SAN DIEGO (KGTV) - The family of a YouTube star who drove his McLaren the wrong way on the 805 last year, killing a mom and her daughter, are suing the City of San Diego, County of San Diego, and the Psychiatric Emergency Response Team (PERT).The lawsuit claims the “horrific and tragic event” was entirely preventable.Eighteen-year-old Trevor Heitmann, known as McSkillet, drove his McLaren the wrong way on the freeway in August 2018, killing Aileen Pizarro and her 12-year-old daughter Aryana. The sports car collided with the family's SUV, which burst into flames.RELATED: Autopsy details mental state of McSkillet before deadly crash on Interstate 805 in San DiegoIn the lawsuit Heitmann's family claims "SDPD was warned by Plaintiff's on the day of, but before his death, that Trevor intended to drive his McLaren at a high rate of speed in the wrong direction on a public roadway, under the delusion that he (Trevor) could drive through vehicles traveling in the opposite direction without incident."Worried about their sons' dangerous intentions and fearing for his well-being, as well as the safety of others, Dr. Mary Rusher, a board-certified psychiatrist, called 911 and made a 5150 request for a psychiatric hold, the lawsuit alleges.The lawsuit claims, "Defendants' purported PERT response team conducted either or both no assessment or the wrong assessment of the mental health status of Plaintiffs' son Trevor, pursuant to and under California Welfare and Institutions Code 5150."RELATED: YouTuber's parents requested psychiatric evaluation before deadly I-805 crashIt alleges, defendants also failed and refused requests to take Heitmann into protective detention to transport him to a designated evaluation and treatment facility."As a consequence, and despite Plaintiffs' attempts to ensure their son's safety and the safety of others by blocking the driveway of their residents, Trevor later that day left his residence and drive the McLaren to the Interstate 805 Freeway where he was killed in the beforementioned collision, which also tragically took the lives of the Pizarros."A spokesman for the County of San Diego told 10News they couldn't comment.RELATED: Son remembers mother and sister after release of driver's autopsy in deadly 805 crashAs of this writing, officials with the City of San Diego and PERT have not responded to 10News requests for comment.This is the third lawsuit filed regarding the 2018 crash. SAN DIEGO (KGTV) — The helicopter pilot who died when his aircraft crashed in Central California while fighting a wildfire on Wednesday was a former ABC 10News pilot.Michael John Fournier, 52, of Rancho Cucamonga, died when his Bell UH-1H helicopter crashed during a water-dropping mission about 10 miles south of Coalinga, Calif. Fournier was the only person on board, according to the Fresno County Sheriff’s Office (FSO).Investigators were called out to the scene at about 11 a.m., but were not able to make it to the crash site until about 8 p.m. due to the rugged terrain and intense conditions. Once they reached the site, FSO said crews draped an American flag over Fournier's body and carried his body out of the site."One, he was on the front lines helping in an emergency. Two, we did not know if he was former military or law enforcement. We felt it was just the appropriate thing to do," FSO wrote on Facebook.Fournier leaves behind a wife and two daughters. A GoFundMe has been posted here to assist his family with expenses.Fournier was working with Fillmore-based Guardian Helicopters at the time of the crash, according to the Associated Press. Recently, he had flown as part of repair work for Southern California Edison. In the mid to late 1990s, Fournier was a contracted backup pilot for ABC 10News in San Diego for about two years, said Kyle Anastasio. He’s known Fournier for nearly 28 years. He says Fournier was trying to break into the flying industry when they met.Anastasio was the primary Sky10 pilot and taught Fournier how to fly the news chopper.“He was a good pilot,” Anastasio said. “That’s why it’s so devastating.”Anastasio says Fournier went on to have a great career in flying.“He took this whole flying helicopters thing to the moon with all the companies he went to, flew utility work and medevac. He was very well known in the industry,” Anastasio said.He said Fournier loved two things in life: his family and flying.“Mike was a rock-solid individual, a lot of people are missing him right now,” Anastasio said.Timothy Gaughen, a former ABC 10News photojournalist, said working beside Fournier was one of the high points in his career."Fast, efficient, fun, it was always great. It was always enjoyable," Gaughen said. "There's certain people you remember from your career. I still remember it as if it was yesterday ... Just a pleasant, pleasant personality."Gaughen said when it was time to get in the air, Fournier was an absolute professional."He was just a down to Earth person ... but when it was time to get the shot, boom, we were a two-man team," Gaughen said.San Diego is no stranger to wildfires and Fournier worked his share of capturing images from above while at ABC 10News, Gaughen says. He adds that Fournier was a safety-conscious man who loved what he did. "There's something in helicopter pilots, they live and breathe being in the air. He died doing what he loved. SAN DIEGO (KGTV) — The Centers for Disease Control and Prevention announced Thursday it is extending a ban on cruise ships operating in U.S. territory through September.The ban was set to end next week, but the agency extended the ban as coronavirus cases rise in 40 states.Florida and California, where many cruises originate or end, both set records for new daily COVID-19 cases recently.RELATED: As cruise ships idle, San Diego region lost up to millionThe CDC says the ban on cruise ship operations will be in effect until, "the expiration of the Secretary of Health and Human Services’ declaration that COVID-19 constitutes a public health emergency," "the CDC Director rescinds or modifies the order based on specific public health or other considerations," or Sept. 30.Some cruise lines had already canceled scheduled sailings until Sept. 15 over ongoing discussions with federal officials on how to restart business safely, the Associated Press reported.The Port of San Diego estimates that each cruise ship that visits San Diego generates about 0,000 in regional economic impact, including local shopping, restaurant businesses, and other expenses.Nearly 30 cruises were canceled due to the pandemic, costing about million in lost revenue for the Port of San Diego alone, according to Brianne Page, a public information officer for the Port of San Diego. SAN DIEGO (KGTV) — The Camp Pendleton Marine accused of trying to smuggle migrants through the San Ysidro Port of Entry this month has been identified.Bryan Oneal Newell Jr. was arrested Dec. 2 by U.S. Customs and Border Protection personnel at the San Ysidro Port of Entry, according to Camp Pendleton. Newell is accused of trying to bring undocumented immigrants into the U.S.Newell, a junior-enlisted Marine, was being held in civilian custody while CBP and the Naval Criminal Investigative Service investigated.RELATED: Marine accused of trying to smuggle immigrants through San Ysidro Port of EntryCamp Pendleton said Newell was not part of military personnel sent to the border to assist personnel with border operations.Newell is the most recent Marine from Camp Pendleton to be charged in an immigration scandal. In July, 23 Marines were detained over human trafficking, drug distribution, and weapons charges, according to the base.Of those 1st Marine Division Marines, six have pleaded guilty at court martial appearances while 13 have approved agreements to leave the Marines rather than go through court martials or waiving separation board processes.
