SAN DIEGO (CNS) - A man who wounded an off-duty sheriff's deputy and a bystander by opening fire in the Gaslamp District two years ago was convicted of assault with a firearm Thursday in his third trial in the case. Ray Pitoau, 39, was convicted of two counts of assault with a firearm for the Aug. 7, 2017 shooting that injured Deputy Jason Philpot, who was walking through downtown with his two brothers following a Metallica concert at Petco Park. Also injured was bystander Vladimir Shvets, a passerby in San Diego for a convention. Pitoau was also convicted of a lesser charge of assault on Philpot's younger sibling, Joshua, who Pitoau initially got into an argument with on Island Avenue near Sixth Avenue just after 1 a.m. RELATED: Gaslamp deputy shooting suspect escapes Spring Valley SWAT standoffSentencing is scheduled for Dec. 11. Pitoau was convicted in a prior trial of three felony firearm possession counts and was sentenced to 27-years-to-life for those convictions. However, both of his previous trials in the case resulted in hung juries regarding the assault charges. Jason Philpot testified that he tried to wrap his arms around Pitoau and get the gun away, but the defendant was able to pull the trigger, wounding the deputy in the chest and right arm. A second round also passed through his right arm. One of the rounds ricocheted off the sidewalk and struck Shvets. RELATED: Man convicted in Gaslamp shooting involving off-duty deputy sentencedProsecutors said Philpot and his group walked past Pitoau when the defendant and Joshua Philpot traded insults. Pitoau testified that he grabbed a gun in self-defense because a group of men, including Philpot, were advancing on him. He testified that he and Jason Philpot both grabbed onto the gun, leading it to fire as they grappled over the weapon. Pitoau was arrested about a month later in Mexico.RELATED: San Diego deputy testifies against man charged with shooting him in Gaslamp District 1972

SAN DIEGO (CNS) - Authorities Tuesday were working to determine what led to the death of an inmate at the San Diego Central Jail. Deputies conducting a security check at the Front Street detention center found 26-year-old Ivan Ortiz of San Ysidro unconscious in his cell about 3:45 p.m. Monday, according to sheriff's officials. ``Deputies and medical staff performed lifesaving measures until paramedics arrived and transported Ortiz to the hospital,'' Lt. Michael Blevins said. Physicians pronounced Ortiz dead about 4 1/2 hours later. Ortiz had been arrested by San Diego police last June on suspicion of attempted murder, assault with a deadly weapon and felony vandalism. A criminal complaint alleges that he attacked two people last June 6 with a skateboard, and attempted to kill one of the victims, though specific details on the alleged attack were unavailable. He also faced two counts of assault with a deadly weapon -- a skateboard -- as well as three counts of felony vandalism regarding alleged incidents on May 10 and June 9, and a misdemeanor count of resisting arrest. At the time of his death, he was being housed alone in a psychiatric observation cell. The county Medical Examiner's Office will conduct an autopsy to determine the cause and manner of Ortiz's death. The sheriff's Homicide Unit also was called in to investigate, which is standard in cases of in-custody fatalities. ``Our response is not an indication of foul play or suspicious circumstances,'' the lieutenant noted. 1511

SAN DIEGO (CNS) - Four men allegedly bringing several dozen pounds of drugs through the coastal North County were arrested today following a road chase from Solana Beach to Carlsbad, authorities said. The pursuit began about 10:30 a.m., when detectives tried to pull over a vehicle with five people in it on Interstate 5 near Lomas Santa Fe Drive, according to sheriff's officials. The driver refused to yield, continuing on to the north for about four miles before exiting onto Encinitas Boulevard, Sgt. Bill Kerr said. There, one of the passengers, 24-year-old Gabriel Albert Delosreyes, got out of the vehicle and allegedly made a futile attempt to escape on foot.As deputies chased down Delosreyes, the fleeing driver -- later identified as Juan Manuel Villalobos, 28 -- got back onto I-5 and went north for several more miles, then exited at La Costa Avenue and headed east along the southern shoreline of Batiquitos Lagoon, Kerr said.Reaching a residential area off Levante Street and Caminito Monarca, just east of El Camino Real, Villalobos pulled over, jumped out of the vehicle and ran off with his remaining companions. One of the four, an unidentified woman, managed to escape, but deputies quickly captured Villalobos along with cohorts Marcos Martinez, 34, and 26-year-old Eddie Anthony Navarro.Inside the trunk of the car Villalobos had been driving, deputies found a truck tire with 25 1/2 pounds of methamphetamine stashed inside it, according to Kerr."Small amounts of other drugs were also found on the suspects,'' the sergeant said. The arrestees were expected to face various criminal charges, including possession of an illicit narcotic for sale, illegal transportation of a controlled substance and conspiracy. 1736

SAN DIEGO (CNS) - An emaciated dog found Friday in Bandy Canyon remains in critical condition but has shown some signs of improvement, the San Diego Humane Society's animal care staff reported today.A county resident brought the 2-year old male pit bull mix to the Humane Society's Escondido campus after finding him extremely dehydrated and cold, with pressure sores on his hips and knees. Humane Society veterinarians are working to feed and re-hydrate the dog slowly so as not to damage his body in its current fragile state.According to the organization, it could take between seven and 10 days for the dog to turn a corner and begin to recover. Humane Society staff are hopeful that will happen."When I found him he was extremely lethargic and weak,'' said Humane Society Law Enforcement Sgt. Lauren Monreal. "He's since received fluids, some electrolytes and ... even despite his horrible condition, he wags his tail.''The organization's Law Enforcement unit opened a felony cruelty investigation on Friday into the dog's abandonment and who may be responsible. Residents can offer information leading to the responsible party's arrest by calling Humane Society Law Enforcement at (619) 299-7012.San Diego Crime Stoppers is also offering a ,000 for information leading to the person's arrest. Residents can call the Crime Stoppers anonymous tip line at (888) 580-8477 or visit the organization's website, sdcrimestoppers.org. 1441
