CARLSBAD, Calif. (KGTV) - More than two and a half years after Team 10 first reported about a North County property management company accused of stealing money from clients, the victims are finally getting their money back.Kelley Zaun owned Carousel Properties, a Carlsbad property management company. Victims first told Team 10 in 2016, they hired her to pay fees associated with their rentals. They said she did not pay those fees. She was accused of taking roughly 0,000 from victims, according to investigators.In 2018, Zaun faced 29 felonies for embezzlement, according to Deputy District Attorney Anna Winn. Zaun entered into a plea deal and agreed to a year in custody. With the help of the DA’s office, Zaun’s former clients were able to get their money back through the Department of Real Estate’s Consumer Recovery Account. RELATED: Team 10: Police investigating Carlsbad companyStephen Lerner, the Assistant Commissioner for Legal Affairs for the department, said so far, 23 victims have been reimbursed through the account. Other victims’ payments are still processing. They have been able to reimburse 2,084.68 thus far.The Consumer Recover Account is an option for fraud victims when trying to recoup money from the person who took it from them. In order to utilize the fund, Lerner said there must be a criminal or civil court order for the defendant to pay back money he or she took. If victims cannot get refunded from the person who stole it, they can apply through the Department of Real Estate (DRE).Winn said she volunteered to be the victims’ liaison with the DRE, as the process for reimbursement is lengthy and many of the victims were elderly. One of Zaun’s victims told Team 10 he is “extremely grateful” for the DA’s office work on this case. Lerner told Team 10 there are approximately 421,000 people with a license under their department, which includes broker and salesperson’s licenses. 12 percent of the license fee paid goes to the account.Since 1964, the DRE has paid more than million to victims. Californians have voted to carve out specific gig workers from a state employment law about who is considered an employee and eligible for benefits.That means people who drive for Uber and Lyft will remain classified as independent contractors and will not be eligible for employee benefits.A California Supreme Court decision in 2018 created a strict test to decide whether a self-employed worker, like gig workers, should be considered employees.In response to the ruling, lawmakers amended Assembly Bill 5 in 2019 to add additional professions where services could be provided by independent contractors, and would not necessarily be employees. However, no changes were made for app-based companies like Lyft, Uber and DoorDash.The state law made app-based drivers employees, and would pay them for their time both while they are driving and they are waiting for a new ride, and offer employee benefits like paid sick leave and workers compensation for one-the-job injuries, the Los Angeles Times explains.Since the proposition has passed, drivers will remain categorized as independent contractors, although the proposition includes wording to require companies to provide an hourly wage for time spent driving equal to 120% of minimum wage. The language also gives drivers a stipend for purchasing health insurance coverage when their driving time averages at least 15 hours a week. However, only hours spent driving counts toward that total, not the time spent waiting between trips.Proposition 22 was launched and partially funded by Lyft and Uber. CAPE CORAL, Fla. - It all started with a high school assignment.Megan O’Grady says she had to write about a topic that she felt passionate about in her life.As the daughter of a law enforcement officer who had recently learned of the deaths of five officers during a 2016 protest in Dallas, it wasn’t hard for her to share what she was feeling at the time.That paper would soon turn into a passion project and the nonprofit, Blue Line Bears.Four years later, the group has dispersed more than 700 teddy bears - sewn with the uniforms of fallen law enforcement officers and given to loved ones that have been left behind.“Taking that uniform shirt and making it into something that can be held and cuddled...it gives them comfort and a little bit of their loved one back,” the 18-year-old tells FOX 4.She says prior to this year, Blue Line Bears filled five to ten requests per week from agencies across the country.“Now, it can be up to like 20 or 30”.Megan’s father is Master Sergeant Patrick O’Grady with the Cape Coral Police Department.He says agencies from all over reach out to the group for bears.O’Grady says they also use the website Officer Down Memorial Page to keep track of impacted families.According to the site, there was 148 line of duty deaths in 2019.This year and at the time of this story, the website reports that the number is already 247.The site says most of those deaths are related to COVID-19 and gunfire.“At any time, we can have over 100 shirts waiting to be turned into bears,” O’Grady says.With an increase in demand comes the need for an increase in space.That’s why the nonprofit is now expanding to an official location in Cape Coral.Megan says the new space will serve as a place to hold meetings and a go-to location for the community to purchases merchandise.She says she's most excited that it will also provide a bigger workspace to prepare the keepsakes that bring support to many families.Because as Megan, now in her first year of college, says, “There’s always a lot of bears to be made.”The O'Gradys say the new location will be complete by the end of the year.The address for the new storefront is 3032 Santa Barbara Boulevard.Click here for more information about Blue Line Bears.This story was first reported by Shari Armstrong at WFTX in Fort Myers, Florida. 2315
