SAN DIEGO (KGTV) - Hundreds of people are sitting in San Diego County jails waiting for jury trials that are postponed indefinitely because of the pandemic. ABC10 News interviewed San Diego County District Attorney Summer Stephan about concerns over whether justice is being delayed.ABC10 News looked into the issue after the wife of a man who's locked up in a San Diego County jail emailed the newsroom for help. ABC10 News is not revealing her identity. Her husband fears retaliation over his case. She wrote to ABC10 News that he’s been waiting for more than a year for his day in court but there is no telling when that will be. In her series of emails, she explained that he was wrongfully accused of a crime and that she doesn’t have the money to bail him out. “Most of the other men incarcerated with my husband have been told to expect no further steps in their cases until early next year,” she added.He's being held at George Bailey Detention Center and is one of the many inmates who were scheduled to be tried in front of San Diego County juries until jury trials were halted months ago because of the COVID-19 threat.“These criminal defendants have a right to a fair and speedy trial. How do you uphold that 6th amendment constitutional right in the middle of a pandemic?” ABC10 News asked San Diego County District Attorney Summer Stephan. “Upholding those constitutional rights is so important to us but these requests are based on these very unprecedented times,” she stated.DA Stephan added that close to 2,500 jury trials have been postponed. Trials were stopped on March 17th. Non-jury trials are currently in progress through a remote virtual process. San Diego courtrooms are now being retrofitted with protective measures like plexiglass barriers. Local court officials have requested another extension from the Judicial Council of California for jury trials to be postponed through mid-September. That could be further delayed depending on how virus case numbers trend.ABC10 News filed a public records request for details on all the people who are waiting to be tried by jury. The DA’s Office returned a list of thousands of defendants.The majority are out of custody, but the DA confirmed that there are roughly 360 felony defendants and 50 misdemeanor defendants who’ve been sitting in jail until their trials can happen.“Most of the cases receive what we call probable cause hearings where a neutral party- a judge- has heard the evidence and believes that it is sufficient to continue to hold them,” said DA Stephan.She told ABC10 News that most of the felony defendants are being held on very serious, violent offenses and the same applies to defendants being held on misdemeanors. “Most of those [misdemeanor cases] are domestic violence where there is a danger to the victim or multiple DUI offenders,” she added.“The number of defendants has dropped dramatically that are normally held in our detention facilities,” San Diego County Superior Court Presiding Judge Lorna Alksne recently told ABC10 News. She said that she’s been working with the District Attorney’s Office, the Office of the Public Defender and the San Diego County Sheriff's Department to lower the jail population of non-violent cases and release the elderly and others with compromised immune systems.As of Monday, the Sheriff’s Department’s website showed that 3,748 individuals were being held in San Diego County jails. DA Stephan said that’s a 20% population reduction since the start of the health crisis.“What do you say to the defendants who are in custody and claim their innocence and in the eyes of the law are innocent until they are proven guilty but they are being held, indefinitely?” ABC10 News asked DA Stephan. “The only thing we can't have is a jury trial right now,” she responded, in part.“We are all very, very anxious and looking forward to having jury trials. It's the best of our democracy,” she added.Once jury trials are able to resume, D Stephan said that their office with prioritize serious, violent felony cases and defendants who are approaching their maximum sentence.The Sheriff’s Department sent ABC10 News the following statement.“In response to the COVID-19 pandemic, the Sheriff's Department is collaborating with our criminal justice partners on the video court appearance process. Every jail has been outfitted with audio-visual equipment for these virtual hearings. The Sheriff's Department produces defendants based on the Superior Court's official calendar. Although, social visits have been suspended, defense attorneys have retained the ability to meet with their clients in person at the detention facilities, via telephone or video conferencing, to ensure the process moves forward as fluidly as possible. Video hearings have eliminated much of the custody time for those who have been arrested and in need of arraignment. These video hearings have significantly reduced the number of persons who would still be in custody awaiting in-person appearances.""The Sheriff's Department is committed to making this process as efficient as possible, until the courthouses can be re-opened for proceedings. Those who remain in our custody are awaiting an arraignment hearing, have been remanded to the custody of the Sheriff's Department pending further court proceedings, sentenced to local custody or pending transfer to state prison.”The Office of the Public Defender sent ABC10 News the following statement.