SAN DIEGO (KGTV) - South Bay Pentecostal Church has been involved in a legal battle since May regarding worshiping indoors, and officials think Friday could be the light at the end of the tunnel.Senior Pastor Arthur Hodges believes during a motions hearing Friday morning the church will be granted permission to reopen indoors.His hope comes from the latest rulings by several judges.On Dec. 3, the Supreme Court ruled places of worship in New York could reopen, saying restrictions meant to curb the pandemic violated the First Amendment of the Constitution.After that ruling, the high court issued an unsigned order to California judges to reconsider Gov. Gavin Newsom's restrictions.On Wednesday, a judge ruled restaurants could reopen indoors in San Diego."That absolutely makes us hopeful, and I've told restaurateurs, business owners, whatever, we're fighting for you, too. Now we have a bigger gun than they do. We've got the Constitution, OK; they don't have that. but they're finding ways to get around it with the right to assemble," Hodges said.Hodges said back in May their initial lawsuit was voted down 5-4 by the Supreme Court.Hodges believes under a high court that shifted majority when Judge Amy Coney Barrett replaced the late Ruth Bader Ginsburg, they will prevail."If religious liberties are lost, you can mark it down your personal liberties are going to be lost," Hodges said, arguing this lawsuit is to protect more than places of worship.Hodges said if they win this legal battle it will pave the way for the rest of the country. 1563

SAN DIEGO (KGTV) - Scientists at the Hubbs-SeaWorld Research Institute are working to replenish the California Halibut population.In October, they released 2,300 juvenile halibut into Mission Bay. Those fish were bred, born and raised at the institute. They hope it's just the start of a robust replenishment program."The species is pretty heavily depleted and for that reason, they're a good candidate to help boost the species," says Mark Drawbridge, the Institute's Director of the Sustainable Seafood Program.Recent surveys show the California Halibut is down to 14 percent of what its population should be. The most severe drop has come in Southern California.Hubbs hopes it can replicate the success it had with the White Seabass. It has released nearly 2.5 million seabass into the wild in the last 35 years."A lot of the process is transferable from one species to another," says Drawbridge.The Dick Laub Fisheries Replenishment Program oversees every step of the process, from breeding to release. Drawbridge says they've seen success in every phase so far."Our survival rates from egg to juvenile stage are typically 20 percent or higher," he says. "Compare that to the wild, where it would be a fraction of a percent. That's more than adequate to produce tens of thousands of fish."The next step is seeing how the halibut survive in the wild. The Institute put stainless steel trackers in each fish and will monitor them over the next few years.The program is funded through private donations, many of which come from fisherman who need a healthy halibut population to make a living. 1602

SAN DIEGO (KGTV) — SeaWorld San Diego is reintroducing its popular annual SoCal Pass as the park prepares to offer new attractions for guests.The SoCal Pass, also known as the "Silver Annual Pass," is available for 1.99, or .24 a month with a down payment, the park says, and contains hundreds of dollars in benefits. The deal is only good online. SAN DIEGO (KGTV) — San Diego Police say possible human remains were discovered in a Fiesta Island fire pit early Thursday.Just after 10:30 a.m., a man on the east side of the island flagged down San Diego Lifeguards after making the grim discovery. Officers responded and sent an image to a forensic anthropologist, who confirmed the remains were possibly human.ABC 10News spoke to the man who made the discovery. Dan Conklin says he was hoping to spend the day on Fiesta Island and was planning to grill some hot dogs when he parked his van near the fire pit. Conklin says he noticed a lot of trash surrounding the pit and some extra wood, so he decided he would stay. When he started cleaning up, he says, he noticed what looked like human remains. "I kept thinking it was a joke, something to do with Halloween, it had to be a mannequin or a dummy or something that you put on your porch or something," said Conklin. Conklin says he flagged down a lifeguard in the bay who then called police. Conklin says when he arrived at the pit, it was still smoldering. SAN DIEGO (KGTV) — San Diego's Registrar of Voters addressed worries over ballots that may have been filled out using Sharpies, saying the ballots will not be disqualified.Wednesday, an attorney working for President Donald Trump's campaign claimed supporters who used Sharpies on their ballots are worried that their votes are being thrown out as Arizona's vote tally continued. There's no evidence that Sharpie votes have been disqualified and the Maricopa County Elections Department has said that ballots won't be impacted because a Sharpie was used.RELATED: 'Sharpie ballots' have the attention of a Trump campaign hoping to flip ArizonaThursday, the San Diego Registrar of Voters offered a similar statement, saying Sharpies — even if they bleed through the ballot — will not disqualify votes. Part of this is because ballots are printed in an off-set pattern, meaning "bubbles" for races and measures do not overlap on each side of a ballot."Regardless, using a Sharpie does not invalidate the ballot. Our voting system prevents a situation where if a voter uses a Sharpie to vote and it bleeds through to the other side, it will not impact any 'bubbles' on the opposite side," the Registrar said.The county added that polling locations do not provide Sharpies and instead use "archival pens," which were identified to be the best writing instrument more than a decade ago."In San Diego County, we do not provide Sharpies to voters to mark their ballot. What we use are archival pens, which we researched over 10 years ago as the best marking instrument for a voter. The ink in the archival pen actually helps in preventing bleed through of the ballot while ensuring the 'bubble' is clearly marked," according to the Registrar.As of Thursday afternoon, the county has recorded more than 1.2 million ballots and had about 370,000 left to process.
