SAN DIEGO (KGTV) -- A former Yuma Police officer charged with raping a woman in San Diego is coming face to face with his accuser’s mother. Jared Elkins didn’t flinch in court Tuesday as his wife’s cousin accused him of raping her over and over in her Kensington home. The woman says she didn’t yell because the former officer threatened to kill her. After the rape, the victim said in court that she ran into her mother’s room and escaped out a window. Her mother’s 911 call played in court Tuesday. Elkins’ wife was asleep across the hall. Police body cam footage showed the accuser hysterical in the back of the police car. The woman can be heard telling the officer how afraid she was. Elkins argued that the sex was consensual and the rape charges were made out of guilt. Elkins pleaded not guilty. His attorney said he used bad judgement but the sex was consensual and the two were drinking.He’s facing nine felony counts including forcible rape and could serve 14 years in prison if convicted. SAN DIEGO (KGTV) - A 10News investigation has revealed that the California department responsible for the state’s child welfare program does not maintain data regarding all deaths of children in foster care.  The revelation is prompting calls for immediate action to child welfare services from at least one San Diego-based politician.State law requires counties to report any child death that is determined to be suspected to be the result of abuse or neglect to the California Department of Social Services.  According to the CDSS, each county in California is required to keep track of every foster child that dies while in its custody.Counties are also responsible for reporting all high profile incidents that occur in foster homes to the State Department of Social Services. High profile incidents would include incidents involving death or serious injury. But the CDSS has no master data list available regarding foster deaths and says that information is maintained at the county level.Using open records laws Team 10 collected the total number fatalities of children residing in a foster placement from all 58 counties in the state since 2010.The numbers show more than 250 kids died during that time across the state. 1290

SAN DIEGO (KGTV) - — San Diegans are not allowing the pandemic to dampen their holiday spirit. This much was apparent at the beginning of Taste of December Nights.Within moments of its opening Friday, a line of cars streamed down Park Boulevard, waiting for a chance to order food from about a dozen vendors lined up at Inspiration Point in Balboa Park. "We've been going to December nights every year, but we didn't want to miss it this year," said Jasper Pascual, of National City, who came with his girlfriend Wendee. "It's something new, something interesting."The pandemic has upended decades of tradition, including December Nights in Balboa Park. Thousands normally pack the event in Balboa Park, enjoying holiday decorations, museums and food. This year, the event is a drive through for food vendors, with participants required to stay in their cars and wear masks. Pedestrians, bicyclists and scooter riders are not allowed. "This event obviously is re-imagined, it's different, but again I think it's the type of event that I think is just what some folks will need," Mayor Kevin Faulconer said as he kicked off the event. San Diegans appeared to agree, waiting in stop-and-go traffic to get into one of two ordering lines. A worker from one of the eateries comes to the window, takes an order, and eventually brings the food. Options included coffee, mini donuts, Cajun and kettle corn."Just tell people be super, super patient, bring some music, relax, have fun, enjoy it, because it's going to be a while," said Hellen Silva, who came with her husband and mother. SAN DIEGO (KGTV) - A former Border Patrol agent was sentenced Wednesday for trying to smuggle drugs across the U.S.-Mexico border while on duty in 2016.Noe Lopez, 37, of Chula Vista, was sentenced to 70 months in prison for attempting to smuggle methamphetamine and cocaine in exchange for cash. He pled guilty to the charges in June 2017.Investigators say the former Border Patrol agent agreed to pick up backpacks containing the drugs from the north side of the border while on duty. Undercover DEA agents used substances resembling drugs in the backpack drops.RELATED: Border Patrol agent arrested in North San Diego County on drug , weapons chargesIn a conversation with an undercover agent, Lopez discussed the area known as "Goat Canyon" as a preferred location, according to investigators, saying "Honestly, the thing is that there aren’t—there aren’t any cameras. Nothing, nothing, nothing."At times, investigators said Lopez switched shifts with another agent to be in a preferred area for a drop.Lopez would load the backpacks in his Border Patrol vehicle and deliver what he thought were narcotics after work in exchange for thousands of dollars, according to the charges.RELATED: Border Patrol agent found not guilty on murder charges, hung jury on two lesser charges"This is a fitting sentence for a law enforcement agent who, instead of policing drug traffickers, joined them," U.S. Attorney Adam Braverman said in a release. SAN DIEGO (CNS) - Unemployment in San Diego County has dropped to 14.3%, but is likely to start increasing again due to modified public health orders, a report released Wednesday by the San Diego Association of Governments found.While unemployment has slowly but steadily declined from the high of 25% the week of May 9, county health orders on Tuesday closing bars, indoor dining at restaurants and indoor business at zoos, museums, movie theaters and other businesses will likely take a toll on the region."The recent rollbacks in opening could significantly impact the food and beverage industry," SANDAG Chief Economist Ray Major said. "Additionally, we could see another wave of layoffs as funding from Paycheck Protection Program loans is exhausted."Those industries told to shut down or modify business on Tuesday represent more than 160,000 jobs, or 11% of the region's pre-COVID-19 workforce.The unemployment rate before the pandemic was 3.1% and it could take many months for the economy to recover to that degree, the report said.The report also shows the geographical distribution of lost jobs and calculates unemployment rates for the five most impacted ZIP codes regionwide, including Encanto, College Area, City Heights, San Ysidro, and Logan Heights. Only Logan Heights is estimated to still have an unemployment rate above 20%. The five ZIP codes least affected, with unemployment rates just over 10%, are Carmel Valley, Del Mar, Rancho Santa Fe, Chula Vista NE, and Rancho Bernardo W."This data can help inform local leaders as they continue to plan our region's recovery," SANDAG Executive Director Hasan Ikhrata said. "As the forum that brings together elected officials and leaders from throughout the San Diego region, SANDAG is in a unique position to analyze this data and to develop reports and economic forecasts." 1848
