SANTA ANA (CNS) - A man who drove drunk and veered into oncoming traffic while making a turn, slamming head-on into a minivan and killing a mother of three in Lake Forest, was convicted today of second-degree murder.William Joseph Carroll, 51, of Mission Viejo, had a blood-alcohol level of about 0.23 -- nearly three times the legal limit -- when his Ford F- 250 pickup truck slammed into a Toyota Sienna minivan driven by 36-year-old Ana Martinez about 11:40 p.m. May 7, 2013, Deputy District Attorney Daniel Feldman told jurors during the trial.Martinez, who was driving to work at the time, was "crushed to death" in the crash, Feldman said.The prosecutor said Carroll was making a left turn from El Toro Road to Santa Margarita Parkway in Lake Forest when he veered into oncoming traffic.A witness told investigators that Carroll ran a red light, he said. Witnesses "describe Mr. Carroll's truck like a train out of nowhere," Feldman said, adding that the force of the collision was like "100 mph" when combining the speeds of both vehicles.Carroll's attorney, Sara Ross, told jurors it was " a case of government overreach." Ross acknowledged that Carroll was "responsible for the killing of Ana Martinez, but he's not guilty of murder."Both drivers attempted to avoid each other, she said, adding that the intersection is "a bit confusing." "It's a very confusing road and you're going to need that context to determine whether this was a murder," Ross told jurors.Feldman said Carroll was charged with second-degree murder rather than vehicular manslaughter because when he was convicted of DUI on Sept. 11, 2008, he was warned he would be charged with murder in the event of involvement in a DUI-related death.Carroll faces 15 years to life in prison when he is sentenced Jan. 19. 1797

Residents will vote on the matter this November.If the measure is passed, the young people would be able to participate in local elections, which usually don't have high turnout.“They've seen that by extending voting rights to people of that age, they've actually increased the level of interest and attention in local politics, not only in those who are newly able to vote, but among their parents and their communities as well,” said Brandon Klugman, Vote 16 Campaign Manager at Generation Citizen.Critics question if teens are mature enough and educated enough to vote.Researchers in Austria, where the national voting age starts at 16, found teens are not likely to be less educated or less motivated to participate in voting.The campaign Vote 16 USA says teens are not likely to make rushed or stressed decisions when it comes to voting.They say teens are more likely to be in a stable environment, where they're surrounded by family, peers, and educators.“In a stable environment, it's great to establish the habit of voting, whereas at 18 on the other hand, most folks are in some sort of intense transition, whether that's joining the workforce, starting college, moving away from home, or going after some sort of transition,” said Klugman.Advocates say this will help in creating a life-long habit of voting.Oakland, California, is considering a similar measure, but it would only allow young voters to participate in school board elections.Several cities in Massachusetts and Maryland have passed similar measures. SAN FRANCISCO (CNN) - James Schwab, a spokesman for the San Francisco Division of Immigration and Customs Enforcement, has resigned, citing what he says are falsehoods being spread by members of the Trump administration including Attorney General Jeff Sessions."I just couldn't bear the burden -- continuing on as a representative of the agency and charged with upholding integrity, knowing that information was false," he told CNN on Monday.Schwab cited Acting Director Tom Homan and Attorney General Jeff Sessions as being the purveyors of misleading and inaccurate information, following Oakland Mayor Libby Schaaf's controversial decision to warn the community of an upcoming ICE raid.ICE released a press release on February 27 about the operations in Northern California in which Homan stated that "864 criminal aliens and public safety threats remain at large in the community, and I have to believe that some of them were able to elude us thanks to the mayor's irresponsible decision."Sessions also repeated a similar estimate in his remarks while visiting Sacramento last week."Those are 800 wanted criminals that are now at large in that community -- 800 wanted criminals that ICE will now have to pursue with more difficulty in more dangerous situations, all because of one mayor's irresponsible action," Sessions had said.Schwab said he took issue with their characterization."Director Homan and the Attorney General said there were 800 people at large and free to roam because of the actions of the Oakland Mayor," he told CNN. "Personally I think her actions were misguided and not responsible. I think she could have had other options. SAN MIGUEL COUNTY, Colo. -- A husband and wife from Florida were killed in a small plane crash Monday in Colorado, just days after their wedding.According to the San Miguel County Sheriff's Office in Colorado, the victims in the crash were identified as Costas John Sivyllis, 30, and his wife of four days, Lindsey Vogelaar, 33, both of Port Orange, Florida.Deputies said the couple was leaving Colorado to return to Florida in a privately owned Beechcraft Bonanza when it crashed in the Ingram Basin east of Telluride, where they were married Oct. 1.Sivyllis, a United Airlines pilot and flight instructor, and Vogelaar, who also worked in the airline industry, were the only people on board. 701

(AP) — Wells Fargo has agreed to pay at least 5 million to settle a California lawsuit alleging it signed up thousands of auto loan customers for costly car insurance without their consent, resulting in many having their vehicles repossessed.The bank filed the agreement Thursday in a federal court in Santa Ana. It still needs a judge's approval.Another defendant, National General Insurance, agreed to pay .5 million, the New York Post reported.San Francisco-based Wells Fargo confirmed the agreement Friday and called it "an important step in making things right." The bank's statement said that it will be sending checks to affected customers.The 2017 class-action lawsuit alleged that for more than a decade, Wells Fargo tacked on insurance to customers' car loans that they didn't need because they had private insurance.Some 25,000 car owners couldn't meet the additional fees and had their vehicles repossessed, the suit alleged.The bank acknowledged in 2017 that million in unnecessary insurance charges had been added to 800,000 auto loans.It's one in a series of scandals involving the banking giant, starting in 2016 with the uncovering of millions of fake checking accounts its employees opened to meet sales quotas.That led to the resignation of CEO John Stumpf. Last year, the Federal Reserve capped the size of Wells Fargo's assets, and Stumpf's replacement, Tim Sloan stepped down in March. New improprieties had come to light on his watch, including the auto loan issues.Federal regulators who lost patience with Wells Fargo's continued bad behavior inflicted harsh punishments.
