LA MESA, Calif (KGTV) - According to the California Department of Public Health, seven deficiencies were issued after an investigation of Sharp Grossmont Hospital. In April state investigators conducted a survey consisting of 14 closed medical records. According to the investigator's findings documented in a statement of deficiencies and plan of correction report, "Hospital leadership did not provide notification of a potential investigation and the use of video recording during medical treatment without patient's consent." Investigators also noted deficiencies with regulations related to medical staff accountability, patient's rights, and use of restraint or seclusion. According to the state document, "The patient has the right to personal privacy. This Statute is not met as evidenced by: Based on interview and record review, the hospital failed to ensure the privacy of all patients undergoing medical treatment in the WHC (women's health center) ORs (operating rooms) when the hospital's Admission Agreement for Inpatient and Outpatient Services was utilized as consent to allow video recording during medical treatment. Also, the Admission Agreement did not allow the patients' the option to acknowledge and/or decline video recording. As a result, the hospital leadership allowed video recording of patients undergoing medical treatment without knowledge or consent." The deficiencies listed fall under violations to conditions of participation for a hospital as listed in title 42 of the federal code of regulations.   A deficiency is a violation of a federal or state law or regulation that the California Department of Public Health cites during a survey or investigation.Officials with the California Department of Public Health tell 10News issuing deficiencies is a form of enforcement action. It requires the facility to submit a Plans of Correction to fix any violations. According to Sharp officials, in 2012 they were alerted that beginning in 2011, potentially powerful drugs and equipment were missing from the anesthesia cart in each of Sharp Grossmont Hospital's three Women's Center operating rooms. The hospital installed a computer monitor with a motion-activated camera in each of the three Women's Center operating rooms. Between July 2012 and June 2013, the videos were recorded. The hospital says the cameras were intended to record only individuals in front of the anesthesia carts. In a statement to 10News, a spokesperson for Sharp wrote:"In their survey, the California Department of Public Health (CDPH) identified areas where opportunities for improvement existed. The hospital addressed each area of concern and created a plan of correction for those findings. Both CDPH and the Centers for Medicare & Medicaid Services (CMS) accepted Sharp Grossmont’s plan of correction, as confirmed in a follow-up survey. The hospital’s plan of correction provides that:The specific techniques used in the 2012-13 investigation have not been used since and will not be used for any future investigations.Any potential future investigations are required to strictly adhere to Sharp’s policies and procedures;Medical staff will be kept informed of any similar future investigations that may occur;Patients will receive full disclosure of any future investigations that may affect their privacy;The patient grievance practices have been strengthened to ensure patient complaints and grievances are appropriately and efficiently managed; andAdditional measures are in place to safeguard against the inadvertent release of patient information to third parties. Staff and clinicians have been educated on the hospital’s plan of correction and policies. While we are pleased that CDPH and CMS accepted our plan of correction, we regret that the investigation inadvertently recorded patients and may have caused distress to those we serve."More than 400 women who claim they were secretly recorded are suing the hospital.Court records show a hearing is scheduled in September. 4026

LEXINGTON, Ky. — A car wash in Lexington, Kentucky is offering a wash, a shine, and a scare this Halloween season.Rainstorm Car Wash has transformed its facility into the ‘Tunnel of Terror,’ a family friendly event that will be held every Friday and Saturday night until Halloween.