A Minneapolis police officer was charged Tuesday with third-degree murder in the death of Justine Ruszczyk, a 40-year-old Australian woman who was shot in 2017 after she called 911 to report a possible sexual assault near her home.Officer Mohamed Noor turned himself in to authorities, said Sherral Schmidt of the Police Officers Federation of Minneapolis.Noor is being charged with third-degree murder -- "perpetrating an eminently dangerous act and evincing a depraved mind" -- as well as second-degree manslaughter -- "culpable negligence creating unreasonable risk," according to the Hennepin County Jail website.In July, Ruszczyk called 911 late at night to report a possible sexual assault in an alley near her home. Fewer than 30 minutes later, she was dead from a gunshot wound to the abdomen. One of the two officers who responded to the call shot the unarmed woman.Officer Matthew Harrity told investigators that he drove to the scene and was startled by a "loud sound" near the squad car, according to Minnesota's Bureau of Criminal Apprehension.Immediately afterward, Ruszczyk approached the window on the driver's side, and Noor, Harrity's partner, shot Ruszczyk through the window, Harrity said.Hennepin County Attorney Mike Freeman told reporters on Tuesday afternoon that Noor's actions did not reflect the training he and Harrity received on responding to possible threats to their safety."There is no evidence that Officer Noor encountered a threat, appreciated a threat, investigated a threat or confirmed a threat that justified his decision to use deadly force," Freeman said.The prosecutor said some police officers would not cooperate with the investigation and volunteer information about the incident.Noor's attorney, Tom Plunkett, said Ruszczyk's death "is a tragedy and Officer Noor again personally extends his continued condolences to her family for their loss.""The facts will show that Officer Noor acted as he has been trained and consistent with established departmental policy. Officer Noor should not have been charged with any crime," he said in a statement.Though the officers were wearing body cameras, they did not turn them on before the shooting, and the squad car camera did not capture the incident, investigators said.That lack of video evidence has frustrated city officials and led the Minneapolis Police Department to update its body camera policy to require officers to activate them upon being dispatched.Ruszczyk's death caused outrage in the United States and Australia and led to the resignation of the city's police chief.Though she was a veterinary surgeon in Australia, her native country, Ruszczyk worked as a spiritual healer, yoga and meditation instructor, and life coach in Minnesota.Don Damond, her fiance, said the two had planned to marry later that summer.The Ruszczyk family released a statement, praising the decision to charge Noor, calling it "one step toward justice for this iniquitous act.""We remain hopeful that a strong case will be presented by the prosecutor, backed by verified and detailed forensic evidence, and that this will lead to a conviction," said the statement released through family attorney Robert Bennett."No charges can bring our Justine back. However, justice demands accountability for those responsible for recklessly killing the fellow citizens they are sworn to protect, and today's actions reflect that."The Police Officers Federation of Minneapolis said it could not comment on specifics of the case."We recognize the tragic shooting of Justine (Ruszczyk) Damond has greatly impacted, not only her family and friends, our membership, but also our community. We respect the criminal justice process and wait for the case to proceed before making further comment," the group said.Noor's last day of employment with the force was Tuesday, according to police Chief Medaria Arradondo. A new report from the Government Accountability Office released Thursday criticizes the federal government for sending out .4 billion in stimulus payments to dead people.The independent watchdog report says the Treasury and IRS sent almost 1.1 million payments totaling nearly .4 billion to deceased individuals around the country.“IRS announced that if a payment was issued to a deceased or incarcerated individual, the total amount should be returned,” read the report. “However, the IRS does not currently plan to take additional steps to notify ineligible recipients on how to return payments.”The GAO is an independent investigative agency that reports its findings to CongressThe agency found that the IRS failed to access death records maintained by the Social Security Administration before sending out the payments.“Typically, IRS uses third-party data, such as the death records maintained by the SSA to detect and prevent erroneous and fraudulent tax refund claims,” read the report. “However, Treasury and IRS did not use the death records to stop payments to deceased individuals for the first three batches of payments because of the legal interpretation under which IRS was operating.”J. Tilden, who lives near Indianapolis, was surprised when he got a ,200 paper check in the mail for his mother, Lillian. Lillian’s death certificate shows she died on Jan. 12, 2018 at the age of 73."So I was surprised and immediately thought about how this was potentially something that was a fraud," Tilden said. "I just thought this is crazy. I can't believe I am getting a check for this particular situation when she's been dead and gone for two years."Tilden is not alone."I posted it to Facebook and actually had several people tell me that they knew others who had been in the same situations,” Tilden said. “So I'm thinking this is a problem, not a one-off situation."Anyone who gets a check for someone who died should return the check to the IRS, and write “void” in the endorsement section on the back of the check.“Payment made to someone who died before receipt of the Payment should be returned to the IRS by following the instructions in the Q&A about repayments,” reads the IRS website. “Return the entire Payment unless the Payment was made to joint filers and one spouse had not died before receipt of the Payment, in which case, you only need to return the portion of the Payment made on account of the decedent. A new boarding process is coming to Delta Air Lines.Beginning on January 23, 2019, the airline will ditch zone boarding in favor of a new — and more complex — process based on ticket type and color.Despite the expansion in number of groups from six to eight, Delta said the new format hopes to "encourage fewer customers to line up in the gate area" and ultimately speed up boarding.The Atlanta-based carrier will still begin boarding with passengers that need extra time, followed by premium passengers sitting in its Delta One suites (applicable on select domestic and all international flights) and then its new Premium Select cabin on some international flights or First Class on domestic flights.After that, it gets complicated: The airline used to board the Sky Priority zone — passengers sitting in Comfort+ and Gold and Platinum Medallion members — together.Moving forward, that group will split into two, with Comfort+ passengers boarding first followed by Sky Priority, meaning high-spending members of its frequent flier program will have to wait a little bit longer.Following that, Delta will board economy passengers by announcing Main Cabin 1 though 3, instead of Zone 1 though 4.Fliers that purchase Delta's cheapest tickets will board last in a new group: Zone 4 will now be called Basic Economy. A man who tried to enter a teenage girl's bathroom stall was confronted and killed by the girl's father, officials say. According to Phoenix police, around 11:30 p.m. on August 2, 40-year-old Melvin Harris went to the QuikTrip near Dunlap and 19th avenues to pick up his teenage daughter and her friends. A man, who would later become the victim, approached Harris' car in the parking lot and asked for money. Harris gave him some money, and he went into the QT. Harris was later informed that a man tried to enter the bathroom stall his daughter was using. The teen told an employee, who in turn alerted an on-duty security guard. The man exited the store and was pointed out to Harris, who realized it was the same man he had given money to earlier. Harris went into the store and told the security guard that, "he needed to take care of the situation, or [Harris] would do it himself." The guard reportedly told Harris he would handle it. According to witnesses, Harris later approached the man and punched him in the face. Witnesses also reportedly told police that Harris stood over him, hitting him in the face several more times. He also allegedly kicked and stomped on him. Harris then left the area. Police identified and located Harris at his home nearby. He reportedly told police that the man punched him first, hitting him in the neck. He denied striking the man when he was down. The victim was taken to the hospital with a broken nose and brain injuries. He later died.Harris has been charged with second-degree murder. 1612
