SAN FRANCISCO (AP) — A federal judge in San Francisco is mulling the competency to stand trial of a Mexican man who shot and killed 32-year-old Kate Steinle. The 2015 shooting figured prominently in President Donald Trump’s run for the White House four years ago. The case against Jose Ines Garcia Zarate on federal gun charges has been pending since a judge raised “serious concerns” about Garcia Zarate's mental capacities back in January. Two doctors have diagnosed Garcia Zarate with schizophrenia and found him unfit to stand trial. The San Francisco Examiner reports that Garcia Zarate told the court Friday through a Spanish interpreter that he wanted to be sentenced to prison or deported back to Mexico. 720

SAN DIEGO (KGTV)-- The special needs teacher accused of having a sexual relationship with a student, pleaded not guilty to 20 felony counts. He also declared he would represent himself in the case. Against the advice of the judge, 49-year-old Juan Carlos Herrera told the courtroom, he will fight this alone. "I would like to represent myself," Herrera said. Relinquishing rights to counsel, the San Diego High school special needs teacher read the 20 felonies for the first time inside the defendant's box. Those charges include having sex, performing other sex acts, and physically and emotionally abusing one student between February 2018 and this March, when she was 15 and 16 years old."They occurred on an almost daily basis," Deputy District Attorney, Jessica Coto said. "They took place in hotels, in his car, and in his classroom." Coto said his ongoing manipulation extended to making threats."The defendant also routinely threatened the victim, that if she told anybody about what was happening, that she would cut off her arms and legs," Coto said. This all came to light on May 5, 2019, when police arrested Herrera at the US-Mexico border. Days prior, the girl's mother found inappropriate messages from Herrera on her daughter's phone.Because of the nature of the charges, and Herrera's second home in Mexico, the prosecution requested million bail. As his own attorney, Herrera fought back, saying he is a Navy veteran with a 25-year clean record with the district."It's not conceivable for someone with my earnings to make million, nor would I flee," Herrera pleaded. "I have been a person of honor and honesty since the beginning."The judge disagreed and kept the bail at million, handing Herrera his first loss, leaving him in utter disbelief.The judge also put a criminal protection order for the now-17-year-old victim. If convicted, Herrera could face a maximum of 16 years eight months in prison. But the prosecution mentioned, more time could be added if they find more evidence of sexual abuse. 2037

SAN DIEGO (KGTV)- As we get into the heart of fire season, there are big concerns for neighbors who live along a former golf course. The old Carmel Mountain Ranch Country Club is full of dried brush. Neighbors say they are worried the owner is letting the property become a fire hazard. Chain linked fences block off the entrances to the now-shuttered golf course. "It's looking pretty rough," says neighbor Jeffery Acogido. He's been living in his Carmel Mountain Ranch home for almost 30 years. "The course was actually here before the residences."The brush from the site comes right up to neighbors backyards. As we continue to see, warmer weather neighbors say the unwanted vegetation is becoming a fire hazard. "The community is really concerned that it's just going to be a matter of time that something unfortunate might happen."There have been talks of developing the land. 10News made calls to speak with the owner about the neighbor's concerns but haven't heard back. That's according to a San Francisco Chronicle report, which says the crisis fueled by the powerful painkiller fentanyl could have been far worse if it wasn’t for the nearly 3,000 times Narcan was used this year to reverse an overdose. SAN FRANCISCO (AP) — A ring-tailed lemur that was stolen from the San Francisco Zoo this week has been found.The 21-year-old male lemur named Maki was discovered missing shortly before the zoo opened to visitors on Wednesday. Investigators found evidence of a forced entry to the lemur enclosure.Someone called police Thursday evening to say that Maki was spotted in Daly City, a few miles south of the zoo.Police say the animal was found in the playground area of a church.Maki was found to be in good health and was transported back to the zoo.Detectives are still investigating the break-in.??
