A prayer rally was held over the weekend for a 33-year-old man who died after being arrested by sheriff’s deputies in a Southern California grocery store. The man, Ernie Serrano, was at the store last Tuesday night in line to pay for his items. Sheriff’s deputies say when they arrived at the store, they saw Serrano tussling with a security guard and attempting to take the guard’s gun, according to a department press release.“While detaining Serrano, he continued fighting with the deputies and did not comply with their commands. At that time, a use of force occurred,” Sgt. Lionel Murphy with the Riverside County Sheriff’s Department states in the release.Serrano was arrested on suspicion of assault with a deadly weapon. Deputies say Serrano then stopped breathing. "Medical personnel on scene rendered aid and was able to obtain a pulse. Serrano was transported to a local hospital for medical treatment. While at the hospital, Serrano’s condition deteriorated, and he was later pronounced deceased," the department states. Serrano’s family disagrees on what happened in the store, and point to video shared on social media from a witness showing a deputy walk up to Serrano and beat him a few times with a baton before another deputy tackles him.The department said the use of force in Serrano’s arrest is under investigation at this time. The family is raising money for Serrano’s memorial services.Warning: the video may be difficult to watch and the post contains strong language. 1499

A University of Utah track athlete was shot dead on the campus Monday night by a man she reportedly had dated and complained to police about, authorities said.University police found Lauren McCluskey's body in the back seat of a car on campus after her worried mother called police, according to university Police Chief Dale Brophy. McCluskey, 21, apparently had a dispute with the man, identified as Melvin Rowland, 37, university Police Lt. Brian Wahlin said. The shooting led police to lock down the campus for hours while they searched for the suspect. Brophy said someone picked the suspect up from campus after the shooting.Early Tuesday, Salt Lake City Police saw Rowland in downtown Salt Lake City and briefly chased him, Brophy said. Brown said Rowland slipped in to the back door of a church, where he was later found dead from a self-inflicted gunshot."This isn't right," Mark Harlan, the school's athletic director, said Tuesday of the death of McCluskey, a Pullman, Washington, native. 1005

A New York appeals court has denied a motion by President Donald Trump's attorney to stay the Summer Zervos defamation case pending appeal, meaning the gathering of evidence known as "discovery" can move forward as both parties await a ruling on the appeal.Zervos, a former "Apprentice" contestant, filed a lawsuit against Trump in January 2017 in which she alleged that Trump defamed her in 2016 after she said he sexually assaulted her in 2007.Trump's lawyer, Marc Kasowitz, is appealing the March 20 ruling by New York Supreme Court Justice Jennifer Schecter, who allowed the case to go forward. He wants the appellate court to revisit the matter of whether the Constitution's Supremacy Clause bars a state court from hearing an action against a sitting president -- what would be considered immunity, because it would make the President immune from suit. Schecter ruled it does not. Kasowitz also argues that Schecter erred in denying the President's motion to dismiss or delay the case on First Amendment grounds.Kasowitz said his motion should be granted on the grounds that New York and federal law both mandate a stay pending appeal, that proceeding with the case could irreparably harm Trump, and that the temporary suspension being sought was not designed to delay the case. But the Appellate Division of the New York Supreme Court denied his motion in a one-page ruling."We look forward to proving Ms. Zervos's claim that defendant lied when he maliciously attacked her for reporting his sexually abusive behavior," said Zervos' attorney, Mariann Meier Wang. Kasowitz did not immediately respond to a request for comment on the ruling.Earlier this month, Zervos' team issued subpoenas to Metro-Goldwyn-Mayer and the Beverly Hills Hotel as part of their effort to prove that Trump lied "when he falsely denigrated Ms. Zervos and denied sexually assaulting her," Wang said. She set a May 31 deadline for both companies to comply with the subpoena for the material requested.MGM owns the archives of "The Apprentice" and Wang wants the company to hand over all documents, video or audio that feature Zervos or Trump talking about Zervos and any recording in which Trump speaks of women in a sexual or inappropriate manner. Wang also wants to depose an MGM representative to inquire about how recordings of "The Apprentice" are stored and maintained, who has access to them, and when, if ever, they were transferred or destroyed. The subpoena asks for "(a)ll video and audio recordings that include Donald J. Trump talking or commenting on the female candidates or female potential candidates of any season of The Apprentice in any sexual or inappropriate manner, including without limitation any statements or comments by Donald J. Trump concerning any female candidate's or potential candidate's body or body parts and/or his sexual or romantic desire or intention concerning any female candidate or potential candidate."Wang also wants records from the Beverly Hills Hotel of any stay by Trump from 2005 through 2009 and documents related to his longtime bodyguard Keith Schiller, his longtime assistant Rhona Graff or Zervos and for "(a)ll video recordings that depict the entrances, common areas, or bungalow areas of the Beverly Hills Hotel during the month of December 2007."The-CNN-Wire 3308

A Texas pastor says he will now carry a handgun when he preaches behind the pulpit."This was not supposed to happen," Pastor Jaime Chapa of El Faro Bible Church in Sullivan City, Texas said, reacting to news updates of a shooting that took the lives of 26 people at First Baptist Church in Sutherland Springs, Texas."There will be three armed (licensed) persons at all times at every service," he said of his own church services. "Nobody needs to know who they are, but, our church will be protected." RELATED: History of violent behavior a factor in gun violence, psychiatrist says 620

A student at Island Park High School in Florida was suspended after the principal and other staff members saw him imitating a gun with his hands and pretending to shoot in a classroom. This happened Friday. "You shouldn't be doing something like that at all," former Island Park High School student Devan Hinton said."It's just not something to be taken lightly," Sam Sherman, who lives in Fort Myers, told Scripps station WFTX in Fort Myers, Florida. The principal called the Lee County Sheriff's Office to file an incident report after he saw the student "imitating a rifle with his hands and pointing it to the classroom."Another staff member described the student making "a gesture with his arm simulating as if he was firing a weapon into the classroom."A third staff member said the student "stood in the classroom doorway and made a machine gun style pose with his arms pretending to shoot at the classroom.""That isn't OK. With everything going on, that's not something to joke about. That's lives in someone's hands," Hinton said. The principal said he didn't think the student was serious but will not tolerate this behavior in school, so he suspended him. It's an action Sherman said he agrees with for the safety of the students."It's better to be preventative than wait and let it go on, and God forbid something else occur," he said. The principal of Island Park High School, Arthur Nauss, sent WFTX this statement:"I took the disciplinary action of sending the student home after I observed him pointing his finger at another student imitating that he was shooting a gun. The student pointing the finger and the student he was pointing at know each one another and were laughing at one another. There was no threat being issued but I believe it necessary to make it clear to the student, and all our students, that this is unacceptable behavior considering the recent events here in Florida. I called the student’s mother to inform her of what had occurred and let her know I would be working with the student in the future to ensure this behavior does not reoccur. When the student returns to school he will be informed that any future actions such as this one will result in a suspension or expulsion from school. I will also let him know that actions like this in the future will be reported to the appropriate authorities." 2379
