SAN DIEGO (KGTV) - Hundreds of criminal cases are being examined and reviewed to make sure prosecutors got the right result. That mission is part of the San Diego County District Attorney’s Conviction Review Unit. The unit has been around for about two and a half years, but there are new visible results of its work.Investigators say Donnell Fulcher shot and killed Roberto Rodriguez shortly after midnight on September 10, 2006.Rodriguez’s pregnant girlfriend was wounded but survived. According to court records, investigators connected Fulcher to the scene in part through DNA evidence found on a glove. Fulcher has always maintained his innocence. “We argued that he was not involved at all,” said his defense attorney, Knut Johnson. “There was also in my view, evidence of some other people who are very likely candidates for people who might have committed this crime.”Because of changes in the way DNA is now analyzed, Fulcher got what most defendants will never see—a chance at a new trial.“The prosecutor’s role is to ensure justice before, during, and after trial. This unit is just another way we can fulfill that mission,” said Bryn Kirvin, the deputy district attorney who leads the conviction review unit. Part of their efforts went into looking at all cases where there could be DNA mixtures, meaning more than one DNA profile in a sample.That’s because guidelines by SWGDAM (Scientific Working Group on DNA Analysis Methods) changed the way they interpreted DNA. “They decided [they wanted] to take a more conservative, a more cautious view when analyzing low-level mixtures,” Kirvin said.According to the District Attorney’s office, approximately 1,525 defendants were tried to jury verdict between 2003 to 2016 for serious or violent crimes. Most did not involve DNA, but in 351 cases, DNA was used at trial.Of those, 254 defendants’ cases involved mixtures. That included Fulcher’s case. Team 10 was in court on October 29th when Fulcher chose to plead guilty to voluntary manslaughter and assault with a firearm, instead of going through another trial.The judge sentence Fulcher to 14 years, but he received credit for time already served. He has since been released.Prosecutors with the unit did not talk specifically about Fulcher, but emphasized their mission of finding justice. “Anything about the case that gives us doubt that we lose our confidence in the conviction, we shouldn’t be afraid to act. We should be running to the courthouse to act,” said Deputy DA Brent Neck who also works with the conviction review unit.In Fulcher’s case, prosecutor Hector Jimenez still believes they got the right individual. “We still believe that we have the right guy, but we lost confidence in the conviction, so we wanted to give the defendant a chance to have a new trial if he wanted,” he told Team 10 on October 29.“He chose to plead guilty instead, so at the end of the day, I believe justice was done.” Anyone can apply to get a conviction reviewed, but there are guidelines.The conviction must have happened in San Diego County Superior Court, the person must still be in custody, and the conviction must be for a violent or serious felony.There must also be some type of credible evidence of innocence. “It doesn’t matter how old the case is. We’re going to be willing to go back and look and make sure that we got it right,” Kirvin said.  3412

Although big box stores are hiring a lot of seasonal employees, local businesses are also increasing staffing. Rick Mitchell, owner of the Pumpkin Station Pumpkin Patch in Del Mar says he hires around 200 temporary workers in October – from high school students to retired veterans. According to experts, if you’re looking to cash in on seasonal work, the time to look is now. Sarah Burns with San Diego Workforce Partnership says adding a personal touch will help you stand out in the seasonal job market. “Can you go in person and introduce yourself to the manager. Say hi, I’m so and so and I’m really interested in working here. That will go a long way in a customer service focused industry,” Burns said. SAN DIEGO (KGTV) - Homeless encampments have moved into the site of previous fires in University heights, sparking more fire concerns.March 2018. Amid a firefight along Highway 163, bystanders on the Vermont Street Bridge looking on soon after the flames spark. Fire crews would put out that fire without any major damage. Months later, a smaller fire erupted in the same area, near another encampment. Marybeth Chruden and the University Heights Community Association organized a petition drive, leading the San Diego City Council to approve more than a million dollars for canyon abatements across the city, including one at the University Heights site in July.In the past few weeks, that site looked a lot different."Shocked, but in a way, not surprised," said Chruden.Chruden's group posted photos on their Facebook page of homeless encampments and the surrounding mess."It shows they are very comfortable, out in the open ... We see people smoking and little campfires down there. The fire danger still high with dry materials in that canyon," said Chruden.Chruden says after several requests on the city's 'Get It Done' app, crews cleared out the area Wednesday morning, except for one mattress. The problem? She expects the homeless to move back in soon."Maybe tonight, in three days or four days. SAN DIEGO (KGTV) -- High school sports in San Diego County and across California will happen during the 2020-21 school year but on a modified schedule that will push the start for fall sports, such as football, to early winter.The California Interscholastic Federation (CIF) Monday released a schedule that shows the last date for Section and Regional/State Championships. Fall sports' championships, according to the schedule, shows end dates in March and April. The schedule shows spring sports, including soccer, basketball, and track and field, with championship end dates in May and June.CIF officials said that “most Section start dates will commence in December 2020 or January 2021.”In a press release posted on its website, the CIF San Diego Section said:The California Interscholastic Federation, San Diego Section (CIF-SDS) is excited to see the foundations of a plan to return high school athletics throughout the state of California for the 2020-2021 school year. Today’s announcement from the state office provides our section with the information necessary to finalize the calendars and schedules for all of our CIF regulated sports, while also acknowledging the importance of the health and safety of our student athletes and coaches by pushing the official start date back to align with the Roadmap to Recovery set by the state of California.Specifics of the plan provides for two seasons of sport, which will serve to maximize the length of each season while not eliminating any athletic opportunities in a reduced athletic calendar for the year. Gavin Newsom announced reopening guidelines for schools across the state.Scripps Ranch High School head football coach Marlon Gardinera was one of many parents, coaches, and players who constantly checked the state CIF website Monday morning for any word on the fall sports season."We were waiting with bated breath,” Gardinera said.After learning there will be an opportunity for kids, including his high school senior and freshman sons, to play, Gardinera said, “It really gives us hope ... as opposed to not having a lot of it, really hard to do when you have two sons who are ready to get back out here.”The modified scheduling will force many student-athletes to choose between sports normally played successively.Gardinera told ABC 10News, “You have soccer and baseball ... [They’re] going to have to choose what sport they're going to want to play in that condensed season.”Otay Ranch High School football player Ethan Knight is excited that there is now a plan in place. "My birthday's in January, so it will be a good birthday present. I think it's great because it will be a new environment." Knight said he has used the months during the pandemic to train for the upcoming season.