“Our clients are always our priority. SAN DIEGO (KGTV) — Friends are expected to come together to remember the Navy sailor shot and killed while checking on an apparent stalled vehicle.A vigil for 21-year-old Curtis Adams will be held Saturday at Breakers Beach on Naval Station Coronado. Those attending will need valid military identification since the vigil is on-base.Adams was shot and killed on Interstate 15 near Mountain View in the early morning hours of Oct. 27. Medical experts say it's not necessarily going to work.The lines were hours long in front of a Linda Vista testing site, just as long at sites around the county Sunday."There's a worrisome reason for that, people are planning to go visit their older relatives and they think they're going to be 100% safe," Dr. Davey Smith, Chief of Infectious Diseases at UC San Diego said getting tested Sunday or any day leading up to Thanksgiving could give you a false negative."If I get tested now, it doesn't mean that I'm not infected, it just means that I'm not actively shedding the virus," Smith said.According to the CDC the incubation period for the virus is 2-14 days."I thought Halloween was going to be the scary part of the year but November, December, January are just going to be really tough I think. We've got Thanksgiving coming up, then we have Christmas coming up and then New Year's and everybody is tired of being on lock down, it breaks my heart," Dr. Smith said leaning back in his chair.Data shows after each holiday this year, we've seen a spike in cases.The CDC and Dr. Smith urge everyone to gather virtually, or in small groups outside, socially distance and wash your hands often.We all know 2020 has been the year of sacrifices and Dr. Smith feels it too, "I'm really grateful for my niece who I have not met yet, because of the pandemic, I am so excited, I get pictures every day, so I'm pretty happy."All of us hopeful next year we can all be with our loved ones."If we can just get through the winter, I promise these vaccines and treatments are really going to change everything and that just means there will be more of us to celebrate next year," Dr. Smith said. 1811

SAN DIEGO (KGTV) — How safe do you feel eating at Petco Park? Or if you've chosen to support the Chargers, StubHub Center?A newly published analysis by ESPN's Outside the Lines investigated thousands of food-safety inspection reports from health departments that monitor professional sports venues across the U.S.The analysis looks at routine inspection reports from 2016 to 2017.According to ESPN, about 28 percent of the venues registered high-level violation in half or more of their food service outlets. The violations cover temperature, pests or bugs, poor condition of food, equipment failures, employee-related issues, and more.The study's worst is in Charlotte, N.C., where Spectrum Center — home of the NBA's Charlotte Hornets — posted a 92 percent violation rate, followed by Michigan's now-closed Palace of Auburn Hills (86.11 percent), and Texas' American Airlines Center (83.08 percent.)The highest rated stadium was Oakland's Oracle Arena — home of the NBA's Golden State Warriors— with a 1.12 percent violation rate.Petco ParkSan Diego's downtown ballpark ranked fifth among MLB venues and 24th among all venues analyzed by ESPN.Of the park's 168 outlets inspected, 28 recorded high-level violations, according to ESPN's study. The study found the park registered on average 0.09 high-level violations per inspections.Some of those violations, for example, including pest-related issues— two of which occurred in 2016 inspections. On Aug. 18, 2016, an inspector found bird droppings on top of an ice bin and on Sept. 20, 2016, rodent droppings were discovered on the floor and top of a concession stand's ice machine. That ice machine was taken out of service for the rest of the season, according to the study.The San Diego Padres told 10News they are "confident that our ballpark will continue to be one of the safest" in baseball:“We strive for excellence with our food and beverage service at Petco Park. Violations are unacceptable; and, it is our policy to immediately address any issues directly with our concessionaire to ensure they are corrected and do not occur again. We are confident that our ballpark will continue to be one of the safest in all of baseball, as evidenced by ESPN’s published rankings today," the statement read.StubHub CenterThe home of the Los Angeles Chargers came in seventh in the NFL and 22 among all venues in ESPN's study.Of the venue's 39 outlets inspected, 6 recorded high-level violations, the study says, and 0.06 violations per inspection, on average.Some of the violations recorded included employees not properly wearing hair restraints on July 15, 2017, and food not properly protected from contamination on April 29, 2017, the study says.In a statement to 10News from Levy, hospitality partner at StubHub Center, the company noted their violations compare "highly favorably" to the average number of violations at any restaurant:“We welcome the local Los Angeles County health department and employ third-party sanitation experts to ensure a safe environment for our guests. Any time a concern is identified, we immediately correct it and welcome the health department to return to confirm that we are in full compliance. SAN DIEGO (KGTV) - For three decades, the Salvation Army has been serving Thanksgiving meals to those in need.This year, it looks a bit different."Just because we have masks and social distancing, their needs haven't changed," said volunteer Elena Misner.Misner says she volunteers on Thanksgiving and Christmas."When I was starting out on my own, the Salvation Army helped me with classes, clothes, services," she said.She says without that initial help, her life might look a lot different."When I got older I found this opportunity," Misner said. "I wanted to give back, so I gave back."In 2020, giving back looks a little different.For the past three decades, the Salvation Army has held large, family-style gatherings inside Golden Hall.But a gathering of that size is not allowed under California and San Diego County COVID-19 guidelines.So, a new idea."It's not inside at Golden Hall but outside with meals and kits to-go," said San Diego Mayor Kevin Faulconer who was volunteering with meal distribution.Just because it looks a little different doesn't mean the traditional meal needs to change.To-go kits included turkey and stuffing, mashed potatoes with gravy, green beans or corn, cranberry sauce, and pumpkin pie."It's not just about a meal today, but some of the help and services and support represents the best of our city," Faulconer said.On Thursday, the Salvation Army served meals at four different locations. 1437
