A judge ruled Tuesday the City of Omaha must release a video showing the death of a TV crewman during a shootout at Wendy's in 2014.Bryce Dion, a sound mixer on a shoot at a Wendy's in Omaha for the reality TV show "Cops," was shot and killed Aug. 26, 2014, after Omaha Police returned fire on a man who shot a pellet gun at officers. He can be seen slumped against a glass wall in the vestibule of the restaurant.Dion was wearing a bulletproof vest, but was hit with a bullet under his armpit. The suspect, Cortez Washington, who was using an airsoft pellet gun, was also killed.In 2016, Dion's brother, Trevor Dion, filed a wrongful death lawsuit against the city, which had asked a Douglas County District judge to bar the release of the video, according to the Omaha World-Herald. The lawsuit says Dion was doing as instructed when he was hit by gunfire from an Omaha police officer.“Bryce positioned himself where told, when told, and acted in accord with police officer instructions. The perpetrator drew what appeared to be a pistol, but proved to be a pellet gun that simulated discharge. Police responded with live rounds of ammunition. They shot and killed the perpetrator. As they did so, they also shot and killed Bryce who was positioned as directed between at least one police officer who arrived at the scene belatedly, other police officers, and the perpetrator.”Brian Jorde, Dion's attorney, says he plans to use the video and other evidence at trial. The proceedings are expected to begin sometime after July."There's approximately 20 bullet holes just near the area of where Mr. Dion was alone so there's a significant amount of gunfire that was exchanged," Jorde said. "We think the public deserves to know what happens when their taxpayer dollars are at work with the police and otherwise. And I think it sheds light on exactly what happened and that Mr. Dion was caught in the line of the crossfire through no fault of his own."Omaha City Attorney Paul Kratz said the city played the video in court Tuesday to support its motion for the case to be dismissed."The city presented the video to the court in support of its motion for summary judgment, and we believe the video will support that motion," Kratz said when reached by phone Tuesday night. 2468

A group of Greyhound passengers were not pleased after their bus left three and a half hours late and then took an unexpected detour on Thursday morning.Passengers said their bus was supposed to leave at 2:30 a.m., but it didn't actually pull away from the bus station until 6 a.m. To make matters worse, once the bus got into Pennsylvania, passengers said it turned around because the driver said there were problems with the bus.But wait, there's more.The bus reportedly missed Cleveland and went all the way to Toledo before the driver realized the error. Toledo is roughly two hours west of Cleveland. Now riders are looking for alternative ways to get to their destinations. One booked a flight and another caught a new bus.Passengers said Greyhound has not been cooperative through this ordeal and hasn't offered them refunds. 860

A lawsuit has been filed against the County of San Diego and the former Assistant Sheriff for sexual harassment and retaliation.The employee began working for the Sheriff’s Department in 2010 at the Vista Detention Facility, according to the lawsuit.Team 10 is not naming her because she said she is a victim of sexual harassment. The female employee claimed that Miller made “inappropriate sexual innuendo” to her, including tickling her hand.She stated in her lawsuit that she confided in two Commanders about Miller’s behavior, but did not raise a formal complaint because she feared retaliation.She applied for a new job within the department with Law Enforcement Services Bureau Administrative Secretary II “in order to avoid Defendant Miller and his continued harassment.”She was not granted the transfer. She alleged “Miller demoted her in retaliation for her rejection of his sexual advances and efforts to avoid further harassment by him.”Team 10 contacted the Sheriff’s Department late Monday. A spokesperson said Miller is no longer with the department, since he retired.She added they cannot comment on pending lawsuits. Team 10 is still waiting to hear back from a county spokesperson.The woman suing the County of San Diego and Miller also believed that “the county had received and/or was aware of several complaints from other employees about inappropriate sexual behavior of the Assistant Sheriff.”The lawsuit stated the county took no appropriate action to protect from Miller’s harassment.Team 10 previously contacted Miller when these allegations first arose in February.He told Team 10 investigator Melissa Mecija he could not comment on an ongoing investigation. He also said he “absolutely” denied allegations of inappropriate conduct.In late February, before the lawsuit was filed, a sheriff's spokesperson told Team 10: "Despite the allegations in the claim, the claimant was not demoted.
