast his opponent, Diane Harkey as a “rubber stamp" for President Donald Trump. The district was previously represented by Darrell Issa. Juan Varges of the 51st Congressional District will also head to Washington. Varges made headlines recently after pointing the finger at the Trump administration for the situation at the border after hundreds of migrants rushed the San Ysidro Port of Entry. The 51st Congressional District consists of south San Diego County, Imperial County and California’s entire U.S./Mexico border. Also in Washington for the swearing in is Congressman Scott Peters of California’s 52nd District. The district includes the cities of Coronado and Poway as well as most of northern San Diego. Peters was first elected in 2012. In 2018, Peters introduced legislation to provide a tax credit who paid more than 30 percent of their gross income on rent and utilities. Rep. Susan Davis was re-elected in 2018 and represents California’s 53rd Congressional District. The district stretches from I-5 and Balboa Park through Mission Valley to East County and includes much of the heart of San Diego.Davis has been serving the district since 2001 and in 2018, won against her opponent, Morgan Murtaugh. Heading to Washington also is Congressman Duncan Hunter of California’s 50th Congressional District.
