SAN DIEGO (KGTV) – A man was fatally shot by San Diego Police as officers responded to calls of vandalism in the Mountain View neighborhood early Monday morning.According to police, officers were called to the 300 block of South Pardee Street just before 4:30 a.m. after receiving reports of “a violent disturbance involving a weapon.”Residents at the home were woken up by a man they say ripped a metal curtain rod from the window and began breaking windows and other objects.“Fearing for their safety, they asked another resident to call 911. A neighbor also heard the commotion and called 911 reporting it sounded like someone was being tortured,” police said.When officers arrived, police say they gave the man directions in English and Spanish but received no response. According to police, that’s when the man crawled through a broken window before running towards officers with a metal pole.“Fearing for their safety, one officer fired a bean bag round, one officer fired a Taser, and one officer fired several rounds from his service pistol. SAN DIEGO (KGTV) - A man was arrested after the mother of a three-year-old girl called the San Diego Police and said her daughter was kidnapped and inappropriately touched by her neighbor.Police say the ordeal happened just before 10 a.m. Saturday, on Maple Street near Oak Park Elementary School.Two uncles spoke with 10News off camera, saying they heard their cousin "making a fuss" about her window being broken into, the same bedroom where their niece was taking a nap."He snatched her from the window... Three minutes to ten minutes that she was in there," one uncle said.When the girl was back home, the uncles said she seemed upset and reserved. Once she started talking, and the family had an idea of what may have happened, emotions boiled over."My cousin just went in for the shine like the first shot he made him bleed like I think he cracked his nose," he said his sister pulled them apart, and the man ran off.Blood stains were visible on the concrete outside. "Something had to be wrong with him, for him to balls up and come through a window with like ten people in the house," he said. The family knew the neighbor was mentally ill but did not think to this extent.The toddler and her parents then went to the hospital to get "a rape kit, just make sure everything’s fine, and we don’t exactly know what happened to her she saying that she was touched."The incident happened right across the street from Oak Park Elementary School, where students will come back to class August 28th. The San Diego Police Sex Crimes Unit is investigating the incident. 1635

SAN DIEGO (KGTV) -- A man is being investigated on suspicion of DUI after driving into a house in San Diego’s Skyline neighborhood early Sunday morning.According to police, the man was driving his 2002 Mercedes Benz on the 6800 block of Madrone Avenue when he drifted off the road, went down an embankment and slammed into a house.The man received serious facial injuries and was taken to the hospital with non-life threatening injuries, police say.The house had only minor damage. It’s unclear if anyone inside the home was hurt in the crash. 556

SAN DIEGO (KGTV) — A San Diego judge said Thursday that his recent ruling protecting two strip clubs from California's stay-at-home order extends to all county restaurants.San Diego Superior Court Judge Joel R. Wohlfeil said Wednesday that strip clubs and "San Diego County businesses with restaurant service” cannot get a cease-and-desist order. Thursday, he reiterated his ruling, saying that it applies to all restaurants in the county, not just the strip clubs in question. "The court’s intention is that all businesses which provide restaurant service — meaning all restaurants in the County of San Diego — are encompassed in the scope of the court’s order. SAN DIEGO (KGTV) — A judge has issued a temporary restraining order against the City of San Diego, barring them from removing pepper trees in Kensington.The trees are more than 100 years old, planted when the neighborhood was first marketed as a housing development in the early 1910s. While the neighborhood was once filled with them, resident Maggie McCann estimates there are only about 33 left.“I think they are pretty looking,” said McCann. “They’re part of the fabric of the neighborhood.”McCann was one of the residents who filed the TRO against the city. She said she has been working for more than a year to designate the remaining pepper trees as “Heritage Trees” and “Parkway Resource Trees” under the City’s Conserve-a-Tree program.When she heard a pepper tree on the 4500 block of Edgeware Road had been cut down on Monday, she rushed to process the TRO.“We don’t know why these trees are being cut down,” said McCann.McCann suggested it may be related to a plan to bury SDGE utility lines in the neighborhood, but the City of San Diego denies that claim.In a statement to 10News, a city spokesperson said the tree that was cut down Monday had been “evaluated more than a year ago as part of a project to repair a damaged and uneven sidewalk caused by the tree’s growth. Noticeable decay and deteriorating tree structure were also observed during the evaluation and the adjacent property owner was notified at that time.”On Tuesday, the remnants of the trunk remained on Edgeware Rd. Decay could be seen in the interior part of the tree, though much of the large trunk appeared to be healthy.“The tree really didn’t need to be removed,” argued McCann.But the city said their decision was more about damage to the sidewalk than whether the tree could have survived a few more decades.“In this instance, the imperative to make the sidewalk safer for residents was weighed against the city’s desire to preserve neighborhood trees and continue to grow our urban canopy. Due to the tree’s damaging impact to the adjacent sidewalk and its decaying state, the decision was made to remove it in order to preserve public safety,” wrote the city spokesperson.A resident on the block said the sidewalk had been recently replaced. The new pavement had been cut around the tree and was undamaged.Several other pepper trees in Kensington have been marked for removal. On Tuesday, McCann walked the streets, posting copies of the TRO on the trees.The fate of those trees remains unknown.