“With all the COVID stuff, a lot of haunted houses weren't open or anything like that,” said Reese Kemp, the manager of Rainstorm's Lexington location. “So we figured let's have a great time.”When Gov. Andy Beshear unveiled his plan for a safe Halloween, he urged people to avoid haunted houses, citing the likelihood that COVID-19 could spread in such tight quarters.Those concerns don’t really apply to a haunted car wash."When you're in your car, you don't have to worry about getting within six feet,” Kemp notes. “Your windows are up the entire time, the [employees] can have a blast and you don't have to worry about coming into contact or spreading or anything like that.”While your car is getting washed, people will notice employees dressed up as scary characters, trailing the cars to give families a fright.As part of the event, Rainstorm has partnered with local food banks. LA MESA, Calif. (KGTV) — The La Mesa community has continued to show its strength and resilience. But as we head into the weekend, the city's 7 p.m. curfew continues and some fear there could be more violent riots.Colorful murals now cover La Mesa businesses, destroyed by rioters and looters last weekend. For Kenny Siler, Friday is a big win. "It means the world to be able to come in here," Siler said.He drove his legally blind friends to the Vons grocery store on the first day it reopened. "If there's a good sale, [I get] a whole bunch of Gatorade, and if there's a good chunk of meat I can smoke," he laughed. He's one of the hundreds of La Mesans supporting local businesses as soon as they can. Some shop, some clean, some donate.Next to Vons, California Coast Credit Union still has not reopened. "Both ATM's and inside, everything has been just butchered," the credit union's Sr. VP of Communications, Rene McKee said.They were victims of the riots, but they are also stepping up to help. Friday, the credit union donated ,000 to the La Mesa Business Disaster Recovery Fund. The online Gofundme account continues to grow every hour, far past the original goal of ,000."It's helping to bolster the spirits of the residents here in La Mesa and these small businesses," McKee said. While glimmers of hope begin to flicker, La Mesans still face the reality that what happened last weekend, could happen again. One hundred national guard troops continue to provide added security and prevent property damage, with 100 more on standby in case the situation worsens. For Siler, who is a proud military veteran, he hopes this weekend will bring peace and order. "I support my constitution," Siler said. "Protest. But don't do what you've done," he pointed at the boarded-up walls.The money donated to the La Mesa Business Disaster Recovery Fund will be collected on June 25, 2020. LAKELAND, Fla. -- A 90-year-old Florida man who dressed in full protective gear to say goodbye to his wife, has died of COVID-19.In a Facebook post, Sam Reck's son-in-law shared the news that Sam has died.JoAnn Reck, Sam's wife of 30 years, died a few weeks earlier after battling COVID-19. She was 86 years old and Sam was 90.Sam Reck had been separated from his wife JoAnn Reck during the pandemic after the state placed a ban on visitors at nursing homes. JoAnn lived in a nursing home and suffered from dementia, and Sam lived in an apartment nearby.Family members said the couple would schedule socially-distant visits once Sam couldn't visit the home any more. (KGTV) - Hundreds of La Mesa neighbors came out to clean up and board up businesses Sunday morning.Albert's Fresh Mexican Food owner Albert Garzon said he saw his business get destroyed Saturday night, "there's nothing you can do about it but just watch, it was just so much chaos and just people running left and right."He said when he came back his business was being boarded up by volunteers. "Under the circumstances with the COVID to make matters worse for all these poor business owners that are barely making ends meet before this even started," Garzon said.The entire La Mesa Springs Shopping Center was covered in boards, provided by a local construction company, Meram Building."Before I even got here my business was clean, it was so many volunteers and I was, literally I had tears in my eyes," Chintu Patel, Owner of Menchie's, said.Both Patel and Garzon were thankful to see support, their heartbreak replaced with gratitude and a sense of perseverance."What the people of La Mesa have come out to do for their community is priceless and that's why we're keeping strong and we're La Mesa strong," Garzon said.Neighbors swept up glass, threw out trash and did anything that was needed. About a dozen formed a human assembly line moving merchandise so Play It Again Sports could secure their building."Yesterday there were signs there was rock throwing there was vulgarity, there was accusations against the police, look at today, today there's brooms, there's shovels." Volunteer Mike Raleigh said.An officer said he saw off duty officers in plain clothes helping in the clean up.One neighbor said the reason people became violent Saturday was because that is the only way they felt their message could be heard or inflicting as much pain as they've felt through racism in their lives. 1822
