SAN DIEGO (KGTV) -- The retrial began Thursday for Constantino Banda Acosta, the man prosecutors say was drunk and angry from a fight when he caused a hit-and-run crash that severely injured a 6-year-old returning from a family trip to Disneyland. The jury was deadlocked Thursday on whether or not Banda was even at the wheel. Throughout the trial, Banda sat quietly in the courtroom and could be seen smiling at the jury as attorneys laid out their case.The central question in the retrial is whether Banda or an employee of his construction company, Jorge Adame Ariza, was the one driving.RELATED: Verdict reached in trial for driver accused in hit-and-run crash that injured boyAriza was captured in security footage driving the truck from a restaurant where the two men were drinking.Ariza claims he turned the wheel over to Banda before the accident happened, which severely injured 6-year-old Lennox Lake of San Ysidro. Authorities say Banda had also been deported at least 17 times before the crash.Prosecution in the case say the two men were heatedly searching for a man who beat up Banda. Lake’s father says the young boy is expected to testify in the trial later Thursday.Lake is still receiving extensive treatments for his injuries.RELATED: Jury deadlocked in case against driver accused in San Ysidro hit-and-run?Banda was speeding west on Camino de La Plaza around 11:30 p.m. on May 6 when he reportedly ran a stop sign at Dairy Mart Road and crashed his pickup into a Honda Accord carrying the Lake family. In September of 2017, a jury found Banda guilty of misdemeanor charges of driving without a license, battery and vandalism. The jury was hung, however, on felony charges of hit and run causing death or permanent injury, DUI causing injury and driving with immeasurable blood alcohol causing injury.  1866

SAN DIEGO (KGTV) - Thirty-seven people were charged with drug and firearms trafficking throughout North San Diego County, according to unsealed indictments — in some case, feet away from schools.More than 100 members of the North County Regional Gang Task Force, the FBI SWAT team, and other local agencies arrested 18 of the 37 defendants Wednesday.Heroin, methamphetamine and fentanyl and firearms, including a semi-automatic pistol, revolvers, and a two AR-15 style assault rifles, were also seized during the arrests, according to the U.S. Attorney’s Office Southern District of California.Officials said the drugs and firearms being trafficked were stored and sold in North County, including near Libby Lake Park and several schools: Jefferson Middle School, Clair W. Burgener Academy, Mission Elementary School, San Marcos High School, and Joli Ann Leichtag Elementary School.Wednesday's arrests are part of a federal and local investigation into street gangs operating in Encinitas, San Marcos, Oceanside, Vista, Carlsbad, Escondido, and elsewhere. Many of those arrested reportedly have ties to the Mexican Mafia, officials said.In total, 27 of the 37 being charged are in custody, according to the U.S. Attorney’s Office Southern District of California. The remaining 10 are being sought."We have a special resolve to go after gangs that have the audacity to operate on the boundaries of our schools, where children play and learn," U.S. Attorney Adam L. SAN DIEGO (KGTV) — Though some of Balboa Park and its museums have partially reopened, the San Diego Natural History Museum will remain closed until 2021."The Nat" is keeping its doors closed for the rest of the year, despite whether public health orders allow the museum to reopen with coronavirus-related restrictions. Officials said the decision to keep the museum closed "was not an easy or obvious decision."During the five-month closure, museum staff said they will focus on exhibition space projects and programs, including:A new "California Blooming" exhibit upon reopeningConstructing an ADA-compliant ramp on the museum's east entranceDeveloping a new museum cafe and retail storeConverting a row of staff offices on the fourth floor into a gallery for future exhibitsCompleting a master plan for gardens outside the buildingThe museum is also reimagining its Canyoneers program to virtual hikes and recommendations and developing more digital options for the community, and students and teachers."The museum we closed in March will not be the same museum we reopen," said Judy Gradwohl, president and CEO of The Nat."Our future will combine the best of our work before and during the pandemic in a hybrid model that connects people with the wonder of nature on-site, online, and out in nature."In the meantime, staff say they plan to stay engaged with the community.“I look forward to seeing how our creative and energetic staff will make the most of the next five months,” said Gradwohl. “To borrow an analogy from the monarch butterflies I’ve been rearing this summer, I look at this extended closure and our eventual reopening as emerging from a chrysalis, not a hibernation.”The museum has been able to keep about 100 of its full-time and part-time staff and doesn't expect any changes to those positions.
