SAN DIEGO (CNS) - A young man accused in a series of San Diego-area gang-related killings and attempted slayings pleaded not guilty Monday to murder, attempted murder and conspiracy charges.Ismael Betancourt, 20, is charged in the Aug. 1, 2019, shooting death of 57-year-old Marco Magana in Mountain View, the Feb. 8 shooting death of 19-year-old Leah Posey in Southcrest, and two attempted murders that allegedly occurred on July 24, 2019 and Feb. 8.San Diego police announced Betancourt's arrest last month in connection with the April 8, 2018, shooting death of 55-year-old Lowry Rivers in National City, which occurred when Betancourt was 17. Rivers' killing is not listed in the latest complaint, and it's unclear whether Betancourt is being tried in juvenile court regarding that crime or whether additional charges are pending in his current case.In addition to the murders and attempted murders, Betancourt is charged along with six co-defendants with conspiracy to commit a crime, for what prosecutors allege was a plan to kill rival gang members.The overarching conspiracy includes the July 12, 2019, shooting death of 20-year-old Joaquin Ruiz, who was shot in a vehicle in Bay Terraces by assailants who opened fire from another vehicle.The four defendants charged with that slaying have been arrested and pleaded not guilty. Two of those defendants, Ethan Apan, 28, and Kevin Herrera, 26, are also charged in the murders in which Betancourt is charged. The complaint charges Apan in Marco Magana's murder and Herrera in Leah Posey's murder.Betancourt is being held without bail and his next court date is a Dec. 22 readiness conference. 1656

SAN DIEGO (CNS) - County health officials reported 253 new COVID-19 cases and three new deaths Sunday, raising the region's totals to 38,300 cases and 682 deaths, as some local businesses prepared to re-open indoor operations Monday.Three men in their 80s died. All three had underlying medical conditions.Of the 5,360 tests reported, 5% returned positive. This is one of the two criteria now being used by the state to loosen or tighten restrictions on activities.The 14-day rolling average of positive tests is 3.7%, well below the state's 8% guideline. The seven-day average number of tests performed in the county is 6,775.Of the total positive cases, 3,099 -- or 8.1% -- have required hospitalization since the pandemic began, and 750 -- or 2% -- were admitted to an intensive care unit.County health officials reported two new community outbreaks as of Saturday, bringing the number of outbreaks in the past week to 19. One outbreak was in a health care setting and one in a business setting.The number of community outbreaks remains well above the county's goal of fewer than seven in a seven-day span. A community setting outbreak is defined as three or more COVID-19 cases in a setting and in people of different households in the past 14 daysGov. Gavin Newsom released a new state system Friday that sorts counties into one of four tiers based on the extent of the area's COVID-19 outbreak,Restaurants, places of worship, movie theaters and museums will be allowed starting Monday to maintain up to 25% occupancy or 100 people -- whichever is less. Gyms may operate with 10% occupancy. Hair salons, barbershops and nail salons may operate indoors with normal capacity.Dr. Wilma Wooten, the county's public health officer, said the county would follow state guidelines that indicate retail businesses are to be restricted to 50% occupancy.All indoor businesses must still abide by social distancing- and face-covering mandates, as well as having a detailed safe reopening plan on file with the county.Wooten said San Diego County had made it to "tier 2," the only county in Southern California to earn that designation. The county still has a "substantial" COVID-19 presence, but unlike Orange, Riverside, Los Angeles and Imperial counties it is not considered "widespread."The two metrics the state was monitoring in that tier list include an old one -- the percentage of positive tests -- and a new one -- the number of daily new cases per 100,000 people. San Diego County is at 3.8% and 5.8 per 100,000 respectively. To make it to the next tier, the county must show rates of between 2% and 4.9% positive tests and between 1 and 3.9 new daily cases per 100,000 population.Because the county currently exceeds one of those numbers, it cannot start its path to the next tier.County Supervisor Nathan Fletcher said he felt the county was moving too quickly to reopen and should take a more measured response."My concerns are with the size, scope and speed of what is being reopened on Monday," he said. "While there are some lower risk entities that could safely reopen at this point, what we are doing is very similar to what we did in June with a large segment of indoor operations all opening at the same time. This led to a large increase in cases and required new restrictions."But even though I prefer a different path, the decision has been made and I will continue to work tirelessly to help us find a way to slow the spread, support our schools, and continue to help our community through this difficult time," Fletcher said.According to Wooten, there is a 21-day mandatory wait time before any county can move between tiers, and a county must meet the metrics for the next tier for two straight weeks. SAN DIEGO (CNS) - California Highway Patrol officers arrested fewer people than last year for suspected drunk driving in San Diego County so far during the Christmas holiday enforcement period, the agency said today.CHP officers arrested 33 people in the county between 6 p.m. Friday and 6 a.m. Sunday, an officer said. That's down from 40 arrests in the area at the same time last year.Statewide, the CHP arrested 639 people for suspected DUI violations Friday night and early Sunday, up from 604 in 2017.There were 20 traffic fatalities reported by law enforcement agencies across the state during the period -- including one in San Diego County. SAN DIEGO (CNS) - Countywide sales of previously owned single-family homes and attached properties both fell from September to October while prices increased, according to data released Thursday by the Greater San Diego Association of Realtors.Sales of single-family homes fell 4.9% from 1,862 in September to 1,771 in October while attached-property sales fell 2% from 943 in September to 924 last month. Sold listings of both property types have fallen for four consecutive months, according to the GSDAR.Median sale prices of single-family homes rose 3.1% from 5,000 in September to 5,000 in October while attached property prices increased 2.4% from 9,000 in September to 9,000 last month. SAN DIEGO (CNS) - A report released Thursday by the International Boundary and Water Commission found a significant presence of wastewater in border channels in the Tijuana River Basin impacting San Diego.In the report, "Binational Water Quality Study of the Tijuana River and Adjacent Canyons and Drains," scientists from the United States and Mexico collected samples from of seven transboundary channels.The sampling and laboratory analysis for the study were performed from December 2018 to November 2019. The findings indicate the presence of treated and untreated domestic and industrial wastewater.The scientists analyzed 267 different parameters in water and 204 parameters in sediment for pathogens, metals, industrial organics, pesticides, as well as conventional parameters typically found in wastewater. Of the parameters tested, 131 were not detected and 136 had detectable levels.Parameters that exceeded standards in both countries at all monitoring sites are those associated with the presence of wastewater, including ammonia, biochemical oxygen demand, chemical oxygen demand, oils and greases, phosphorus, nitrates, methylene blue active substances and coliform bacteria.Data analysis indicates that the parameters which exceeded standards had originated as uncontrolled sewage spills from Tijuana. Disposal of solid waste or trash contributes to the presence of certain parameters exceeding the standards, such as the organic compound DEHP. Commonly used in the manufacture of plastics, DEHP exceeded applicable standards at all monitoring sites and could have leached from plastic accumulated in the canyons and Tijuana River.The results showed that certain parameters of concern -- Hexavalent Chromium and the pesticides DDT and Aldrin -- were either not detected or found in very low amounts below the limits established in both countries' applicable regulations. Likewise, metals such as copper, nickel and zinc, which are commonly used in the metal plating industry, were detected at levels within applicable standards in both countries.The report also includes recommendations related to control of industrial wastewater discharges in Tijuana, increased resources and assistance for wastewater collection and treatment systems in Tijuana, and continued joint water-quality monitoring and field inspections to detect and respond timely to wastewater flows. 2389
