(AP) — Prosecutors added criminal charges involving five additional victims Wednesday in the case of a California surgeon and his girlfriend who were previously charged with drugging and sexually assaulting two women.The Orange County district attorney's office said the additional charges include kidnapping and rape by use of drugs.The new charges accuse Dr. Grant Robicheaux of sexually assaulting five additional women. His girlfriend, Cerissa Riley, is now charged in three additional assaults. Details were not immediately released.Robicheaux, 38, and Riley, 31, appeared in court and pleaded not guilty to all counts. Kaplan came after the Justice Department argued that the U.S. and by extension American taxpayers should replace Trump as the defendant in the lawsuit filed by E. Jean Carroll.The judge ruled that Trump's public denials of the rape allegation came outside the scope of his employment as president.The Washington Post obtained Kaplan’s 59-page ruling, which said Trump didn’t qualify as a federal “employee” and that he wasn’t acting “within the scope of his employment” when he denied Carroll’s rape allegation during 2019 interviews.During those interviews, Trump claimed Carroll was “totally lying” to sell a book and denied ever meeting her, though they were photographed together in the late 1980s.Carroll’s lawsuit claims the president harmed her reputation when he denied the allegation and branded her a liar, The New York Times reports. 1136

NORTH FORT MYERS, Fla. -- Orlando Ortega posted a Facebook video of his now-former co-worker, Eileen Marcinkowski, calling him the N-word Sunday. The video has more than 150,000 views.But the owner of the restaurant where the incident took place said the video doesn't tell the whole story. “The lady in the video he actually did hit. She had blood on her face, she was bleeding," said Jane Thursfield, owner of Cactus Jack. Thursfield said Ortega provoked the fight when he punched Marcinkowski in the face after he was let go by the restaurant. Scripps station WFTX in Fort Myers could see no evidence of blood on Marcinkowski's face in the Facebook video. The owner said even if Marcinkowski was provoked, the racial comments were not OK. “No, no, of course not," Thursfield said. "No, we don’t condone that at all.”Other customers, like Johnny Samz, who said he regularly eats at Cactus Jack, agreed. “I don’t think it’s ever good, for anybody to use the N-word," said Samz. "I don’t care what the circumstances are.” WFTX's Jasmine Minor asked since Ortego no longer worked at the restaurant, if Marcinkowski would face the same fate. “She is still working here, yeah," said Thursfield. "I have not been here long and she’s working, but we will obviously address that.” The owner said the incident took place "off-the-clock" and "off business property."
