(CNN) -- A Michigan lottery winner must share the million windfall with his ex-wife, even though they were in the process of divorcing when he bought the ticket.Richard Zelasko won an million Mega Millions jackpot in July 2013 -- after taxes and fees his prize was ,873,628, according to an opinion issued last week by the Michigan Court of Appeals.The suburban Detroit man and his then-wife, Mary Elizabeth Zelasko, filed for divorce in late 2011. The case had gone to arbitration, and they were waiting for the arbitrator's opinion when Richard Zelasko won the prize.The couple were married in 2004 and have three children.The arbitrator ruled that the ticket was part of the couple's marital assets and awarded million to the wife and divided the rest of their assets, according to the opinion. He said that the "marital property includes all property acquired from the date of marriage until the date of entry of the divorce decree," including property acquired during a separation.The court also cited the arbitrator's opinion that the winning lottery ticket was probably not the first that Richard Zelesko had purchased during the marriage and that "(a)s losses throughout the marriage were incurred jointly, so should winnings be shared jointly."It's true that Zelasko spent to buy the winning ticket; however, "the dollar spent was arguably marital money and, as such, a joint investment," the arbitrator said.The appellate court said it found no errors that would require it to change the award."It's very difficult to overturn an arbitration," said Michael Robbins, who's represented Richard Zelasko since 2015.Robbins told CNN that the couple had been separated since 2009.An attorney for Mary Elizabeth Zelasko told CNN that he would not comment on the case because it is confidential.The couple's divorce was finalized in 2018.Robbins said his client can appeal the ruling and is "considering his options." 1945

YouTube star Brooke Houts is the subject of a police investigation over a video that appears to show her abusing her Doberman.Los Angeles Police Officer Rosario Cervantes said the department's animal cruelty task force is looking into the matter but didn't offer further details.Houts posted the video to her YouTube channel, which has more than 330,000 subscribers. The video has since been taken down, though it's unclear whether that was done by her or by YouTube.However, viewers shared the video on social media, where it drew widespread criticism.In the 50-second video, Houts says she is attempting to prank her dog. Glendon Oakley was shopping for a jersey Saturday when a child came into the El Paso, Texas, store and said there was a shooter at the nearby Walmart.Oakley told CNN no one in the store, including him, paid attention because they didn't understand what the child was talking about. Oakley said he then walked to another store.That's when things went wrong."I just heard two gunshots and a whole bunch of people started running around and screaming," Oakley said.As mayhem erupted over the next five to seven minutes, the armed Oakley planned to go with others who ran out of the store toward the gunshots."But I see a whole bunch of kids running around without their parents. Only thing I think of is pick up as many kids I can as possible," Oakley said.He and another man began corralling children. There were about 13, Oakley said, but he could only carry three."I was just focused on the kids, I wasn't really worried about myself. So just put my head down and just ran as fast as I could," he said. "They were anxious, when they were in my arms, they were trying to jump out of my arms but trying to keep them as tight as possible. "I think that everybody in this world that has been successful has had somebody help them along the way," Kelly said. "I just want to be able to help some people who maybe haven't had that yet." Kelly's attentiveness toward his students is one of the reasons eighth-grader Olivia Toledo wanted to recognize him for his hard work. "When I need help, I know that I can go to him, and he will help me until I get it," Toledo said." He keeps us engaged by telling us to just keep going and never give up."
