The question at hand: Where should a 7,000-pound elephant live?The legal issue pits an elephant sanctuary in Hohenwald, Tenn. against the woman who raised Tarra the elephant since she was a baby.The case went to trial just this week and ended with a hung jury, so the fate of Tarra -- perhaps the best known of the Sanctuary's elephants -- remains in limbo.Tarra is an Asian elephant. Many remember the story from a decade ago of Tarra and her loyal canine companion, Bella. She was the first elephant at the Sanctuary in Hohenwald, brought there by co-founder Carol Buckley in 1995.Years earlier, Buckley took ownership of Tarra from a businessman in California."It was an instantaneous attraction to each other. She needed a mother. She was a baby, and I was happy to fill that role," Buckley said.This led to Buckley starting the sanctuary, but after several years, Buckley was ousted. She left Tarra there knowing it was the best place for her at the time.Now, Buckley operates a new sanctuary in Georgia. She said she never surrendered Tarra, has worried about her welfare in Hohenwald, and is suing to get her back."The lawsuit is very simple. It says I own Tarra," said Buckley.Legal expert Jim Todd said this is the first-of-its-type case in Tennessee.Todd said there's the custody issue, but he added there's also the question of whether Buckley abandoned Tarra.She said no and added her concern has always been what's best for the elephant."I'm going to put her wherever it is best. If Georgia is better for her, I would move her to Georgia," Buckley said. "If Tennessee is better, I would leave her in Tennessee."The two-day trial this week in Lewis County ended with a hung jury. Ten jurors voted to return Tarra to Buckley with two others saying no. A retrial likely won't happen until 2019.Asian elephants typically have a lifespan of 48 years. Tarra is 44 years old.The Elephant Sanctuary issued the following statement saying in part, "We remain fully committed and exist to provide home, herd and individualized lifetime care to all residents of the Sanctuary, as we have done for the past 23 years." 2211

A longtime Fox News analyst sharply criticized the network on Tuesday, denouncing the outlet as a "propaganda machine" devoted to President Trump, and saying that it was "wittingly harming our system of government for profit," in a stunning internal email announcing his exit from the company.Ralph Peters, a US Army lieutenant colonel who served as a military analyst for Fox News, said he felt "compelled to explain" his departure from the company to colleagues, before skewering the network he has called home for years. Peters had been telling friends that he planned on leaving the network in a "nuclear" fashion, one of those friends told CNN."Four decades ago, I took an oath as a newly commissioned officer. I swore to 'support and defend the Constitution,' and that oath did not expire when I took off my uniform," Peters wrote in the letter sent to a handful of colleagues. "Today, I feel that Fox News is assaulting our constitutional order and the rule of law, while fostering corrosive and unjustified paranoia among viewers. Over my decade with Fox, I long was proud of the association. A federal prosecutor who was helping lead the investigation into the origins of the Trump-Russia probe has resigned from the Justice Department. Nora Dannehy was a top prosecutor on a team led by U.S. Attorney John Durham of Connecticut, who was appointed last year to lead an investigation into how the FBI and other federal agencies set out to investigate Russian interference in the 2016 presidential election and whether the Trump campaign had coordinated with the Kremlin. A body found in Costa Rica has been identified as a Florida woman who went missing while she was on vacation, according to her family. The father and brother of Carla Stefaniak identified the body as the 36-year-old Tuesday night.During an exclusive interview with ABC Action News, Stefaniak's father, Carlos, said his heart shattered when he saw her body.Costa Rica's Judicial Investigation Agency (OIJ) said an autopsy performed on her body showed that she had stab wounds around the neck and extremities and blunt-force trauma to the head.Family friend, Greg Zwolinsky, who is with them in Costa Rica, said he wants everyone to remember Stefaniak based on the radiance of her personality that is portrayed in pictures of her smiling.On Monday, a spokesperson for the OIJ confirmed that remains were found. The body was found in a wooded area as investigators combed through the region, roughly 1,000 feet away from where Miami resident and Tampa native, Carla Stefaniak, spent what was supposed to be her final night in Costa Rica last week, Judicial Investigator Director Walter Espinoza said in a press conference. On Monday night around 11 p.m., OIJ officials detained a security guard at the apartment complex, 32-year-old Bismarck Espinoza Martínez. Martínez has been in Costa Rica since June 2018.After Stefaniak was reported missing, agents began to investigate where she was last seen. Officials say that Martínez had the time and space to commit this crime and became a suspect because of the investigation. Specifically, his statements did not match video surveillance in and around the area at that time.In addition, fluids found in the apartment where Stefaniak was staying have the consistency of blood, OIJ officials said.Stefaniak traveled to Costa Rica to celebrate her 36th birthday, according to the family. She left for Costa Rica on Thanksgiving Day but had not been heard from since Tuesday, her brother, Carlos Caicedo, told ABC Action News.Meanwhile, the lawyer representing the complex that houses the Airbnb told ABC Action News they were "deeply saddened and devastated by the tragic events that occurred last week" and said that the owners were cooperating with authorities. He said the rental had been temporarily closed while officials conduct the investigation. The lawyer released the following statement:"Since 2013, Villa Le Mas has operated a small vacation rental facility located at San Antonio, Escazu, Costa Rica. We have received over a thousand guests with wonderful reviews about the property and our service.We are deeply saddened and devastated by the tragic events that occurred last week. The owners are fully cooperating with the authorities in the investigation and we hope that once the facts are determined, the perpetrator is brought to justice.Our deepest sympathies are with the family of the victim of this horrible crime.While the investigation is ongoing, and since the focus of the owners is the comfort of our guests, the facility has been temporarily closed."Now that Stefaniak has been identified by her family, they say they will continue to press Costa Rican officials for more information on who killed her.  3301
