BRUNSWICK, Ga. (AP) — A Georgia judge has denied bond for the white father and son charged with murder in the February slaying of Ahmaud Arbery.Superior Court Judge Timothy Walmsley said Friday that he's concerned Gregory McMichael and his adult son, Travis McMichael, took the law into their own hands and endangered neighbors when they pursued the 25-year-old Black man with guns and shot him in a residential street in February.Defense attorneys say the McMichaels had reason to suspect Arbery was a burglar and Travis McMichael was defending himself when he shot Arbery in the port city of Brunswick.During a hearing Thursday, prosecutors said Travis McMichael had previously used racial slurs in text messages and on social media.Prosecutors asked the suspect’s friend, Zachary Langford, on the witness stand about a text in which McMichael used a slur for Black people. At first, he said he didn’t recall receiving the message, but after reviewing a transcript of the exchange, he said “He was referring to a raccoon, I believe,” The Associated Press reports.Attorneys for the McMichaels have died any racist motives in the shooting.The McMichaels were not arrested until May, when the Georgia Bureau of Investigation stepped and charged them with murder and aggravated assault.There was mounting public pressure for justice in the case after video was released of the deadly incident. The case gained attention nationwide during the summer’s protests over racial injustice.The man who filmed the video, William Bryan, was also later arrested and charged with murder and criminal attempt to commit false imprisonment, according to The New York Times.In June, The Times says a grand jury returned an indictment with nine counts against all three men. Those charges include malice murder, four counts of felony murder, two counts of aggravated assault, false imprisonment and criminal attempt to commit false imprisonment. 1934

BARNEGAT LIGHTHOUSE STATE PARK, N.J. — A dead whale is sitting on a New Jersey state park beach after a Christmas storm blew through the northeast.The humpback whale is near Barnegat Lighthouse State Park in Ocean County. It is unclear at this time how the roughly 20-foot-long whale died, according to the Marine Mammal Stranding Center, a marine animal focused organization that responded to the whale Saturday. They said it could have been hit by a boat or something else during the storm, or died from contracting a disease. In addition to coming ashore on a holiday weekend, when few state employees are working, the below-freezing temperatures are also delaying the whale’s removal.“The whale’s too frozen,” Bob Schoelkopf, the director of the Marine Mammal Stranding Center said. “We can’t even cut into the blubber, it’s too thick and frozen.”Schoelkopf believes the dead whale was washed ashore on Christmas Eve, then taken back out to sea on Christmas as a large storm came through, and then came back ashore Saturday.Anyone visiting the area should stay clear, Schoelkopf said, because of the possibility for diseases to be in the carcass.Whale watching boats had spotted the whale alive earlier this year in Sandy Hook bay, where it had been photographed feeding, Schoelkopf said.In September, a different humpback whale was found dead off the Jersey Shore after being entangled. Another dead humpback whale was found floating off Cape May in November.The National Oceanic and Atmospheric Administration declared an “unusual mortality event” for humpback whales in 2017, after high numbers of whales were found dead from Maine to North Carolina. BOSTON (AP) — A federal appeals court has upheld a district court decision clearing Harvard University of intentional discrimination against Asian American applicants. Two judges on the 1st U.S. Circuit Court of Appeals in Boston rejected claims from an anti-affirmative action group that accuses the Ivy League university of imposing a "racial penalty" on Asian Americans. The decision delivers a blow to the group, Students for Fair Admissions, and moves the case a step closer to a possible review by the U.S. Supreme Court. The group's 2014 lawsuit alleges that Harvard's admissions officers use a subjective "personal rating" to discriminate against Asian Americans who apply to the school. Harvard denies any discrimination.According to the Associated Press, the judges concluded that Harvard does not place outsized emphasis on race. 848

  

Breonna Taylor's mother, Tamika Palmer, requested a new special prosecutor to review her daughter's case. During a meeting Friday, the Kentucky Prosecutors Advisory Council voted not to approve her request.Tamika Palmer and her attorneys argue Kentucky Attorney General Daniel Cameron did not accurately explain the law to the grand jurors, present evidence correctly, and perform the job bias-free.Which leads to their request of having a new prosecutor appointed to Breonna Taylor's case.While the Kentucky Prosecutors Advisory Council can replace a local prosecutor with the attorney general, the council noted they do not have the legal authority to replace the attorney general."No basis in case law or statute exists for the prosecutor advisory council to appoint a new, independent prosecutor as requested by Ms. Palmer," Chris Cohron, the Commonwealth's Attorney for the Eighth Judicial Circuit in Bowling Green.The council voted unanimously. As soon as the council made its decision, the people watching the virtual meeting spoke out, with one person saying, "You're wrong, and you know it."That's the end of the legal road for Breonna Taylor's family regarding state or criminal penalties.
