SAN DIEGO (CNS) - A jury awarded million Friday to the widow of a retired San Diego Police Department criminalist who committed suicide after he was accused of a 1984 murder.The attorneys alleged the investigation was begun improperly by San Diego police homicide detectives, driving her husband to suicide.The verdict was the result of a federal lawsuit alleging wrongful death and civil rights violations filed by Kevin Brown's widow, Rebecca, against the city of San Diego and its police department. Jurors are due back in court Tuesday to consider punitive damages.Brown, 62, was suspected in the murder of Claire Hough, who was strangled and found dead at Torrey Pines State Beach in 1984. Brown hanged himself at Cuyamaca Rancho State Park in October of 2014, which his lawyers said was a result of the homicide investigation, as well as the seizure of numerous items of sentimental value from his Chula Vista home.Rebecca Brown's attorneys alleged now-retired SDPD Detective Michael Lambert misled a judge when securing an affidavit for a warrant to search and seize property at Brown's home. The affidavit was secured on the basis of Brown's sperm cells, which were found on a vaginal swab of Hough, though Rebecca Brown's attorney, Eugene Iredale, said those cells were most likely transferred onto the swab via accidental cross-contamination.Iredale told jurors that lab techs at the SDPD crime lab often used their own semen as reference samples when conducting testing for the presence of semen.Other DNA evidence found on Hough's clothing pointed to another suspect, Ronald Tatro, who was previously convicted in several other rapes and assaults on women. Tatro, who died in 2011, was matched to several blood stains and a pubic hair found on the girl's clothing, Iredale said.Despite Tatro's DNA being far more prominent on the swab, Iredale said Lambert used Brown's sperm cells and evidence that Brown had frequented strip clubs in the 1980s to suggest he worked in concert with Tatro in the killing.However, no such connection between the men was ever discovered, nor was Brown ever connected to the murder.Brown, who suffered from anxiety and depression, was "obsessed with getting his property back," Iredale said, yet was unable to secure their return over the course of several months.Iredale said the prospect of spending time in jail while fighting to clear his name and the property seizure was enough to push Brown to suicide.The attorney said Lambert was aware Brown was suicidal and held onto his property "because he knew it would cause pain and hurt, because he felt he was going to break him down, he was going to crack the case."Deputy City Attorney Catherine Richardson argued at trial that Lambert relied upon DNA experts when he wrote the affidavit and was not given all the information he needed.The attorney said Lambert asked about contamination when presented with the evidence of Brown's DNA, but was told by his sergeant that contamination was not possible. She also said Lambert was not informed that SDPD lab techs sometimes used their own semen for testing until months after the search warrant was secured.Richardson said the items from Brown's home had to be seized in order to prove or disprove a possible connection between Tatro and Brown, which would have dated back more than three decades, and that a rigid investigation was needed to prove there was no favoritism toward an SDPD employee."If he hadn't investigated (Brown), then the police would have been accused of covering up for one of their own," Richardson told the jury in her opening statement. 3615

SAN DIEGO (CNS) - County environmental health officials issued a water contact closure Friday along the Tijuana Slough National Wildlife Refuge and Border Field State Park due to sewage-contaminated water. The San Diego County Department of Environmental Health issued the closure Friday afternoon following rainfall this week that caused contaminated water in the Tijuana River to flow into U.S. waterways. County officials regularly issue beach closures after rainstorms due to contaminated flows from the river. The closure extends along the shoreline from the U.S.-Mexico border to the southern end of Seacoast Drive. County officials have placed water contact closure signs to alert beachgoers of the water's contamination. The signs will remain in place until water sampling meets state health standards. SAN DIEGO (CNS) - As the San Diego region prepares for possible cases of novel coronavirus, the Health and Human Services Agency reported Wednesday that even with six influenza-related deaths recorded last week, the flu season appears to be winding down.A total of 86 San Diego County residents have died from the flu so far this season, and of the half dozen deaths recorded last week, only one actually happened last week. All of the people who died had underlying medical conditions.That total is more than last flu season's entire toll.As of this time last year, the county had recorded 46 flu deaths. Last season's deaths totaled 77."Influenza appears to be declining, but people should continue getting vaccinated as the flu could last until April or May," said said Dr. Wilma Wooten, the county's public health officer. "The vaccine is safe and effective and the best tool we have to prevent influenza."Last week, Chairman Greg Cox, County Board of Supervisors, recommended everyone get a flu vaccine to protect themselves and their family, and reduce the potential strain on the healthcare system, which may be impacted by novel coronovirus concerns.There have been a handful of novel coronavirus cases in San Diego County and as of yet no deaths."It's important for everyone to educate themselves and their family and be prepared ...," Cox said. SAN DIEGO (CNS) - After hours of public input and deliberation, the San Diego County Board of Supervisors today unanimously approved a .5 billion operating budget for the 2020-21 fiscal year.Previously .4 billion, the revised budget reflects an additional .2 million in recent funding requests, including million for rental assistance, millions of dollars in road projects and an office dedicated to racial equality.Tuesday's vote, held via teleconference, follows two public hearings earlier in August, when board members heard funding requests from residents.Normally held in late June, the budget approval process was delayed due to the COVID-19 pandemic.Supervisors thanked Chief Administrative Officer Helen-Robbins Meyer and her staff for crafting a budget during an especially challenging time.``Putting together a budget is a big job,'' said board Chairman Greg Cox.According to a summary provided by Robbins-Meyer's office, the county is spending .5 billion on health & human services, billion for public safety, 6 million on finance and general government, 2 million on land use and environment, 9 million on various items and 5 million on capital improvements.``I think we can be proud that we have a good, solid and well-balanced budget,'' Supervisor Dianne Jacob said.Supervisor Jim Desmond credited staff members for ``for fighting to do the right thing. SAN DIEGO (CNS) - Health officials announced Tuesday that students at three high schools in San Diego County have tested positive for mumps and may have exposed others to the contagious virus in the last two weeks.One person at each of the campuses -- High Tech High School International, La Jolla High School and San Pasqual High School -- tested positive for the virus, according to the San Diego County Health and Human Services Agency, which did not specify whether the patients were students or staffers.Students and faculty at the three schools are being advised to be aware of possible mumps symptoms, which can include a fever, headache, earache and salivary gland inflammation.The exposures happened during normal school hours on Oct. 21-22 at High Tech High; Oct. 21-23, 25 and 28 at La Jolla High; and at San Pasqual High on Oct. 17-18 and 21-24.Symptoms can show between 12 and 25 days after exposure, according to the San Diego County Health and Human Services Agency."We are working closely with school officials to inform the school communities about the symptoms of mumps and vaccine recommendations," said Dr. Wilma Wooten, the county's public health officer. "Because there is no prevention after exposure for mumps, people should be watching for symptoms and make sure they have all the recommended doses of measles, mumps and rubella immunizations."County health officials have received reports of 47 mumps cases this year, the most in 25 years. Mumps cases statewide, nationwide and in Baja California are also outpacing the number of reported cases at this time last year.The viral disease is passed through coughing, sneezing or close contact. Severe complications are often rare but can include meningitis, permanent hearing loss, a decrease in fertility and fetal loss for pregnant women in their first trimester. Most mumps patients recover without incident.Health officials encouraged all residents to receive the measles-mumps- rubella vaccine to protect against developing the illnesses. The vaccine is recommended in two doses at 12 to 15 months old and at 4 to 6 years old.
