A judge ruled Tuesday the City of Omaha must release a video showing the death of a TV crewman during a shootout at Wendy's in 2014.Bryce Dion, a sound mixer on a shoot at a Wendy's in Omaha for the reality TV show "Cops," was shot and killed Aug. 26, 2014, after Omaha Police returned fire on a man who shot a pellet gun at officers. Officers were called to the restaurant on a report of a robbery.In the video, someone could be heard repeatedly asking, "Bryce, are you alright?" He can be seen slumped against a glass wall in the vestibule of the restaurant.Dion was wearing a bulletproof vest, but was hit with a bullet under his armpit. The suspect, Cortez Washington, who was using an airsoft pellet gun, was also killed.In 2016, Dion's brother, Trevor Dion, filed a wrongful death lawsuit against the city, which had asked a Douglas County District judge to bar the release of the video, according to the Omaha World-Herald. The lawsuit says Dion was doing as instructed when he was hit by gunfire from an Omaha police officer.“Bryce positioned himself where told, when told, and acted in accord with police officer instructions. The perpetrator drew what appeared to be a pistol, but proved to be a pellet gun that simulated discharge. Police responded with live rounds of ammunition. They shot and killed the perpetrator. As they did so, they also shot and killed Bryce who was positioned as directed between at least one police officer who arrived at the scene belatedly, other police officers, and the perpetrator.”Brian Jorde, Dion's attorney, says he plans to use the video and other evidence at trial. The proceedings are expected to begin sometime after July."There's approximately 20 bullet holes just near the area of where Mr. Dion was alone so there's a significant amount of gunfire that was exchanged," Jorde said. "We think the public deserves to know what happens when their taxpayer dollars are at work with the police and otherwise. And I think it sheds light on exactly what happened and that Mr. Dion was caught in the line of the crossfire through no fault of his own."Omaha City Attorney Paul Kratz said the city played the video in court Tuesday to support its motion for the case to be dismissed."The city presented the video to the court in support of its motion for summary judgment, and we believe the video will support that motion," Kratz said when reached by phone Tuesday night. 2468

A glitch to the IRS' e-file portion of its website prompted the IRS to push back the deadline to file taxes from today (April 17) to tomorrow (April 18). The IRS said that both individuals and businesses can take advantage of the extra filing day without penalty. “This is the busiest tax day of the year, and the IRS apologizes for the inconvenience this system issue caused for taxpayers,” said Acting IRS Commissioner David Kautter. “The IRS appreciates everyone’s patience during this period. The extra time will help taxpayers affected by this situation.”The IRS said that during the system outage, taxpayers were able to file their tax returns electronically through their software providers and Free File.Taxpayers using paper to file and pay their taxes at the deadline were not affected by the system issue, the IRS said. The glitch shuttered part of the IRS' website, not allowing some who file taxes online to complete their taxes. A brawl broke out during a sentencing Wednesday afternoon of a former daycare owner accused of reckless homicide in the death of a 7-week-old baby in her care.37-year-old Claudette Mitchell was being sentenced for charges related to the death of a 2-month-old child that died while in Mitchell's care last August at "WHO'S LUVIN YOU" daycare. Mitchell ran the daycare out of her home on Milwaukee's northside. A criminal complaint says Mitchell told police she put the baby down for a nap and when she checked on her about an hour later she was unresponsive and had scratches and blood on her face. Court documents show the baby suffered multiple fractures to her skull and bruising all over her body. Forensic investigators believe the baby died of blunt force trauma to the head.  Mitchell received a sentence of 42 months, and upon release, 48 months of supervision. Following the sentencing, an altercation broke out between 50 members of Mitchell's and the victim's families and friends according to the Milwaukee County Sheriff's Office.Additional deputies and district attorney investigators were called to the room to restore order. Authorities say additional security had been in place prior to the altercation but Mitchell's loved ones did not comply with deputies’ orders to remain in the courtroom while the victim’s family was being escorted out. 1407

A group of siblings are back together after being separated in foster care.A Texas couple with three biological children officially adopted the five siblings over a Zoom call in May, doubling the size of their family.Andi Bonura says she and her husband, Thomas, had been wanting to adopt after years of pregnancy issues. Their three existing children, Joey, Sadie and Daphne, were born premature. They also lost one child during a pregnancy and another died in the NICU.So, in 2017, the couple got licensed to become foster parents. Their first foster child was Bryson, who is now 2 years old. The couple then began fostering two of Bryson’s older siblings, David and Gabrielle.Eventually, the two final siblings, Thomas and Carter, started visiting the Bonura home and asked if they could also come live with them, according to Bonura.Bonura says that one day, she got a call saying their foster children’s biological parents were terminating their rights to the kids and they were given the option to adopt them. They said yes.Bonura says finally adopting the children was so freeing and felt wonderful.“We had been working so hard for years to get them all together, to bond as a family and it just feels so amazing to all of us, knowing we are a family, finally,” said Bonura.If you’re considering becoming a foster parent or adopting, Bonura says to do it if you can.“It will be the single most important and meaningful thing in your life,” she said. “The struggles to get to the place, your goal, is worth every tear.
