CASS COUNTY, Ind. — Six people, including four children, died early Wednesday morning in a house fire near Logansport, Indiana.The fire started at about 1:45 a.m., Wednesday in the 4300 block of Pottawatomie Road. Deputies who arrived said they climbed on the roof and broke windows to try and get inside, but the flames were too intense, Logansport Pharos-Tribune reporter Mitchell Kirk said.A man and a woman made it out of the house and were hospitalized. The cause of the fire is still under investigation. The Indiana Fire Marshal's Office has assigned three investigators to the site.  634

CARLSBAD (CNS) - Attorneys for the alleged victims of a former Carlsbad military boarding school headmaster whose molestation conviction was overturned last week by a state appellate panel asked the San Diego County District Attorney's Office Wednesday to appeal the ruling or retry the case against him.Jeffrey Barton, 62, was convicted in 2017 of five felony counts of forcible oral copulation and one felony count of forcible sodomy for allegedly molesting a cadet at the Army and Navy Academy beginning in 1999, when the alleged victim was 14 years old.Barton was sentenced to 48 years in state prison.A three-justice panel from the Fourth District Court of Appeal agreed with Barton's contentions that the trial judge should not have dismissed one of the jurors during the trial and reversed the conviction on Friday.RELATED: Appeals court reverses molestation conviction for former Carlsbad boarding school headAttorney John Manly, whose firm represents four alleged victims in civil suits filed against Barton and the academy, said, "We disagree with the ruling of the court of appeal. Jeffrey Barton is a serial sexual predator who is known to have sexually molested at least six boys in horrific ways. The evidence against him is overwhelming and we ask District Attorney Stephan to appeal this decision and, if necessary, retry this case in the interest of justice and public safety."So far, two of those civil suits have been settled and two are pending.A District Attorney's Office spokeswoman said, "We have contacted the victims who testified in the case and are working to provide them support. At this time, we are exploring our appellate options, which include retrial."The convictions came in Barton's second trial.In his first trial, almost two years before, a different jury deadlocked on the charges involving the alleged victim.Two other former Army and Navy Academy students testified in the first trial that they were molested by Barton, but the defendant was acquitted on all but one of the counts involving those victims.The appellate panel ruled that Barton's second trial could have concluded differently had one juror not been excused, allegedly for refusing to deliberate with her fellow panelists.The justices wrote in their ruling that the other jurors appeared to disagree with Juror No. 12, but did not provide enough of a showing that she was actively stalling deliberations.The ruling indicates the juror did not appear to find the alleged victim credible."The trial court's error in discharging Juror No. 12 warrants reversal," the panel wrote. "She was the lone holdout juror who consistently held to her belief Barton was not guilty and, had she remained on the jury, it is reasonably probable the case would have ended in a mistrial, a more favorable result for Barton than conviction."The panel wrote that Barton was convicted "within hours" of the juror being discharged. 2921

  

CHICAGO, Ill. – A study published this month suggests that by lessening the amount of virus you take in by putting on a mask, you may also lessen the likelihood of getting severely sick if you contract COVID-19.As the race to a safe and effective coronavirus vaccine heats up, new research about masks is changing the narrative on their importance.Last week, CDC Director Dr. Robert Redfield called face masks the most “powerful public health tool we have.”“I might even go so far as to say that this face mask is more guaranteed to protect me against COVID than when I take a COVID vaccine,” said Dr. Redfield.It was a stark change from CDC messaging early on in the pandemic that face coverings would most likely only protect those around you.“That was because there was a lot of data at that time that you can shed the virus at high rates from your nose and mouth even when you feel well,” said Dr. Monica Gandhi, an infectious disease doctor and professor of medicine at the University of California – San Francisco.She co-authored newly published research in the New England Journal of Medicine that theorizes that not only do masks protect the wearer but they may even reduce the severity of the coronavirus when someone gets infected.“We realized that we should be messaging more strongly masks protect you as the wearer and protects others,” said Dr. Gandhi.It theoretically works much like the early days of vaccines that used small amounts of viruses to illicit an immune response in the body. So, by wearing a mask, you are only exposed to lesser amounts of the virus, if any, potentially building up a sort of immunity.“The more virus you get inside, the sicker you are, the less virus you have, the less sick you are. This is called a dose response and it's true of many infections,” said Dr. Emily Landon, an epidemiologist and infectious disease specialist at University of Chicago Medicine.Gandhi says the theory has already been studied and proven in animals.“There was a hamster study that looked at the COVID-19 virus and the more that the hamsters were given, the more sick they got,” she said.Dr. Gandhi says it could also explain the why according to the CDC, 40% of coronavirus patients are asymptomatic.“Countries that mask well have lower rates of severe illness than countries that don't mask well. So, putting it all together, this is our hypothesis.”And while the research is still theoretical, if it bears out, experts say universal mask-wearing could drive up the proportion of people who get less sick from the virus if they do contract it. 2579

  

CARLSBAD, Calif. (KGTV) — A 52-year-old modeling photographer was arrested this week in Carlsbad, accused of sexually assaulting a teenager.Robert Koester, of Carlton, Ore., was arrested on Tuesday at a Carlsbad Blvd. residence after the reported sexual assault of a 16-year-old during a modeling shoot, according to Carlsbad Police.Police were alerted to the reported sexual assault on Monday after the teenager said she met with Koester, who was subcontracted by Frank, a Carlsbad-based modeling agency. MAP: Track crime happening in your neighborhoodThe victim said during the photo shoot, Koester sexually assaulted her. She left the shoot early and told her father about the incident.Police investigated and found Koester at the residence, which he was temporarily renting. Police said other evidence was collected at the scene.Investigators are working with the modeling agency, Frank, to identify other possible victims. Investigators believe Koester worked under the aliases "Rhake Winter" and "Bert Kay" as well.Anyone with information about Koester is asked to call Carlsbad Police at 760-931-3819 or email their tipline at tipline@carlsbadca.gov.Koester has been charged with great bodily injury, sexual battery, possession of child pornography, and providing harmful material to a minor.
