FALLBROOK (KGTV) -- A couple looking to buy a home in the North County wants to share an experience they're describing as negative as the new solar energy law goes into effect in 2020.The law requires that homes built in California starting in 2020 must have solar panels. It has caused confusion among potential homebuyers, like Brian and Carmen McKay. They recently left Las Vegas, looking to move back to San Diego County.“I used to work at Fallbrook skilled nursing many years ago,” said Carmen McKay. The couple found a home they liked in the Horse Creek Ridge development, a new housing project in Fallbrook.“When we realized it was a corner lot… oh my gosh, we loved it,” Carmen said.They were told the cost was roughly 5,000—which sounded like a reasonable price for San Diego, according to the McKays. That is when they say they got a surprise from the sales representative.“Then she says, by the way, once we were sold on the house and the price… there’s solar panels on the house. You have the option to lease it or buy it. And we’re like, why?” Carmen said.They said during the home tour, solar panels were not mentioned at all. Carmen said the sales representative only mentioned it when they were back in the office, ready to sign documents to buy the home. As the McKays were questioning solar, they were told “it’s required by the state.” That is only partially true. A spokesperson for the California Energy Commission told Team 10 that “the law only applies to homes that have been permitted after Jan. 1, 2020.”“If that’s not the case with the home in question that you mentioned, then the mandate does not apply,” wrote energy commission spokesperson Edward Ortiz.The McKays were told it would be about ,000 extra to buy the solar panels.“I think that it was misleading because we were buying a house that we were told it was 5, but it’s actually 5 or we’re paying a higher monthly out of pocket,” said Brian McKay.The seller knew they were on a time crunch.“We sold our property [in Nevada]. We’re at an AirBnB… we need to buy,” Carmen added.Nobody at the sales offices at Horse Creek Ridge would comment. Team 10 was directed to public relations. Horton in its decisions regarding home design options in the state of California – the current State Energy Code requirements (commonly known as Title 24) and the State‐Mandated Solar requirements, which take effect in 2020. In most communities, we have found that solar is the best, most cost‐effective option for both D.R. Horton and our homebuyers to meet the current Title 24 Energy Code requirements. Thus, Horse Creek Ridge was designed using solar to meet the current Title 24 requirements, and as a result, we are required by the state to have solar on each home in the community.”When asked why that was not told to the potential homebuyers from the beginning, during the tour of the home, D.R. Horton spokesperson added that “solar requirements are communicated to customers via numerous marketing materials… and as an addendum to the home purchase agreement.” She pointed to an 8-page brochure, where solar is mentioned once on page 7. She also sent Team 10 an image of solar displayed on a model home—something the McKays said they never saw.There is no mention of solar or photos of any homes with solar on Horse Creek Ridge’s website. “I feel like I was deceived,” Carmen said. “We fell in love with the place. I felt like I was pushed in the corner.”Dan Zimberoff is an attorney not involved in this case, but he has seen solar disputes in the past. “A buyer needs to be aware,” Zimberoff said. “If you’re purchasing a new home and you see what that price is, ask the details. Is that really going to be the final price?” “We’re starting to remember why we left California,” Carmen said.The McKays ultimately decided not to buy the home. They hope their experience teaches others about the right questions to ask. “We were willing to pay the higher cost to live here, but I don't like being misled by builders,” Brian said. (KGTV) - A retired Escondido homeowner is figuring out how she'll pay for Thanksgiving dinner after everything she bought for the holiday was spoiled during a power outage.On a fixed income, Carol Marbrey purchased the meal at the beginning of the month.“I was never warned that my electric would be turned off, and then I was told it would be on by 7:30 AM, then I was told it would be on by noon, and this is all online, and then I was told it would five at night.”Marbrey came home that night to a dark house; power wasn't restored until the next day.The outage happened earlier this week during the extreme wind conditions and Red Flag Warning countywide.San Diego Gas & Electric says some customers weren't warned because it was a fluid situation, with weather conditions changing by the hour.  A spokesperson tells 10News after power is shut off, technicians must inspect hundreds of miles of lines before turning them back on.Marbrey says she called the company several times to understand the situation.“I was getting different answers as to why our electric was not going on," said Marbrey.An SDG&E spokesperson tells 10News they encountered an issue trying to re-energize Marbrey's circuit, by then it was getting dark, and they had to wait until the following day.Marbrey says she understands the necessity to keep the community safe but wishes she’d been better informed.She knows her situation could be a lot worse.“Our hearts really go out to those people that really suffered; we really respect the fire department, the electrical people that are on the ground, the maintenance people, everyone that's doing their best to keep us safe.”Marbrey estimates they lost 0 to 0 in spoiled food. (KGTV) - A baby python caught on video being snatched from a reptile store in Escondido has been recovered.Late Wednesday afternoon, police told 10news a break in case led them to a home in Escondido, where a woman spotted in surveillance video admitted to taking the snake and turned it over. The theft took place at LLL Reptile last Friday afternoon."Just shocking because of the way she did it," said District Mangaer Joe Alvarez.Video shows her walking around the reptile shop for about ten minutes, before something catches her eye. On the video, she's seen staring down an employee before she appears to slide open the top of a tank and grab something. Another camera shows her walking right past the checkout counter. From the final camera angle, a yellow snake is seen squirming in her purse."Looks like the snake is making one last ditch effort to get away, you see her literally grab the snake and put it in her purse before she walks out," said Alvarez.That snake is a baby yellow-colored, green tree python, about ten inches long. "A lot of guys pour their heart and soul into caring for these animals, and someone comes and just rips it out. It hurts," said Alvarez.Alvarez was concerned about the snake's welfare, because it requires high heat and humidity. The conditions are more important because of his young age, about three months old. Those worries dissipated when police stopped by the shop on Wednesday, snake in hand. Employees tell 10news the staff was "over the moon excited." Police tell 10news the woman was wanted on 5 outstanding warrants, including at least one drug-related warrant. (KGTV) - Escondido restaurant owners made the decision to stay open for indoor and outdoor dining after a court ruled Friday evening they must be take out only.On Grand Avenue, it looked like a time warp. People were back under tents and umbrellas eating and drinking on the patio and some indoors.At Tony Pepperoni Pizzeria, the sign in the window blinked "Open.""The restaurant business isn't something you can say hey close, open, close," Tony Pepperony Pizzeria Owner Joe Locricchio said.That's exactly what he's been dealing with for the last 10 months."We have livelihoods on the line... I have single mothers okay, they need to buy diapers. I have guys that haven't had a job and they're walking out of here with money every night in tips." Locricchio said his 80+ employees are like family.Staying open hasn't come without challenges.He said he was criminally cited by Alcoholic Beverage Control and issued a cease-and-desist order by the City of Escondido.His restaurant on Grand Avenue just opened 17 days ago.When asked what he had to say to critics who think he should close and are worried about the coronavirus killing San Diegans, he said, "listen, my heart goes out to everybody that's passed away, one death is too many. To those critics who have something to say about my decision, listen I respect their decision. I respect that they have the choice to not have to come here they don't have to support me, all I ask is to support my decision."He said strangers have yelled and ranted to him about his decision.He said what is more compelling, is how the community has shown their support, "it's been an overwhelming response. It makes my hair stand up, I'm going to be honest with you, the community has been unbelievable."Other restaurants are staying open too and Locricchio encourages more to follow their lead.This while hospitalizations continue to soar and health officials say it's safest to stay home.Locricchio said the choice is yours.He said the criminal citation means he could have his Liquor License temporarily taken away.
