"They took time out of their day to cut my grass and they didn't have to do that.""We didn't have to do it. We didn't do it to get recognition by any means, but we wanted to bless her and bless her family. Her grass was high and we wanted to help her," Fire Captain Kris Gumpert said.However, Louviere says she did not know the job was finished until she saw it on Facebook."I'm working from home currently, so I didn't walk outside this morning. (KGTV) — Defense attorneys for 15 Marines accused of human smuggling said they hope the judge dismisses the case.The attorneys argued that the Commander illegally used his power to discipline the Marines publicly, and therefore influenced the outcome of the case.It was a very public display of discipline.Fifteen Camp Pendleton Marines were cuffed and taken away by NCIS agents in front of an 800-person battalion formation in July. They were accused of human smuggling and conspiracy.But now, attorneys representing a few of the accused Marines said the public arrests violated their rights. Now, they are filing what's called an "undue command influence" motion against the Battalion Commander who led the formation."Anytime you have a Commander who is in a position of leadership who potentially affects a subordinate's rights to a fair trial, that can be viewed as potential 'undue command influence,'" military attorney Gary Barthel explained. "This motion for 'undue command influence' was made against the Battalion Commander for making comments and parading the 15 individuals out for what was supposed to be a recognition, and they were ultimately arrested." Barthel is a former legal advisor to Camp Pendleton's Commanding General. He said a Commanding Officer's job is to maintain good order and discipline their command. But in military law, they also wear the prosecutor and jury selector hats."Those two hats can clash," Barthel said. "That's why it's important for Commanding Officers to be careful what they say with regard to their views of the military justice system, or their views of a particular individual who has been accused of an offense."The defense team said the Commander used his power to influence the outcome of the case unfairly. But Barthel said in his experience with 'undue command influence' cases, he believes the military has likely already taken the Commander in question off the case."You can take the individual that allegedly made the statements involved out of the process, and that keeps the process fair and impartial," Barthel said. OCEANSIDE, Calif., (KGTV) -- While many of San Diego County's beaches and parks are now off-limits due to the Coronavirus, Oceanside remains open. But some residents fear that a beach and golf course soft-closures only encourage people to ignore the stay-at-home order. Unlike the taped up beaches in San Diego, Del Mar, Solana Beach, and Encinitas, Thursday evening, Oceanside decided on a soft-closure. The parking lots, Pier, picnic areas, and playgrounds are closed. But the beaches remain open. "We figured, as long as we can encourage people and enforce that social distancing, we would be able to keep those recreational opportunities available," Samuel Liston with the City of Oceanside said. One person taking advantage of Oceanside's open beach was surfer, Oliver Dillard of Bay Park. Earlier, he was at Pacific Beach but was told by a police officer to leave."I'm just in the moment. Being here now," Dillard said. But not everyone is thrilled. "My reaction to them keeping open the beaches in even a soft way is horror," Oceanside resident, Frances Pope said. Pope suffers from a rare Autoimmune Disorder. She lives in a senior community in Oceanside. She says if her local beach is the only one that is open, people will flock to it, and you can forget about social distancing. "We're going to have a swarm of people, and it's not just Oceanside that is going to be hit by that," Pope said. "They're going to go back to their homes, inland or down south, and they will infect their families."It is not only beaches. Oceanside's City-run golf courses are also one of the last ones to remain open. According to the Pro-shop, golfers must walk on the course. No golf carts will be rented unless a person has a disability placard from the DMV.Still, Pope says this "halfway measure" is not enough. She wants everyone to take the virus seriously and stay home. OMAHA, Neb.  - The DEA is warning police and parents to be on the lookout for marijuana and methamphetamine laced candy this Halloween.The DEA and police agencies throughout the country have seen an increase of seizures of drug-laced edibles, including but not limited to chocolates, suckers and gummies. The DEA's Omaha Division has not identified any specific threats but issued an advisory.The items are often professionally packaged and can easily be mistaken for regular candy or baked goods. Last year the DEA found marijuana-laced candies sold in packages labeled; Munchy Way, 3 Rastateers, Twixed, Keef Kat and Rasta Reese's; had been collected during Halloween.Signs of marijuana or meth-laced candy include unusual wrapping, appearance, unusual colors, odd smell, misspelled candy labels, or candy or food that is unwrapped or unmarked.Parents and caregivers should seek immediate medical attention if a child ingests drug-laced candy and then contact local police. 988
