CHULA VISTA, Calif. (KGTV) -- Wednesday, the City of Chula Vista filed a lawsuit against the Monsanto Company for chemical contamination. In the lawsuit filed by a law firm named Baron and Budd, the city says chemicals known as PCBs manufactured by Monsanto, now known as Bayer, have escaped into the city’s municipal stormwater system, leading the city to spend substantial amounts of money on cleanup.PCBs are known to cause a number of health issues in humans, such as cancer and damage to the immune system.RELATED: Jury awards 9 million in damages after man says he got terminal cancer from Monsanto's RoundupMonsanto was the sole manufacturer of the chemicals in the US between 1935 and 1979, when the chemicals were banned by the federal government.“Monsanto needs to stop playing games and accept responsibility for cleaning up the mess it’s made,” said Baron & Budd Shareholder, John Fiske. “Chula Vista is the latest city to recognize that PCB cleanup costs shouldn’t be passed on to its citizens, and I anticipate more cities and states will continue to follow suit.”RELATED: Bayer buys seed company Monsanto for billionThe chemicals were used numerous of commercial and industrial applications like paint, electric transformers, cable coatings, sealants and lubricants.Scientists say PCBs can’t be contained to their original applications so, when it rains, the chemicals escape into stormwater systems that wash into bodies of water, such as the bay.The law firm representing Chula Vista also represents San Diego, San Jose, Oakland, Berkley, Long Beach and several other cities in the Pacific Northwest in similar lawsuits. 1680
CHULA VISTA (KGTV) -- Eastlake's Design District shopping complex, which once boasted a vibrant family and adult nightlife destination for the sprawling east Chula Vista communities, lost yet another marquee tenant.Good bye, Tavern+Bowl Eastlake. The 11-year-old bowling alley and sports lounge, located at 871 Showroom Place off Otay Lakes Road, locked its doors unexpectedly Monday night. The 16,000-square-foot establishment nestled within a modern strip mall adorned with water features, rich landscaping, and winding sidewalks was a popular spot for locals.Tavern and Bowl is one of four recent closures at the Design District: restaurant Filippi's Pizza Grotto, arcade and laser tag center Lazer Journey, and indoor go-kart track Eastlake Speed Circuit.READ:?Anonymous tip led to Filippi's inspectionIt's unclear if staff or management were aware of the bowling alley's plans to shut down. Robyn Spencer, a sales director at the San Diego location, would only say that the tavern "has permanently closed."What is clear is that at least one regular was left in the dark.Emeka Enunwa, an Eastlake resident and manager at Work Skills, is upset that the bowling alley is gone. He says he often brings a group of adults with disabilities to Tavern and Bowl to learn life skills by working light "volunteer-like" duties, such as cleaning and performing tasks. He says his group was there two days ago but nobody told him that would be their last shift. His group took pride working at the facility and that the news of the closure may be devastating to some. Enunwa also worried about what's happening in Eastlake that's forcing all these businesses to shut down. "I'm beginning to feel bad as a business owner; no notice ... throwing employees out of work," he said."I'm feeling for the city...they're losing jobs, they're losing money," he said.Enunwa is working quickly to find another business partner but says it's hard "because not everybody wants to accept people with disabilities."The District at Eastlake property management group could not be reached immediately Wednesday for comment.10News' Laura Acevedo contributed to this report. 2492

CHULA VISTA, Calif. (KGTV) -- Parents at Eastlake High School are asking the Sweetwater Union High School District board to investigate a math teacher that students accuse of making inappropriate comments. The parents say the issue started last spring when the teacher made comments about erectile dysfunction in class. Other parents say the teacher hardly teaches, forcing their kids to fall behind. Dan Huslin, a parent of an Eastlake High sophomore, said the school's principal told him last year the teacher was suspended, but this year he found out he's back in the classroom. Huslin said when he asked about why he returned, the current principal told him the district was providing the teacher counseling to help him improve. On Monday night, parents spoke at a Sweetwater district meeting and asked the board to investigate and remove the teacher. Also, parents asked the district to provide math tutoring for the students who are now behind. A district spokesperson told 10News the teacher was not suspended last year and was instead out for personal reasons, adding that they couldn't comment on whether the teacher is receiving any counseling because it is a personnel matter. The spokesperson did say the parents concerns are being addressed, but wouldn't specify how. 1288
CHULA VISTA, Calif. (KGTV) — Police say they rescued a kidnapping victim this week, after the man was able to signal for help through a car's cracked window as the suspect tasked with guarding him slept.Sunday night, a 36-year-old man was attacked by two men and thrown into a pick-up truck while walking to his car from a restaurant in the 600 block of Broadway, Chula Vista Police said.Police said the suspects took the victim to a second location near Sequoia St. and Presidio Point Ct. and handed him off to a third suspect waiting in a parked car. While the suspect in the front seat was supposed to be watching the victim in the backseat, he fell asleep instead, police say.Police say that's when the victim was able to signal for help, waving a white cloth out of a slightly cracked open window in the backseat. A passerby spotted the victim flagging for help at about 11:30 a.m. Monday and called police.Police arrived and rescued the man and arrested the sleeping guard. That's when the suspected pick-up originally used to abduct the victim drove past, police said. Police say they arrested one of the two men inside the truck who they believe to have been involved with Sunday's incident.Police are still looking for a third suspect. The motive behind the abduction remains unclear, police said, but it didn't appear the victim knew the kidnappers. The victim was taken to the hospital for treatment of injuries sustained during the ordeal, police added. 1470
CHULA VISTA, Calif. (KGTV) — Upstairs in the visiting room he teared up saying this was a big misunderstanding.Thomas Escajeda, 61, is accused of threatening St. Rose of Lima church and a school at 293 H St. Tuesday, according to Chula Vista Police. Police says he threatened to harm parishioners attending a mass for All Saints Day on Thursday at 8 a.m.Escajeda, however, told 10News from jail Thursday that the accusations are a mistake. Escajeda, who has attended the church for a year, said he called the church with the idea to sell hot chocolate, coffee and maybe some donuts to warm the congregation up during the cold morning hours before service. He says it was the phrase, "I'd make a killing," that sent the person on the other end into a panic.RELATED: Chula Vista church receives threat against All Saints Day massThe mass and Thursday classes were canceled despite the arrest. If Escajeda did say those words the timing couldn't have been worse with the synagogue shooting in Pittsburgh last Saturday.Thursday, he had one message — directed to his wife and stepdaughter."I miss them every day, even though I've been here for a day and a half, basically think before you speak," Escajeda said.10News has reached out to the church to verify Escajeda's story. He is currently being held on 0,000 bail.Chula Vista Police has told 10News they will not comment on a pending investigation. 1475
