A Michigan State University trustee who pledged support for victims of sex abuse has opposed them repeatedly in courtrooms as a lawyer, an investigation by Scripps station WXYZ in Detroit has found.Trustee Dan Kelly was elected to the board of trustees in 2016 as the Larry Nassar sex abuse scandal erupted.  His university bio touts 25 years experience as an attorney representing school districts.  In at least seven cases reviewed by WXYZ, Kelly represented districts accused of failing to protect students from sex abuse.Kelly has represented districts like Roseville, Dundee and, at least four times, Warren Consolidated Schools in sex abuse civil cases.Former Warren gym teacher James Kearly pleaded no contest to fourth-degree criminal sexual conduct charges involving three young girls.  In 2004, Kearly and Warren Schools were sued by the victims’ parents, alleging the district ignored more than a decade’s worth of Kearly’s documented fondling.As abuse allegations stacked up, according to testimony, the district moved Kearly to a school that taught younger students in the hopes that he would be less attracted to underdeveloped elementary school girls.While there, three second grade girls said Kearly molested them.“He touched my privates, Mr. K,” testified one of his young victims. “Sometimes in the office and sometimes in the gym.”During trial, Kelly told jurors the district couldn’t be held responsible for Kearly’s actions and, while there was no excuse for what he did, “the touching was always on the outside of the clothing… was very brief and…there’s very strong evidence that (the girls) didn’t know that it was inappropriate when it occurred.”WXYZ shared Kelly’s words with Morgan McCaul, one of Larry Nassar’s victims.“That’s gross.  What you just read is gross,” she said. “When this is a leader and essentially the architect of campus climate, I don’t know how you can send your kids to Michigan State University and feel safe.”The jury in the Kearly case returned a .1 million verdict in favor of the victims.In 2006, Kelly defended a district accused of ignoring allegations that teacher Roderick Reese molested 11 elementary school girls. As is common in sex abuse cases, the plaintiffs filed their lawsuits as Jane Does. But Kelly filed a motion to have the young girls' names made public, saying that the case had already been tried in the press. WXYZ spoke with a parent of one of Reese’s victims, who was 12 when Kelly wanted her name unsealed.“It was kind of like, who’s on trial here?” the father said, who asked that we conceal his identity to protect his daughter. “It’s not my kid or the other parent’s children.”The judge denied Kelly’s motion. The case settled for an undisclosed amount and, in a criminal trial, the teacher was convicted of child molestation. 12 years later, the father of Reese’s victim hasn’t forgotten what Dan Kelly tried to do in court.“I was totally stunned,” he recalled. “Why would he want to do this to these children? They didn’t do anything wrong.”In a January trustees meeting, Kelly apologized to Nassar’s abuse survivors and said, until recently, he had viewed the Nassar scandal through the eyes of a lawyer.“In the back of my mind,” Kelly said, “I thought that this would be resolved in the litigation process.”Attorney Mick Grewal represents more than 80 of Nassar’s victims.“I think he viewed them as the opposition, not survivors,” Grewal said. “It’s clear to me that he’s not the right guy. A mother of a 9-month-old baby is upset after she says her daughter received a second degree burn while she was in a daycare in Detroit on Friday.Her daughter attended Lafayette Day Care Center on E. Lafayette Street in Detroit.It was a seemingly normal day for Sabrina Shellman when she picked up her kids at the center Friday afternoon. It wasn’t until she got home, she noticed a burn her daughter’s leg.The family took the baby to the doctors, filed a police report and then contacted Scripps station WXYZ in Detroit.“It’s frustrating, it’s heartbreaking, it makes me really, really angry,” Shellman said.When she picked up her kids, 9-month-old Jayla and 4-year-old Jayden, she said no one told her about the injury.It wasn’t until she changed the baby that she said she noticed something was wrong.“That’s when I noticed the burn on the back of her leg,” she said. “No one bothered to call me. No one informed me of this at all.”Sabrina rushed Jayla to the doctors, who told her it’s a second degree burn. She immediate called the daycare.Shellman said a manager said the injury did not happen at the daycare. The mother said she thinks they are trying to cover it up.“My daughter received a burn," she said. "They should be ashamed of themselves, definitely, they should be ashamed.”Sabrina asked her son if he saw what happened, he says one of the caregivers did it.“Spilled oatmeal on her leg, that’s what he told me,” she said.Now, Sabrina said baby Jayla has been traumatized.“She’s screaming, she’s yelling, she won’t stop crying.”The daycare manager didn’t want to talk on-camera, but said they don’t know how the baby got burned and claims it didn’t happen at the daycare.Sabrina says that’s a lie.“Mistakes happen but the fact that you all tried to cover it up and didn’t bother to call me that says a lot about them,” she said.The most recent report from the state shows the daycare has no violations. A Pennsylvania couple is facing criminal charges after police say they hid the body of their infant daughter in a plastic container filled with cat litter in a crawlspace inside their home, according to the Berks County District Attorney’s Office.Samantha Trump, 27, and Shaun Oxenreider, 25, are charged with abuse of a corpse, concealing the whereabouts of a child and criminal conspiracy, according to a criminal complaint.Spring Township police began an investigation when two relatives of Oxenreider contacted them, reporting that they’d heard about the death of the 6-month old baby, the criminal complaint says.Officials are still trying to determine how and when the child died. An autopsy has been scheduled.Police say a relative of Oxenreider told them he’d heard several stories about what happened to the baby and who paid for the funeral expenses from Oxenreider, according to the criminal complaint.Police spoke to a Berks County Children and Youth Services caseworker to follow up with the report, the criminal complaint says. The caseworker spoke to Oxenreider and Trump on the phone, then told police their statements were suspicious. The caseworker also told police she could find no record of the baby’s name with either Trump or Oxenreider as a last name at any Berks-area hospital, or at the funeral home where the couple said they had the baby’s remains cremated.When asked to provide a death certificate for the child, Trump told the caseworker that she and Oxenreider were in New Jersey visiting a relative, and would not be back until after Easter, according to the criminal complaint.On Monday night, the criminal complaint says, a relative drove past the couple’s home on the 1300 block of West Wyomissing Court and saw Oxenreider’s vehicle parked outside. The relative contacted police, who went to the home to investigate.The couple initially did not allow police inside, the criminal complaint says. Officers spoke to Trump through the door while Oxenreider attended to the couple’s other child.As the investigating officer and child protective services officials arrived on the scene, Oxenreider left the home, and Trump remained at the door, the criminal complaint says. Trump then dropped to the ground and went into convulsions during questioning by investigators. She was taken to Reading Hospital for treatment, according to the criminal complaint.Police continued to speak to Oxenreider. Shortly after midnight, they asked his permission to search the home, the criminal complaint says. Officers made it clear that they wanted to look in spaces that could potentially conceal a child.Oxenreider agreed to the search.Police eventually searched a locked bathroom, that Oxenreider opened with a key. Inside they discovered used diapers, pictures of the baby, and baby clothing. A door inside the bathroom leading to a crawl space was also found. When police looked inside, they found a large plastic container with the lid snapped shut, the criminal complaint says. The container was filled with cat litter.Officers noticed a plastic trash bag sticking out of the litter. When the bag was pulled out and cut open, the criminal complaint says, police discovered the child’s body inside.Oxenreider was arrested without incident, according to the Berks County District Attorney’s Office.
