SAN DIEGO (KGTV) - A federal judge has ordered the San Diego Police Department to stop citing people for living in their vehicles.The decision comes after a lawsuit was filed against the city by a group of homeless people and their advocates.On Tuesday, United States District Judge Anthony Battaglia agreed with the plaintiff’s argument that the city’s municipal code was too vague in defining what constitutes habitation of a vehicle.Tristia Bauman, an attorney with the National Law Center on Homelessness & Poverty which helped work on the case told 10News, “we are very happy and pleased that the judge understood what we were arguing.”However, that was only one half of the lawsuit. The other half targeted the city’s municipal ordinance that outlaws RV parking from 2-6a.m. Known as the Nighttime RV Ordinance, or Oversized Vehicle Ordinance (OVO), the judge denied the request to enjoin it, saying the same argument did not apply.In the decision, Battaglia wrote “while the court sympathies that this Ordinance leaves Plaintiffs with nowhere to park between these hours and is decidedly unfair, the law is not ambiguous, unclear or vague in any way.”A spokesperson for city attorney Mara Elliot declined to comment beyond saying they “will review the ruling and advise our client.”An early neutral evaluation conference had been scheduled for Thursday with all the parties. SAN DIEGO (KGTV) - A Cajon Valley School District worker crossed into oncoming traffic in his work truck Friday morning, striking a car with a mother and child inside, California Highway Patrol officers said. The crash happened about 10:30 a.m. on Avocado Blvd. north of Challenge Blvd. in the Rancho San Diego area, according to the CHP. Officers say the 55-year-old CVSD employee was driving a Ford pickup with a trailer and made an unsafe left turn movement into oncoming traffic. The truck came into the path of a Ford Fusion and the vehicles crashed head-on. The impact sent both vehicles into the front yard of a home. “Initial indications are that the child safety seat which contained the infant was not properly installed and was found by responding emergency personnel face down on the rear floorboard of the Ford Fusion,” CHP officers said. Both drivers had major injuries but are expected to survive. The infant’s injuries are unknown but did not to be serious, officers said. Drugs and alcohol are not factors in the crash. 1044

SAN DIEGO (CNS) - Two former members of an Imperial County church that federal prosecutors allege was embroiled in a labor trafficking scheme in which church members forced homeless people to surrender their welfare benefits and panhandle for the church, pleaded guilty to labor trafficking and benefits fraud Thursday in San Diego federal court.Jose Gaytan, 47, and Sonia Murillo, 51, both of El Centro, admitted to assisting in the scheme to recruit homeless people in San Diego and other cities, then force them to participate in raising money on behalf of Imperial Valley Ministries, a non-denominational church headquartered in El Centro, according to the U.S. Attorney's Office.Prosecutors say former church pastor Victor Gonzalez ordered his members to prevent victims from leaving church properties, including by screwing or nailing windows shut and keeping doors locked from the inside at homes the church operated. Kimberly Wright, co-director of the animal education center, said the alien's voice is a combination of their bat-eared fox, Acacia, and one of their kinkajous, Kima, as well as sounds from an adult and infant."They came out and he took a lot of noise from several of our animals," Wright said. "We tried about every weird sound that we had ... SAN DIEGO (KGTV) - A 15-year-old boy was arrested in connection with the shooting death of his father inside their Scripps Ranch home.At 8:39 p.m. Sunday, San Diego police responded to a report of a shooting at a home in the 11200 block of Affinity Court, near Scripps Ranch Boulevard.10News learned the suspected shooter's brother called 911 to report the incident.Officers arrived to find a 46-year-old Vietnamese man lying on a bedroom floor with at least one gunshot wound to his upper body. After life-saving efforts by paramedics, the man -- who was not immediately identified -- was pronounced dead at the scene.Officers combed the condominium complex and nearby area for the suspected shooter, who was identified as the victim’s 15-year-old son, but could not immediately locate him. Authorities later added that the boy is a Mira Mesa High School student. At about 1 a.m. Monday, officers responded to a reported sighting on Scripps Poway Parkway and saw the boy walking down the street. He was apprehended, and 10News learned the boy had a gun and additional ammunition with him at the time of his arrest. 1133
