(KGTV) - After Monday's arrest in the death of a Carlsbad woman found on a hiking trail, prosecutors must now decide whether to charge the teenage suspect as an adult.A 17-year-old teen from Carlsbad was booked on murder charges weeks after Lisa Thorborg, 68, was found stabbed to death along Hosp Grove Trail.Investigators tell ABC 10News police work led them to the teenager, before DNA evidence confirmed their suspicions. Former District Attorney turned criminal defense attorney Paul Pfingst says prosecutors must now decide whether the accused should be tried as an adult."An adult for a first-degree murder case can receive a 25 years-to-life sentence. A juvenile can only be kept until the age of 25," said Pfingst.A decade ago, Pfingst represented Heather D'Aoust. At the age of 14, she killed her mother with a claw hammer. D'Aoust was charged as an adult, pleaded guilty and was sentenced to 16 years to life.Pfingst says unlike in that case -- thanks to new state laws -- if prosecutors do charge the 17-year-old as an adult in the Carlsbad case, a judge will have the final say."The more dangerous that person is, they most likely they are to be charged as an adult," said Pfingst.Pfingst says the biggest factor is the crime itself."Is the act is such that it demonstrates such a wanton disregard for life and for people around them that the person needs too be confined?" said Pfingst.Pfingst says the background of the suspect will heavily scrutinized."Including whether they've been involved with gang activity, prior acts of violence, prior acts of rebellion," said Pfingst.Police in the Carlsbad case declined to say if the teen has a criminal history. Pfingst says the extensive background check is likely underway as prosecutors weigh their decision."What does the protection of community protection require? Longer incarceration or does it require juvenile attempts at rehabilitation?" said Pfingst.A detention is scheduled for Thursday in juvenile court. 2002

The witness said that large gatherings and parties in their neighborhood and at the beach have become a daily occurrence. CALEXICO, Calif. (KGTV) — A man was airlifted to the hospital Sunday after illegally climbing over a section of Calexico's border and falling.The man, who U.S. Customs and Border Protection said had crossed over illegally sometime just after 8 p.m., broke both of his legs and sustained a back injury from the 30-foot fall from atop the border wall.Video shows the man climbing over and falling to the ground, where he lay motionless.RELATED: Congress watchdog: Border wall may cost more, take longerBorder officials said they found him behind the nearby Gran Plaza Outlet Mall at about 9 p.m.Agents on the scene provided the man with first aid and called in emergency responders, who took the man to a Palm Springs medical center.El Centro Sector Border Patrol released the video on Twitter this week, reminding the public of the danger of attempting to climb the border wall. 890

  

CHICAGO, Ill. – The City of Chicago will soon implement under another stay-at-home advisory as it seeks to slow the spread of the coronavirus.The city’s mayor, Lori Lightfoot, announced Thursday that the advisory will go into effect on Monday, Nov. 16 at 6 a.m.Lightfoot says the advisory will call on the people of Chicago to stay at home unless for essential reasons, stop having guests over – including relatives they don’t live with, avoid non-essential travel, and cancel “traditional” Thanksgiving plans."Residents are advised to only leave home to go to work or school, or for essential needs such as seeking medical care, going to the grocery store or pharmacy, picking up food, or receiving deliveries," the city wrote.The city says the advisory will remain in place for 30 days or until the commissioner of health, Dr. Allison Arwady, determines a change in the guidance is appropriate.The new advisory comes as the city and many parts of the country experience the highest coronavirus case rates since the pandemic began. Lightfoot says data shows the city is seeing an average of at least 1,900 cases per day."If we continue on the path we’re on and don’t step up to do the things we know work, we estimate we will lose 1,000 more Chicagoans to this virus by the end of the year," said the mayor.Lightfoot says the stay-at-home advisory is part of a new strategy called “Protect Chicago,” which she describes as a comprehensive effort that includes new regulatory actions, neighborhood street-level activations and citywide public awareness.Watch the mayor's announcement below: 1598
